(4) Water conservancy projects involving rivers shall be reviewed by the corresponding first-level water administrative department according to the hierarchical management authority of the river course. Article 8 When constructing a water conservancy project, during the design and construction, the comprehensive benefits of the water conservancy project shall be fully considered, and necessary conditions shall be created for the management and protection of the project according to local conditions. Article 9 Land acquisition compensation and resettlement for the construction of large and medium-sized water conservancy projects shall be handled in accordance with the State Council’s Regulations on Land Acquisition Compensation and Resettlement for the Construction of Large and Medium-sized Water Conservancy and Hydropower Projects.
The adjustment, compensation and personnel resettlement of land for the construction of small water conservancy projects shall be handled in accordance with relevant provincial and municipal regulations. Chapter 3 Management and Protection Units Article 10 Water conservancy projects shall establish corresponding management and protection units or be equipped with specialized management personnel in accordance with the following provisions: (1) Water conservancy projects invested and constructed by the state shall be approved by the people at or above the county level in accordance with the law. The government or the water administrative department at the same level approves the establishment of management and protection units;
(2) Water conservancy projects jointly constructed with state investment and rural collective funds shall be jointly constructed by the water administrative department, the local people's government and the rural The collective leaders jointly formed the project irrigation area management committee and established a management and protection unit. Among them, the management and protection units of small (I) type or above and small (II) type water conservancy projects with important locations should report to the people's government at or above the county level or the water administrative department at the same level for approval;
(3) Rural collectives For water conservancy projects invested and constructed by investors or other units and individuals, the investors shall independently establish management and protection units or assign specialized management personnel, and report them to the county-level water administrative department for record. Article 11 Responsibilities of water conservancy project management and protection units:
(1) Promote and implement relevant laws, regulations, rules, policies, decisions and orders, and mobilize the masses to manage and utilize water conservancy projects well;
(2) In accordance with the requirements of water conservancy project management specifications, formulate daily management rules and operating procedures; do a good job in project inspection, observation and data compilation, and understand the project dynamics;
(3) Repair and maintain water conservancy projects and ancillary facilities and equipment, keep engineering equipment in good condition, and ensure normal operation of engineering facilities;
(4) Understand meteorological forecasts and hydrological forecasts, and monitor rain conditions, water regimes, project safety status and upstream related situation, and timely carry out dispatching and flood prevention and relief work;
(5) Do a good job in project greening and soil and water conservation;
(6) Actively carry out comprehensive operations to improve the economic benefits of the project ;
(7) Plan water use, save water, ensure farmland irrigation, collect and manage water and electricity fees in accordance with regulations;
(8) Carry out scientific experiments and technology Innovation, give full play to the potential of engineering equipment, and gradually realize the modernization of engineering management;
(9) Provide ideological and political education and technical training to employees.
The responsibilities of the personnel in charge of water conservancy projects shall be implemented with reference to the provisions of the preceding paragraph. Article 12 The person in charge, accountants and technical personnel of the water conservancy project management and protection unit shall have corresponding management capabilities and professional knowledge, and obtain corresponding qualifications in accordance with the law. Article 13: For irrigation projects spanning villages and above in rural areas, the irrigation district representative meeting system shall be implemented.
