Measures of Chengdu Municipality on Implementing the Regulations on River Management in People's Republic of China (PRC) (revised in 2006)

Article 1 In order to strengthen the management of river courses, ensure the safety of flood control, and give full play to the comprehensive benefits of river courses, these implementation measures are formulated in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) River Management Regulations and other laws and regulations, combined with the actual situation in Chengdu. Article 2 These Measures shall apply to rivers within the administrative area of Chengdu, including artificial waterways, flood discharge areas and flood storage and detention areas. Article 3 The municipal water administrative department is the competent authority of rivers within the administrative area of this Municipality, and is responsible for the unified management of rivers.

The water administrative departments of all districts (cities) and counties are the river authorities within their respective administrative areas, and are responsible for the unified management of rivers. Article 4 The chief executive of the local people's government shall be responsible for flood control and obstacle removal in river courses. Article 5 River regulation and construction shall conform to the comprehensive planning of river basins, flood control standards, navigation standards and other relevant technical requirements stipulated by the state, maintain the safety of dikes, and maintain the stability of river regime and smooth flood discharge.

Flood control standards for rivers: Rivers within the administrative divisions of Jinjiang, Qingyang, Jinniu, Wuhou and chenghua district shall be protected against floods with a return period of 70 years before 2030 and floods with a return period of 200 years after 2030; River courses in key flood control towns determined by district (city) and county people's governments and municipal water administrative departments outside five urban areas shall meet the flood control standard of once every 20 to 50 years; Rivers in other areas should adopt flood control measures, and the flood control standard is 10 to once every 20 years. Article 6 For the construction and development of various water conservancy projects, prevention and control of water disasters, regulation of river courses, construction of bridges, wharves, roads, ferries, pipelines, cables and other river-crossing buildings and facilities, the construction unit must report the project construction plan to the river authorities for examination and approval in accordance with the river management authority before going through the examination and approval procedures in accordance with the basic construction procedures.

After the construction project is approved, the construction unit shall inform the river authorities of the construction arrangements. The project completion acceptance shall be attended by the river authorities. Do not meet the design standards or unqualified acceptance, shall not be put into use.

If all kinds of buildings and facilities that have been built do not meet the flood control standards prescribed by the state, the river authorities shall order the original construction unit to rebuild or dismantle them within a time limit. Article 7 The construction of river-crossing bridges, wharves, pipelines, lines and other facilities must meet the requirements of flood control and navigation, and the flood passage shall not be reduced, and the stability of river regime shall not be affected. Those who damage water conservancy projects shall bear corresponding liability for compensation. Article 8 It is forbidden to unilaterally build drainage, water blocking, water diversion and water storage projects and river regulation projects in districts (cities) and counties that use rivers to ease or cross regions (cities) without an agreement reached by relevant parties or the approval of the river authorities at the next higher level. Ninth according to the flood control planning, dredging rivers, strengthening dikes and regulating rivers need to occupy land, which shall be adjusted by the people's governments at or above the county level, and the land management department shall go through the formalities for land use according to law.

The available land increased due to the construction of reservoirs and river regulation shall be owned by the state and used by the people's governments at or above the county level for resettlement and river regulation projects. Tenth rivers within the administrative area of this Municipality shall implement the principle of combining unified management with hierarchical management according to the water system. In addition to the main streams of provincial rivers such as Minjiang River, Tuojiang River, Puyang River (including Qingbaijiang River), Baitiaohe River (including Pi River), Zouma River, Jiang 'an River, Shagou River and Heishi River, there are many rivers such as Minjiang River, Beihe River, Xihe River, Nanhe River, Xiejiang River, Chujiang River, Pujiang River, Linxi River, Jinjiang River and Center. The remaining rivers are managed by the district (city) and county river authorities. Eleventh city river authorities are responsible for organizing the formulation of municipal river regulation planning, flood control planning and flood control emergency plan; Responsible for the examination and approval of the city's river water project construction; Responsible for the examination and approval of the establishment and expansion of municipal river sewage outlets; Responsible for the examination and approval of river dredging and sand mining schemes; Responsible for the examination and approval of relevant construction projects within the scope of river management.

The municipal river authorities may entrust the municipal river management authorities of districts (cities) and counties other than the central city to be responsible for the specific management work. Article 12 The management scope of a river section with dikes includes waters, sandbanks, beaches (including cultivated land), flood discharge areas, dikes on both sides of the river and dike protection areas. The scope of river embankment management shall be delineated in accordance with the following provisions:

(a) the Minjiang River (including Jinma River) and Tuojiang River are 30 meters away from the toe of the embankment;

(2) Yujiang, Beihe, Xihe, Nanhe, Xiejiang, Chujiang, Pujiang, Linxi and Jinjiang (except the central city) are 20 meters away from the toe of the embankment;

(3) The management scope of river courses in districts (cities) and counties is embankment toe10m;

(four) the scope of the berm of the river in the central city shall be drawn up by the municipal river authorities and reported to the municipal government for approval.

The management scope of river courses without dikes shall be determined according to flood control planning or design flood level. Thirteenth river dike safety protection zones shall be determined according to the importance of dikes, embankment foundation soil conditions and other factors, in accordance with the following provisions:

(1) The distance between Minjiang River (including Jinma River) and Tuojiang River is 100 m;

(two) Yujiang, Beihe, Xihe, Nanhe, Xiejiang, Chujiang, Pujiang, Linxi, Jinjiang (except the central city) 50 meters outside the berm;

(three) the district (city) county management river is 20 meters away from the berm.
