List of flood discharge compensation standards in Henan Province

Legal analysis: the main part of the legal houses and other ancillary buildings suffered by farmers with permanent residence in this area due to flood diversion and storage are not included in the compensation scope. Residents in the region who enjoy the unified national housing subsidy policy after the disaster will not be compensated for their housing losses. Those who have arranged for the relocation of immigrants and obtained corresponding subsidy funds will not be compensated if their old houses are destroyed by floods. In 2020, if the resettlement plan is arranged for the flood storage and detention areas that have been used, the loss of houses damaged by water will not be compensated.

Article 30 During the emergency flood control period, the flood control headquarters of the local people's government must be presided over by the person in charge of the people's government, and organize and mobilize all relevant units and individuals in the region to participate in flood control and emergency rescue. All units and individuals must obey the command and undertake the flood fighting and emergency rescue tasks assigned by the flood control headquarters of the people's government.

Article 32 During the emergency flood control period, the flood control headquarters shall have the right to allocate materials, equipment, means of transportation and manpower needed for flood control and emergency rescue within its jurisdiction, and shall return them in time or give appropriate compensation afterwards. No unit or individual may take up land, cut down trees or remove water blocking obstacles for emergency rescue. Those who cut down trees by taking soil and covering an area mentioned in the preceding paragraph shall go through the formalities with the relevant departments according to law afterwards.
