Provisions of Xiamen Municipality on the Administration of Water Projects

Chapter I General Provisions Article 1 In order to strengthen the protection and management of water projects and give full play to the benefits of water projects, these Provisions are formulated in accordance with the Water Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "water projects" as mentioned in these Provisions refers to water storage, water diversion, flood control, reclamation, tidal retention, irrigation and drainage, hydropower generation, water supply for villages and towns and other water projects.

Urban water supply and urban flood control projects shall be managed in accordance with the relevant provisions of the state and the municipal government. Article 3 The municipal water administrative department is the competent authority of water projects in this Municipality, and is responsible for the planning, construction, management and coordination of water projects in this Municipality.

The district water administrative department is the competent authority of water projects within its jurisdiction, and is responsible for the planning, construction, management and coordination of water projects within its jurisdiction under the guidance of the municipal water administrative department.

Land, planning, municipal administration, agriculture, forestry, environmental protection, highways and other relevant administrative departments. In accordance with national laws and regulations, cooperate with water administrative departments to manage water projects within their respective responsibilities. Article 4 Water projects built by the state are owned by the state; Water conservancy projects built by villages and towns with self-raised funds shall be collectively owned by villages and towns; The ownership of water projects invested by other sources of funds may be determined according to the joint venture or investment contract, but it shall not violate the relevant provisions of the state. Water projects assisted by private offices are managed by beneficiary towns and villages. Article 5 All units and individuals have the obligation to protect water projects and have the right to stop acts that damage water projects. Article 6 Units and individuals that have made outstanding contributions to water protection projects shall be rewarded. Chapter II Management Organization of Water Projects Article 7 A management organization shall be established for state-owned water projects.

Collectively-owned small (1) water projects and seawalls with an area of 1000 mu or more should have management institutions, and other small water projects should implement the responsibility system of "who benefits, who manages and who is responsible" for safety management and maintenance, and should have full-time or part-time management personnel. Article 8 Water project management institutions or managers (hereinafter referred to as management units) shall regularly inspect and observe water projects, record the results, sort out and file them, and formulate maintenance, emergency rescue, reinforcement or transformation plans in view of the problems existing in water projects, so as to eliminate hidden dangers in time and ensure the safe operation of the projects. Ninth water project management units in the discovery of dangerous situations that may endanger the safety of the project, should take emergency rescue measures to ensure the safety of the project, and promptly report to the higher authorities. Tenth small (two) above the reservoir management unit shall, before the annual flood season, prepare the limited water level of the reservoir, and report it to the district water administrative department and the flood control and drought relief headquarters for approval. For important small (I) reservoirs, the flood limit water level shall be reported to the municipal water administrative department and the flood control and drought relief headquarters for approval. The management unit of medium-sized and above reservoirs shall also prepare the reservoir flood control plan and report it to the municipal water administrative department and the flood control and drought relief headquarters for approval. If it is necessary to modify the flood control plan due to special circumstances, it must be approved by the original approval department.

The reservoir shall not exceed the flood limit water level. Eleventh reservoirs, seawalls responsible for flood control and security should go deep into the project site, understand the water situation, dangerous situation, responsible for solving related problems. After the release of the disastrous meteorological warning affecting the local area, it shall arrive at the scene in time to organize and direct the flood control and disaster relief work. Twelfth water projects to implement the principle of combining professional management with mass management. Each village should have a team leader in charge of water, and each villager group should have a part-time water administrator; Irrigation districts with an area of 1 10,000 mu or more shall establish an irrigation district congress system and an irrigation district management committee to discuss and decide on major issues such as management and protection of irrigation district water projects. Chapter III Construction of Water Projects Article 13 New construction, reconstruction and expansion of water projects must be examined and approved by the water administrative department and reported to the relevant departments for approval in accordance with the prescribed construction procedures. The management, protection and observation facilities of water projects shall be designed, constructed and put into use at the same time as the main project. Fourteenth township water supply projects should be designed by qualified design units, and reported to the water administrative department or the Municipal Planning Commission for approval according to the following provisions:

(a) township water supply projects with water supply scale below 1000 tons/day shall be examined and approved by the district water administrative department and reported to the municipal water administrative department for the record;

(two) township water supply projects with water supply scale from 1000 tons/day to 10000 tons/day shall be examined and approved by the municipal water administrative department;

(three) the water supply scale 10000 tons/day above the township water supply project, approved by the Municipal Planning Commission.

Without the approval of the water administrative department or the Municipal Planning Commission, the water source project management unit shall not supply water. Fifteenth township water supply projects should be constructed in strict accordance with the design requirements, and accept the quality supervision of the municipal and district water conservancy and hydropower quality supervision institutions. After the completion of the project, a complete project completion data shall be compiled and submitted to the water administrative department that originally examined and approved, and the relevant units shall organize the acceptance. It can not be officially put into operation until it is qualified. Chapter IV Protection of Water Projects Article 16 The scope of management and protection of water projects shall be delineated in accordance with the following provisions, and signs shall be set up:

(a) the management scope of the reservoir area is below the reservoir land acquisition line or the resettlement line, and the protection scope is the hillside where the management scope extends to the first hurdle;

(two) small (a) above the reservoir dam (including the main dam, auxiliary dam) management scope for its peripheral extension of 50 meters, the scope of protection for the management scope extension of 200 meters; The management scope below the first category is 30 meters outside, and the protection scope is management scope 100 meters;

(3) The management scope of flood discharge structures in small (1) or above reservoirs is 50 meters around them, and the protection scope is 50 meters outside the management scope and within 200 meters of downstream overflow channels; The management scope below the small (I) type is 30 meters outside its periphery, the protection scope is 30 meters outside its management scope, and the downstream spillway 100 meters;

(4) The management scope of the filling water conveyance channel is 5m at the foot of the canal and 5m at the top line of excavation. The total management scope on both sides is controlled within 10m, and the protection scope is 30m.

(five) the management scope of electromechanical irrigation and drainage stations, hydraulic pump stations, power plants, substations, sluices, ship locks and other engineering buildings. 20 meters for its periphery and 50 meters for its management scope; The management scope is within the outer side of pressure pipeline 1m, and the protection scope is 3m outside the management scope. The protection range of low-voltage transmission lines is within 8 meters around the pole;

(6) The management scope of the levee is 5m outside the toe of the levee, and the protection scope is 30m outside the management scope. The management scope of the levee is 20m at the toe of the facing slope and 20m at the toe of the back slope 10m to 20m, and the protection scope is 50m outside the management scope. The floodplain below the design flood level submerged line in the flood detention area of reclamation area is designated as the management scope;

(seven) the land occupied by the existing office, living facilities, warehouses, activity places and comprehensive management projects of the water project management unit is classified as the management scope; The land occupied by water conservancy project operation observation facilities and flood control roads, sites and equipment belongs to the management scope.

The management and protection scope of the Xiamen section of Beixi Water Diversion Project shall be subject to the red line delineated by the municipal water administrative department and the municipal land management department. If the open channel is changed into an underground channel, the original management and protection scope of each channel section will remain unchanged.

The actual management scope of water projects has gone beyond the scope of these provisions and remains unchanged.
