3. Seek a new visa distribution method, giving priority to foreign workers with master's degree or above in the United States.

This reform bill highlights "Americans first", attaches importance to the interests of American workers, and strives to eliminate the abuse of H-1B. At present, China and India apply for the most H- 1B visas, and 60% of work visas are taken away by Indians. The H- 1B visa originally allowed American employers to hire foreign professionals and technicians without finding their own employees, so the abuse of H- 1B is self-evident.

The Immigration Bureau suspended the expedited service of H- 1B visa. It may be due to the abuse of H- 1B visa, and it is also to shorten the overall processing time of all H- 1B applications, so we have more energy to deal with the pending (nearly 240 days) H- 1B extension cases. The US Immigration Bureau issued an announcement on March 3, suspending all urgent applications for H- 1B from April 3, 20 17, and the suspension time may be as long as six months.

A separate announcement will be made before the suspension ends. The Immigration Bureau specifically stated that all applications for H- 1B in fiscal year 20 18 and applications for H- 1B without quota submitted after April 3, 20 17 belong to the category of "cancellation of expedited service".

During the suspension of expedited application, the applicant will not be able to submit the I-907 form for expedited application and the I- 129 form for non-immigrant workers to apply for H- 1B non-immigrant classification. In addition, this urgent application for suspension does not apply to other non-immigrant classification applications in I- 129.

In addition, if the applicant who submitted the H- 1B on or after April 3rd submits the I-907 form and the I- 129 form at the same time, the Immigration Bureau will return the two forms during the suspension of the expedited application.
