Chapter 1 General Provisions Article 1 This law is formulated in order to prevent and punish drug-related crimes, protect the physical and mental health of citizens, and maintain social order. Article 2 The term “drugs” as used in this Law refers to opium, heroin, methamphetamine (methamphetamine), morphine, marijuana, cocaine, and other narcotic drugs and psychotropic drugs controlled by the state that can induce human addiction.

According to the needs of medical treatment, teaching, and scientific research, narcotic drugs and psychotropic drugs can be produced, operated, used, stored, and transported in accordance with the law. Article 3 Drug control is the common responsibility of the entire society. State agencies, social groups, enterprises and institutions, as well as other organizations and citizens shall perform anti-drug duties or obligations in accordance with the provisions of this Law and relevant laws. Article 4 The anti-drug work follows the policy of focusing on prevention, comprehensive management, and banning species, prohibition, trafficking, and smoking.

The anti-drug work is under the unified leadership of the government, with relevant departments assuming their respective responsibilities and a working mechanism with broad participation from society. Article 5 The State Council establishes the National Narcotics Control Commission, which is responsible for organizing, coordinating, and guiding national anti-drug work.

Based on the needs of anti-drug work, local people's governments at or above the county level may establish anti-drug committees to be responsible for organizing, coordinating, and guiding anti-drug work within their respective administrative regions. Article 6 People's governments at or above the county level shall incorporate anti-drug work into national economic and social development plans, and include anti-drug funds in the fiscal budget at the same level. Article 7 The state encourages social donations for anti-drug work and provides tax incentives in accordance with the law. Article 8 The state encourages the development of anti-drug science and technology research and the promotion of advanced anti-drug technology, equipment and drug treatment methods. Article 9 The state encourages citizens to report drug-related crimes. People's governments at all levels and relevant departments should protect whistleblowers, commend and reward those who have made meritorious reports and units and individuals who have made outstanding contributions to anti-drug work. Article 10 The state encourages volunteers to participate in anti-drug publicity and education and drug rehabilitation social services. Local people's governments at all levels should provide guidance and training to volunteers and provide necessary working conditions. Chapter 2 Anti-drug Publicity and Education Article 11 The state adopts various forms to carry out nationwide anti-drug publicity and education, popularize drug prevention knowledge, enhance citizens’ anti-drug awareness, and improve citizens’ ability to consciously resist drugs.

The state encourages citizens and organizations to carry out public welfare anti-drug publicity activities. Article 12 People's governments at all levels shall regularly organize and carry out various forms of anti-drug publicity and education.

Trade unions, Communist Youth Leagues, and women’s federations should organize and carry out anti-drug publicity and education based on the characteristics of their respective work targets. Article 13 Educational administrative departments and schools shall incorporate anti-drug knowledge into education and teaching content, and conduct anti-drug publicity and education to students. The public security organs, judicial administrative departments and health administrative departments shall provide assistance. Article 14 Press, publishing, culture, radio, film, television and other relevant units shall carry out targeted anti-drug publicity and education to the society. Article 15 Operators and managers of airports, railway stations, long-distance bus stations, docks, hotels, entertainment venues and other public places shall be responsible for anti-drug publicity and education in their respective places, implement anti-drug prevention measures, and prevent drug-related crimes. Article 16 State agencies, social groups, enterprises, institutions and other organizations shall strengthen anti-drug publicity and education for their own personnel. Article 18 Parents or other guardians of minors shall educate minors on the dangers of drugs and prevent them from taking or injecting drugs or engaging in other drug-related illegal and criminal activities. Chapter 3 Drug Control Article 19 The state controls the cultivation of original medicinal plants for narcotic drugs. It is prohibited to illegally cultivate opium poppies, coca plants, cannabis plants and other raw plants controlled by the state that can be used to refine and process drugs. It is prohibited to smuggle or illegally trade, transport, carry, or possess uninactivated original drug plant seeds or seedlings.

Where local people's governments at all levels discover illegal cultivation of original drug plants, they should immediately take measures to stop and eradicate it. If villagers' committees or residents' committees discover illegal planting of original drug plants, they should stop and eradicate them promptly and report to the local public security organs. Article 20 Enterprises designated by the state for planting original medicinal plants for narcotic drugs must plant original medicinal plants for narcotic drugs in accordance with relevant national regulations.

The extraction and processing sites of narcotic drug raw plant cultivation enterprises determined by the state, as well as the narcotic drug storage warehouses established by the state, are listed as key national warning targets.

Article 21 The state exercises control over narcotic drugs and psychotropic drugs, and implements a licensing and inspection system for the experimental research, production, operation, use, storage and transportation of narcotic drugs and psychotropic drugs.

The state implements a licensing system for the production, operation, purchase, and transportation of precursor chemicals.

Illegal production, sale, transportation, storage, provision, possession, and use of narcotic drugs, psychotropic drugs, and precursor chemicals are prohibited.
