Three kinds of residence permits for emigrating to France
Article 1 Three kinds of residence permits for emigrating to France
?
For some foreign immigrants, a phased transition method can be adopted, from one residence qualification to another until they obtain permanent residence qualification. Different residence qualifications are reflected in different residence permits. France implements a residence permit system for foreign labor immigrants who are allowed to enter the country. Foreigners holding immigration permits must apply for residence permits. The residence permit corresponds to the residence qualification and is also divided into three categories. Immigrants who enter the country need to apply for residence permits with different validity and use effects according to different nationalities and identities. At the same time, you must apply for the corresponding labor certificate before you can be allowed to work. Residence permit mainly has the following types:
(1) Temporary residence permit
The validity period is 1 year. If the time limit is exceeded, you can apply for an extension to continue using it. During the period of residence, the holder of this certificate will be restricted by the workplace and occupation category when applying for a job. The residence permit clearly indicates the occupation and work area of the holder. The holder must engage in the designated occupation in the designated area.
(2) Ordinary residence permit
The validity period is 3 years, which can be extended after expiration. When looking for a job, the holder of the certificate has only geographical restrictions, but there is no restriction on working. In the designated area, the holder can choose a certain occupation or exchange another occupation.
(3) Long-term residence permit
The validity period is 10 year, and the extension formalities can be handled after the expiration. The certificate is mainly issued to the spouses, children and parents of immigrants, as well as French citizens from countries that have signed immigration treaties with France. The holder can engage in any occupation or work without being restricted by region or occupation category when he is employed.
French law stipulates that ordinary residence permit holders can apply for long-term residence permits. However, holders of temporary residence permits and contract residence permits, as well as tourists and international students, cannot apply for long-term residence permits.
Article 2 Application conditions and procedures for French immigrants
1. Application conditions
In order to reduce the number of foreign immigrants, the French government has very strict restrictions on foreigners who apply for entry as immigrants. Immediate family members of non-French citizens or foreign nationals, specially approved contract workers and political asylum seekers are not allowed to obtain immigration permits. Only those who meet the following conditions can be approved:
(1) French citizens' spouses, unmarried couples, children under the age of 2/kloc-0, parents, etc.
(2) spouses of foreigners who have obtained long-term residency and children under the age of 18;
(3) Accepting the employment of the employer, and the labor contract industry is approved by the Immigration Bureau;
(4) Refugees whose status has been approved and who have obtained the legal right of abode.
2. Application procedures
The French embassy in China is not responsible for accepting immigration applications. Therefore, if China citizens intend to move to France, they should first apply to the French Immigration Bureau by their French relatives, namely the entry guarantor. The specific procedures are as follows:
(1) The guarantor applies to the governor of the province where he is located, and at the same time delivers proof of residence, identification, proof of the guarantor's residence and economic conditions, such as rent receipt, electricity and gas receipt, and proof of kinship showing the relationship between the two parties. The last kind of proof needs to be handled by the applicant in our country at the notary office of his place of residence. After being certified by the Chinese Embassy in France, it should be submitted to the French authorities.
(2) After accepting the application, the Governor will forward all the materials to the Immigration Bureau for detailed investigation. After investigation, if the guarantor is a French citizen or a foreigner with long-term residency, and his living area and economic income meet the conditions of family reunion, he can obtain an entry permit.
(3) If the entry is approved, the Immigration Bureau will notify the embassy in China, and then the embassy will send a notice to the applicant and start the visa formalities.
(4) After receiving the notice from the French Embassy in China, the applicant first goes to the local provincial or municipal hospital for physical examination, and the report of the examination results must be signed by the doctor and stamped with the official seal.
(5) Finally, apply for an entry visa at the French Embassy in China with a notice, passport, health certificate and my photo.
Article 3 French immigration application fee
1. First, the applicant shall pay the specified materials and RMB 1 000 yuan, and the materials shall be verified by lawyers and accountants, and the qualifications of the applicant shall be preliminarily examined. Pre-trial will take about 1 month.
2. Once the pre-trial is passed, the materials will be sent to French law firms and accounting firms for review after the applicant pays the second fee of 90,000 yuan. Review time needs more than 2 months.
3. After approval, the applicant needs to pay a third fee of RMB 200,000. At the same time, the applicant will set up a limited liability company or unlimited liability company on a voluntary basis, and pay the registered capital into the applicant's bank according to the requirements of French lawyers (the registered capital has nothing to do with 300,000 yuan).
After all the formalities are completed, the applicant's information will be submitted to the relevant departments of the French government by French lawyers. It takes 3-6 months or more for the French government to vet applicants.
Once the application is accepted, the applicant will pay the last 40,000 RMB and get the certificate of French businessman.
6. If the applicant fails to register a company in France and obtain a business license, all the money will be refunded to the applicant.
7. After holding a business card, the applicant can stay in France and enter and leave freely within one year. Unlike the United States and Canada, France's permanent residence permit does not require a certain period of residence in the country, which is the so-called immigration prison. From the first day after obtaining French residence, you can travel freely to and from China and all European countries that need Schengen visas without a visa.
8. For the renewal formalities in the second year, you only need to provide utilities invoices or telephone bills or proof of housing, and report the company's operation and work to the police station, which will renew the residence visa in the second year after collecting taxes of more than ten euros.
9. The spouses and minor children of foreigners who have obtained the permanent residence permit in France can go to France for family reunion after staying in Europe for one year, and they can obtain the permanent residence permit in France.
10. You can apply for naturalization after obtaining a work visa for 3 years.
