Regulations on Ecological Environment Protection of Songtao Reservoir in Hainan Province (revised 20 17)

Article 1 In order to strengthen the protection and management of the ecological environment of Songtao Reservoir and give full play to the comprehensive benefits of Songtao Reservoir, these Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 Songtao Reservoir as mentioned in these Provisions refers to the main project, reservoir area and channels of Songtao Reservoir (including tailrace, main canal, main canal and branch canal). Article 3 The water administrative department of the provincial people's government is in charge of the water resources and soil and water conservation of Songtao Reservoir. Songtao water conservancy project management institution established by the water administrative department of the provincial people's government is responsible for the specific work of Songtao reservoir management.

The competent department of environmental protection of the provincial people's government shall supervise and manage the water environmental protection and water pollution prevention and control of Songtao Reservoir.

The competent departments of land, forestry, fishery, agriculture, public security, transportation, tourism, planning and construction of the provincial people's government and the people's governments of Baisha, Danzhou, Qiongzhong, Chengmai, Lingao, Haikou and other cities, counties and autonomous counties (hereinafter referred to as the people's governments of relevant cities, counties and autonomous counties) shall, according to their respective functions and duties, make concerted efforts to protect the ecological environment of Songtao Reservoir.

The competent department of environmental protection of the provincial people's government and the people's governments of relevant cities, counties and autonomous counties, as well as other relevant competent departments, may entrust the Songtao water conservancy project management institution to implement the power of administrative punishment involving the management of Songtao Reservoir. According to the actual needs of Songtao Reservoir management, the provincial people's government established a comprehensive law enforcement system in a timely manner. Article 4 The provincial people's government and the people's governments of relevant cities, counties and autonomous counties shall incorporate the ecological environment protection of Songtao Reservoir into the national economic and social development plan.

The water administrative department and the environmental protection department of the provincial people's government shall, jointly with the relevant departments and the people's governments of cities, counties and autonomous counties, prepare the ecological environment protection plan of Songtao Reservoir, and submit it to the provincial people's government for approval before implementation. Article 5 The provincial people's government and the people's governments of relevant cities, counties and autonomous counties shall increase their investment in the ecological environment protection of Songtao Reservoir year by year.

The provincial people's government set up a special fund for ecological environment protection of Songtao Reservoir. Article 6 The provincial people's government shall establish an ecological compensation mechanism for Songtao Reservoir. Specific measures shall be formulated by the provincial people's government. Article 7 The provincial people's government and the people's governments of relevant cities, counties and autonomous counties shall strengthen the land management in Songtao reservoir area and the post-resettlement support work, properly solve the problems left by the land and immigrants in the reservoir area, and gradually establish a long-term mechanism to promote the improvement of the ecological environment, economic development, income increase of immigrants and social stability in the reservoir area. Article 8 Land (including islands in the reservoir) and water surface below the design flood level line (193.438+0m contour line) in Songtao reservoir area; Within the outer slope toe on both sides of the water conveyance channel and filling channel section of Songtao Reservoir; The management scope is within the excavation point of both sides of the excavation canal section or the outer shoulder line of the canal top (if there is a drainage ditch, the drainage ditch shall prevail).

The design flood level line of Songtao reservoir area extends horizontally outward within 400 meters; The extension of the main dam of the reservoir is 500 meters, the extension of both sides of the abutment of the auxiliary dam and the foot of the backwater slope is 100 meters, and the extension around the spillway is within 500 meters; The scope of protection is within 3m or 5m (5m for tailrace, main canal and branch canal, and 3m for branch canal) from the toe of slope of self-filled channel or the excavation point of excavated channel or the outer shoulder line of canal top (the drainage ditch shall prevail if there is one).

The specific boundaries of the management and protection scope of Songtao Reservoir shall be delineated by the competent department of water and soil administration organized by the provincial people's government, and signs shall be erected and announced. Article 9 The following acts are prohibited within the protection scope of Songtao Reservoir:

(1) Damming, reclamation, blasting, drilling, quarrying, mining and grave repairing;

(2) Dumping and burying toxic and harmful wastes such as radioactive substances;

(3) Setting up warehouses and stacks of toxic and harmful chemicals;

(four) the application of highly toxic, highly toxic and highly residual pesticides;

(five) the discharge of pollutants exceeds the national standard;

(six) other acts of sabotage in violation of laws and regulations.

It is forbidden to carry out activities that endanger dam safety, such as blasting, drilling wells, quarrying, mining, dredging, borrowing soil and repairing graves, within the scope of dam management and protection. Article 10 In addition to the acts prohibited in Article 9, the following acts are also prohibited within the management scope of Songtao Reservoir:

(1) Building livestock and poultry farms;

(two) set up a dock for loading and unloading garbage, feces, oil and toxic substances;

(3) Dumping, stacking and storing mud, stones, slag, garbage and other solid wastes on beaches and coasts;

(4) Planting crops below the normal water level line (190m contour line);

(5) Fried fish, poisonous fish and electric fish;

(six) unauthorized fishing bonito, big fin loach, eel and other rare fish and larvae;

(7) Cleaning vehicles, containers and other articles loaded with toxic pollutants;

(eight) vehicles driving on the crest, crest and dam without approval;

(nine) other acts in violation of laws and regulations. Eleventh Songtao Reservoir drinking water source protection areas shall be designated by the provincial people's government according to law, and classified management shall be implemented in accordance with the relevant provisions of the state.

The provincial people's government and the people's governments of relevant cities, counties and autonomous counties shall erect landmarks in the drinking water source protection area of Songtao Reservoir. Twelfth prohibit the establishment of sewage outlets in Songtao Reservoir drinking water source protection areas.

Construction projects unrelated to water supply facilities and water source protection are prohibited in the first-class protection zone of drinking water source of Songtao Reservoir; Construction projects that have been completed and have nothing to do with water supply facilities and water source protection shall be ordered to be dismantled or closed by the people's governments at or above the county level.

It is forbidden to build, rebuild or expand construction projects that discharge pollutants in the secondary protection zone of drinking water source of Songtao Reservoir; The people's governments at or above the county level shall order the completed construction projects that discharge pollutants to be dismantled or closed.
