Common misunderstandings and solutions of Dutch high-tech immigrants

I KM= immigration

There are two reasons for being misunderstood as successful immigration when applying for KM:

1.KM is the abbreviation of Kennismigrant in Dutch, and the official translation on IND is: Highlyskilledmigrants, that is, high-tech immigrants.

2. You can get a visa for up to 5 years by applying for KM.

But in fact, KM is an "advanced" work visa, which is neither naturalization nor permanent residence. To apply for permanent residence or naturalization, you need to live continuously and effectively for more than five years and pass the Dutch A2 exam.

2. Maximum residence is 5 years = you can stay in the Netherlands for 5 years.

How long you can stay actually depends on how many years you signed the labor contract with the Dutch company.

? If you only have a 1 year labor contract, you can only stay in the Netherlands for one year.

? If you are fired/laid off or leave your job automatically after working for half a year, KM will expire.

? If you sign an indefinite contract (permanent contract) with the company, KM can only give you a residence of 5 years at most, which can be renewed later.

* The official statement is: "Those who fail to renew their contracts in time must leave the country before or on the same day as the deadline. KM fails to leave the country in time and fails to communicate with IND. If it is found, it will be forcibly repatriated; It may lead to a ban on entering any Schengen country for up to 5 years; The record of overdue departure may also lead to subsequent refusal. "

However, there are also some sayings that if the layoffs are caused by non-personal factors, the company can inform IND, and IND will give the applicant a three-month residence period to find a job. However, since there is no official regulation, it is recommended to contact IND for a solution before leaving the company.

Third, KM has the requirements of age, education and capital.

KM is not an investment immigrant. Generally, these requirements are immigration agents, not official application requirements.

There are only two conditions for applying for KM: labor contract+salary standard.

* Your company needs to have KM qualification (approved sponsor), and all companies with KM qualification are listed on IND. You can check it if necessary.

4. Only KM can apply for a 30% ruling.

KM is often associated with 30% award on the Internet, and some articles list KM as a prerequisite for applying for 30% award. But in fact, 30% of the rulings have nothing to do with KM.

Let me explain the 30% ruling first: the 30% ruling is a Dutch tax preference, and 30% of the wages of qualified foreign employees can be exempted from tax.

The ruling of applying for 30% is only for the identity of the applicant (except for employees of the company and self-employed); The applicant's place of residence (within 24 months before employment, living within150km from the Dutch border for no more than 16 months); And the salary level of the applicant.
