Article 1 These Provisions are formulated in accordance with the Water Law of People's Republic of China (PRC) and other relevant laws and regulations, as well as the provisions of the Ministry of Water Resources on the allocation of functions, internal institutions and staffing, etc., in order to strengthen the supervision of the water conservancy industry, perform the duties of water conservancy supervision and standardize the water conservancy supervision behavior.

Article 2 The term "water conservancy supervision" as mentioned in these Provisions means that the Ministry of Water Resources and the water administrative departments at all levels perform their duties and supervise the implementation of water conservancy laws, regulations, normative documents and mandatory standards to the water administrative departments at the same level and lower levels, other institutions exercising water administrative duties and their subordinate enterprises and institutions in accordance with their statutory duties and procedures. The "level" mentioned in the preceding paragraph includes internal institutions and subordinate units.

Article 3 Water conservancy supervision shall adhere to the principles of legal compliance, objectivity and fairness, problem-oriented, graded responsibility and overall coordination.

Article 4 The Ministry of Water Resources shall be responsible for coordinating, organizing and guiding the national water conservancy supervision. River basin management agencies shall be responsible for water conservancy supervision within the designated jurisdiction according to their duties and authorization. Local water administrative departments at all levels shall be responsible for water conservancy supervision within their respective administrative areas in accordance with their management authority.

Chapter II Scope and Matters

Article 5 Water conservancy supervision includes: flood and drought disaster prevention, water resources management, river and lake management, soil and water conservation, water conservancy project construction and safe operation, water conservancy fund use, water conservancy government affairs, implementation of major water conservancy policy decisions, etc.

Sixth water conservancy supervision matters mainly include:

(1) Comprehensive planning of rivers and lakes and flood control planning;

(2) Development, utilization and protection of water resources;

(three) water permit, water efficiency management;

(four) the protection and management of rivers and lakes coastline, river sand mining management;

(5) Soil and water conservation and water ecological restoration;

(6) Inter-basin water transfer, water use planning and water allocation;

(seven) irrigation area, rural water supply and rural hydropower resources development;

(8) Prevention of floods and droughts;

(nine) water conservancy construction market, water conservancy project construction and safe operation, safe production;

(ten) the use of water conservancy funds and the implementation of the investment plan;

(eleven) the construction and application of water conservancy network security and informatization;

(twelve) monitoring, operation and management of water conservancy infrastructure such as surface water and groundwater;

(thirteen) the implementation of water conservancy project resettlement and reservoir resettlement support policies;

(fourteen) water supervision and water administrative law enforcement;

(fifteen) water conservancy poverty alleviation;

(sixteen) other water conservancy supervision matters.

Chapter III Institutions and Responsibilities

Article 7 The Ministry of Water Resources shall set up a leading group for water conservancy supervision, coordinate the national water conservancy supervision and inspection work, and organize and lead the supervision institutions of the Ministry of Water Resources. The leading group for water conservancy supervision has an office (hereinafter referred to as the "Supervision Office of the Ministry of Water Resources") to guide the construction and management of the supervision team of the Ministry of Water Resources and undertake the daily work assigned by the leading group for water conservancy supervision. Each river basin management institution shall set up a corresponding water conservancy supervision leading group with an office (hereinafter referred to as "the supervision office of river basin management institutions"), and set up an inspection team of river basin management institutions to undertake corresponding responsibilities. The provisions referred to in the "Ministry of water resources supervision institutions" refers to the Ministry of water resources supervision room, as well as relevant departments, institutions, river basin management institutions, water administrative law enforcement and other relevant units with relevant responsibilities.

Eighth responsibilities of the leading group of water conservancy supervision work of the Ministry of water resources:

(a) decision-making water conservancy supervision work, planning key work of water conservancy supervision;

(two) examination and approval of water conservancy supervision rules and regulations;

(three) leading the construction of water conservancy supervision team;

(four) examination and approval of water conservancy supervision plan;

(five) to consider the major problems found in the supervision and inspection;

(six) accountability for major issues;

(7) Other supervisory duties.
