Provisions of the Standing Committee of Kunming Municipal People's Congress on discussing and deciding major issues (revised on 20 15)

Article 1 In order to ensure and standardize the Standing Committee of Kunming Municipal People's Congress (hereinafter referred to as the Standing Committee of the Municipal People's Congress) to exercise its functions and powers according to law, discuss and decide on major issues within its administrative area, according to the provisions of the Constitution of People's Republic of China (PRC), the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at Various Levels, the People's Republic of China (PRC) Supervision Law, the Standing Committees of People's Congresses at Various Levels and other laws and regulations. Article 2 The term "major issues" as mentioned in these Provisions refers to matters that are related to the overall situation of reform, development and stability and the vital interests of the people in the construction of economic, political, cultural, social and ecological civilization within their respective administrative areas and are of general concern to the society and discussed, decided or put on record by the Standing Committee of the Municipal People's Congress. Article 3 The Standing Committee of the Municipal People's Congress shall, under the leadership of the Kunming Municipal Committee, focus on the overall situation of the city's work, fully promote democracy, and discuss and decide on major issues in accordance with legal authority and procedures. Article 4 The following major issues shall be submitted to the Standing Committee of the Municipal People's Congress for deliberation or review, and corresponding resolutions and decisions shall be made:

(a) to ensure that the Constitution, laws and regulations, as well as the resolutions and decisions of the people's congresses at higher levels and their standing committees and the people's congresses at the corresponding levels are observed and implemented in this Municipality;

(two) major decisions and arrangements to promote the rule of law and strengthen the construction of Kunming under the rule of law;

(three) major reform measures involving the vital interests of the people in the economic construction and social development of this Municipality;

(four) the five-year plan for national economic and social development, and the adjustment plan of the plan;

(five) the municipal budget adjustment plan and the draft final accounts of the previous year and the net balance of funds;

(6) To annul inappropriate resolutions and decisions of the people's congress at the next lower level and its Standing Committee, as well as inappropriate decisions and orders of the people's government at the same level;

(seven) major issues submitted by the Standing Committee of the Municipal People's Congress for deliberation and decision;

(eight) the city and foreign local governments to conclude sister city relations;

(9) Granting or revoking local honorary titles such as honorary citizens;

(ten) according to the provisions of relevant laws and regulations, other major issues that should be considered and decided by the Standing Committee of the Municipal People's Congress. Article 5 The following major issues shall be reported to the Standing Committee of the Municipal People's Congress. When necessary, the Standing Committee of the Municipal People's Congress may make corresponding resolutions and decisions:

(a) major issues in the implementation of the basic national policies of this Municipality, such as population and family planning, environment and resource protection;

(two) the implementation of the municipal national economic and social development plan and the local financial budget;

(three) the mid-term evaluation of the implementation of the five-year plan for national economic and social development;

(four) the municipal budget implementation and other financial revenue and expenditure audit, as well as the rectification and treatment results of the problems pointed out in the audit work report;

(five) the Municipal People's government to fulfill the responsibilities of investors and the supervision and management of state-owned assets;

(six) in addition to the city's national economic and social development plan, the establishment and construction of major projects invested by the municipal financial funds;

(seven) the preparation, revision and implementation of urban and rural planning in this Municipality;

(eight) employment, schooling, medical care, social security, housing security, food safety, public cultural services, urban and rural construction, poverty alleviation and development, resettlement and rural economic and social development;

(nine) the completion of the city's ecological environment and environmental protection objectives and the disposal of major environmental events, Dianchi Lake management, Yangzonghai protection, Songhuaba Reservoir, Yunlong Reservoir, Qingshuihai and other key water sources ecological environment protection;

(ten) the protection of historical and cultural cities, scenic spots and nature reserves;

(eleven) major natural disasters, public health emergencies, major animal diseases, major pollution accidents and major safety accidents that have caused serious losses to the state, collective property and citizens' lives and property, and their investigation and handling;

(twelve) the preparations for the international and domestic large-scale activities sponsored by the Municipal People's government;

(thirteen) to investigate serious cases of violation of law and discipline of state organs elected or appointed by the Municipal People's Congress and its Standing Committee;

(fourteen) major issues that the Standing Committee of the Municipal People's Congress considers should be reported to the Municipal People's government, the Municipal Intermediate People's Court and the Municipal People's Procuratorate;

(fifteen) other major matters that should be reported in accordance with laws and regulations. Article 6 The Municipal People's Government shall report the following major issues to the Standing Committee of the Municipal People's Congress for the record within one month from the date of approval according to law:

(1) Adjustment or change of the administrative divisions of this Municipality;

(two) the establishment, adjustment or change of the working department of the Municipal People's government;

(three) summary of the final accounts submitted by the Municipal People's government to the next level government for the record;

(4) Detailed urban regulatory planning;

(five) other major matters that should be filed with the Standing Committee of the Municipal People's Congress in accordance with the provisions of relevant laws and regulations. Article 7 The major issues stipulated in Articles 4 and 5 of these Provisions shall be put forward in the form of bills or reports; Major issues specified in Article 6 shall be put forward in the form of filing reports. Article 8 The following organs or personnel may submit motions or reports on major issues to the Standing Committee of the Municipal People's Congress according to law:

(a) the meeting of directors of the Standing Committee of the Municipal People's Congress;

(2) Municipal People's Government, Municipal Intermediate People's Court and Municipal People's Procuratorate;

(3) Special committees of the Municipal People's Congress;

(four) five or more members of the Standing Committee of the Municipal People's Congress jointly signed in writing.
