Regulations of Jiangxi Province on Prevention and Control of Geological Disasters

Chapter I General Provisions Article 1 In order to prevent and control geological disasters, avoid and reduce losses caused by geological disasters, ensure the safety of people's lives and property, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the provisions of the Emergency Response Law of People's Republic of China (PRC), the Regulations on the Prevention and Control of Geological Disasters and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the prevention and control planning, prevention, emergency treatment, governance and avoidance and relocation of geological disasters within the administrative area of this province.

The geological disasters mentioned in these Regulations include mountain collapses, landslides, mudslides, ground collapses, ground fissures, ground subsidence and other disasters related to geological processes caused by natural factors or human activities.

Geological hazards are classified into four categories: extra-large, large, medium and small, and the classification standards shall be implemented in accordance with relevant state regulations. Article 3 The prevention and control of geological disasters shall adhere to the principles of giving priority to prevention, combining prevention with control, overall planning, highlighting key points, territorial management and graded responsibility. Article 4 People's governments at or above the county level shall strengthen their leadership in the prevention and control of geological disasters, incorporate the prevention and control of geological disasters into the national economic and social development plan, establish and improve the responsibility system for the prevention and control of geological disasters, and organize and urge relevant departments and people's governments at lower levels to do a good job in the prevention and control of geological disasters.

The people's governments at or above the county level shall guarantee the funds for the prevention and control of geological disasters and incorporate them into the fiscal budget at the corresponding level.

Township people's governments and sub-district offices shall, in accordance with their respective responsibilities, do a good job in the prevention and control of geological disasters within their respective jurisdictions. Article 5 The competent departments of land and resources of the people's governments at or above the county level shall be responsible for organizing, coordinating, guiding and supervising the prevention and control of geological disasters within their respective administrative areas.

The departments of development and reform, finance, housing and urban and rural construction, planning, transportation, water conservancy, meteorology, civil affairs, public security, tourism, education, health, supervision and management of production safety, poverty alleviation and immigration of the people's governments at or above the county level shall be responsible for the prevention and control of geological disasters according to their respective functions and duties. Article 6 People's governments at all levels and relevant departments and units shall carry out publicity and education on the knowledge of prevention and control of geological disasters, popularize the knowledge of prevention and control of geological disasters, enhance the public's awareness of prevention and control of geological disasters, and improve the ability of disaster prevention and avoidance and self-help and mutual assistance.

The people's governments in areas prone to geological disasters shall regularly organize government personnel and village (neighborhood) committees to participate in emergency training for geological disaster prevention and control. The person in charge of the people's government at the city, county and township level shall fully grasp the geological disasters in the local area and improve the command ability of disaster prevention and emergency rescue.

Schools should strengthen the knowledge education on the prevention and rescue of geological disasters for teaching staff and students, and cultivate their safety awareness and self-help and mutual rescue ability.

The news media should carry out public welfare propaganda on the prevention and control of geological disasters, and strengthen the supervision of public opinion on illegal activities in the prevention and control of geological disasters. Seventh any unit or individual has the right to report and accuse illegal acts in the prevention and control of geological disasters.

Units and individuals in geological disaster-prone areas have the obligation to cooperate with geological disaster monitoring, management, avoidance and relocation and other geological disaster prevention and control work.

The people's governments at or above the county level shall reward the units and individuals that have made outstanding contributions in the prevention and control of geological disasters. Chapter II Planning for the Prevention and Control of Geological Disasters Article 8 The competent departments of land and resources of the people's governments at or above the county level shall, jointly with the departments of housing and urban and rural construction, planning, water conservancy, transportation and meteorology, organize the investigation of geological disasters within their respective administrative areas, and formulate the planning for the prevention and control of geological disasters within their respective administrative areas according to the results of the investigation and the planning for the prevention and control of geological disasters at the next higher level. Ninth geological disaster prevention and control planning, should listen to the opinions of relevant departments, units and the public; When necessary, a hearing shall be held.

The prevention and control plan of geological disasters shall be approved and implemented by the people's government at the same level after being demonstrated by experts, and shall be reported to the competent department of land and resources of the people's government at the next higher level for the record. Tenth geological disaster prevention planning mainly includes the following contents:

(1) Present situation analysis and trend prediction of geological disasters and their influence on local economic and social development;

(2) Principles and objectives for the prevention and control of geological disasters;

(three) geological disaster prone areas, key prevention areas and key protection areas;

(four) the geological disaster prevention project and its prevention plan, the main protection object;

(5) Planning and implementing safeguard measures, etc.

The criteria for the division of geological disaster-prone areas and key prevention and control areas shall be implemented in accordance with the relevant provisions of the state.

The key points of geological disaster protection mainly include towns, densely populated residential areas, tourist attractions, schools, hospitals, large and medium-sized industrial and mining enterprises, key water conservancy and electric power projects, traffic trunk lines and other infrastructure. Eleventh geological disaster prevention and control plan after approval, it shall be announced to the public in a timely manner, and any organization or individual has the right to consult.

Revisions to the prevention and control plan of geological disasters shall be reported to the original approving authority for approval and reported to the competent department of land and resources of the people's government at the next higher level for the record. Article 12 When compiling and implementing the overall land use planning, mineral resources planning and planning of major construction projects such as water conservancy, transportation and energy, we should consider the requirements of prevention and control of geological disasters, implement prevention and control measures, and avoid and reduce losses caused by geological disasters.

Geological disaster prevention and control planning should be taken as an integral part of the preparation of urban master planning, town master planning and rural planning.
