Regulations of Zhejiang Province on Safety Management of Water Conservancy Projects

Chapter I General Provisions Article 1 In order to strengthen the safety management of water conservancy projects, ensure the safe and normal operation of water conservancy projects and give full play to the efficiency of water conservancy projects, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Flood Control Law of People's Republic of China (PRC), the Regulations of the State Council on the Quality Management of Construction Projects and other laws and administrative regulations. Article 2 These Regulations shall apply to the safety management of water conservancy projects within the administrative area of this province.

The term "water conservancy project" as mentioned in these Regulations refers to various projects for the development, utilization, control, allocation and protection of water resources, including reservoirs (including mountain ponds, the same below), hydropower stations, sluices (including culvert gates, the same below), dikes (including revetment, the same below), pumping stations, aqueducts, inverted siphons, ditches, weirs, electromechanical wells and water pipelines. Article 3 People's governments at or above the county level shall strengthen their leadership over the safety management of water conservancy projects, coordinate and solve major problems in the safety management of water conservancy projects within their respective administrative areas, urge relevant departments to perform their safety management duties according to law, ensure the safe and normal operation of water conservancy projects, and give full play to the role of water conservancy projects in the development and utilization of water resources and disaster prevention and mitigation. Article 4 The water administrative department of the people's government at or above the county level (hereinafter referred to as the water administrative department) shall be responsible for the supervision and management of water conservancy projects within their respective administrative areas.

Development and reform, finance, land and resources, construction (planning), environmental protection, transportation, electric power, agriculture, forestry, production safety supervision, civil affairs and other departments shall, according to their respective responsibilities, do a good job in the supervision and management of water conservancy projects.

Township people's governments (including street offices, the same below) are responsible for the supervision and management of water conservancy projects built and managed by rural collective economic organizations within their respective administrative areas and other water conservancy projects determined by county-level people's governments. Article 5 Water conservancy projects shall be managed by classification. Classification and grading standards for water conservancy projects shall be implemented in accordance with the relevant provisions of the state and the province.

The people's governments at or above the county level shall strengthen the safety supervision of water conservancy projects such as reservoirs, hydropower stations, large and medium-sized sluices, dikes, large pumping stations, aqueducts, ditches with a flow of more than one cubic meter per second, etc., which have an important impact on the safety of people's lives and property. The water administrative department is responsible for the industry management of water conservancy project safety. The water administrative department and other water conservancy project departments are responsible for the safety management of water conservancy projects directly managed by them.

The water conservancy project management unit is directly responsible for the safety of the water conservancy projects it manages. Chapter II Project Quality and Construction Safety Article 7 Water conservancy construction projects shall go through the formalities of project examination and approval, approval or filing in accordance with the authority and procedures prescribed by the state and the province.

Water conservancy construction projects that need to be submitted for examination and approval shall, at the same time as formulating water conservancy construction plans, formulate management plans, and clarify matters such as management units, sources of management funds, and safeguard measures after the completion of water conservancy projects.

The preliminary design documents and construction drawing design documents of water conservancy construction projects shall be reviewed in accordance with the relevant provisions of the state and the province. Eighth water conservancy projects involving project site selection, land (water) use, environmental protection, resettlement and other management activities, in accordance with the provisions of urban and rural planning, land (water), environmental protection, resettlement, geological disaster prevention and control and other relevant laws and regulations. Ninth water conservancy construction projects shall conform to the comprehensive planning of river basins, and those involved in flood control shall conform to the flood control planning. The water administrative department shall, in accordance with the law, review and sign opinions on whether the water conservancy construction project conforms to the comprehensive river basin planning and flood control planning. Tenth design units should undertake design business within the scope of their qualification grade. Design units and designers shall design in accordance with laws, regulations and mandatory standards for engineering construction, and affix their seals and signatures on the design documents. Design units and designers are responsible for the design quality of water conservancy projects, and undertake corresponding quality and safety responsibilities within the design service life. Eleventh supervision units shall undertake supervision business within the scope of their qualification grades.

When undertaking the supervision business, the supervision unit shall, according to the needs, assign supervisors with corresponding qualifications to the construction site for on-site supervision. During the construction of important parts of the project and concealed works, supervisors should conduct on-site supervision of the whole process; Without the implementation of the whole process of on-site supervision, the supervision personnel shall not sign the supervision opinions. Twelfth construction units should undertake construction business within the scope of their qualification grade.

The construction unit shall establish and implement the responsibility system for production safety to ensure the safety of the project construction and during the construction period.

When a production safety accident occurs in the process of water conservancy project construction, the construction unit shall report to the safety production supervision department and the water administrative department in accordance with the relevant provisions. Thirteenth water conservancy project construction units in the preparation of the project budget, it should determine the safe working environment of the construction project and the cost of safety construction measures, clear construction safety measures.

Water conservancy project construction units shall not put forward requirements that violate safety production regulations or mandatory standards for survey, design, construction and supervision units.
