Legal analysis: If the debtor is inclined to emigrate, it may be accompanied by evasion of debts. Although the other party can go to court when emigrating abroad, the probability of getting the money back is obviously smaller than that at home. It is suggested to file a lawsuit as soon as possible and submit an application for restriction of departure. The court will send a letter to the exit and entry administration department of the public security organ, requesting that the other party be restricted from leaving the country before the dispute is resolved. This can effectively prevent the other immigrants from evading debts.
Legal basis: Article 119 of the General Principles of Civil Law of People's Republic of China (PRC) must meet the following conditions: (1) The plaintiff is a citizen, legal person and other organization that has a direct interest in the case; (2) Having a clear defendant; (3) Having specific requests, facts and reasons; (4) It falls within the scope of civil litigation accepted by the people's court and is under the jurisdiction of the sued people's court.
