Obtain nationality by birth

Most people acquire their nationality in this way. Obtaining nationality by birth is divided into: by descent and place of birth.

By descent: No matter where you were born, as long as one parent is from China, your child will acquire the nationality of one or both parents. This principle is called bloodline, also known as individualism.

By place of birth: regardless of the nationality of parents, as long as they are born in the country, they will automatically acquire the nationality of that country. This principle is called birthism, also known as territorialism.

Most countries in the world adopt the principle of combining bloodline with birthplace.

Obtain nationality by joining.

Obtaining nationality by birth is not according to one's own wishes, but the way to join in obtaining nationality is based on one's own wishes or some facts. Only when the relevant conditions are met can one obtain the nationality of another country.

Marriage: If a man from one country marries a woman from another country, she will acquire the nationality of the man's country if she is willing to apply. If the laws of the woman's country do not allow dual nationality, the woman must give up her nationality before she can apply for the nationality of the man's country.

Adoption: When a national adopts a stateless child or a child from another country, the adopted person's nationality will change, or the adopter's original nationality will remain unchanged.

Voluntary application: also known as naturalization, refers to the voluntary application of nationals of one country for the nationality of another country. Many countries have certain restrictions on naturalization conditions.

Nationality of birth: or adopt the principle of descent, that is, determine a person's nationality by the nationality of his parents at birth; Or adopt the principle of place of birth, that is, determine a person's nationality by the country where he was born; Or adopt the principle of combining bloodline and birthplace to determine their nationality. China adopts the principle of mixed descent, supplemented by place of birth, including three contents: first, both parents or one parent is a citizen of China, and I was born in China and have China nationality; Two, one or both parents are citizens of China, I was born in a foreign country and have China nationality; However, if my parents or one of them is a citizen of China and lives in a foreign country, and I was born with a foreign nationality, I do not have China nationality; Third, parents who are stateless or whose nationality is unknown have settled in China. Continuous nationality

According to Article 7 of China's Nationality Law, foreigners or stateless persons applying for citizenship in China must meet two preconditions: first, the applicant must be willing to abide by the Constitution and laws of China; Second, it must be voluntary. At the same time, the necessary conditions are as follows: ① The applicant is a close relative of China people; ② The applicant has settled in China; ③ There are other justified reasons. If I am under the age of 18, my guardian or other legal representative can handle the application procedures on my behalf. In China, you can apply to the local city and county public security bureau; In foreign countries, you can apply to our diplomatic representative offices or consular offices. The above-mentioned authorities are responsible for accepting applications and examining whether the applicants meet the legal requirements, and then the applications are examined and approved by the Ministry of Public Security of China. With the approval of the Ministry of Public Security and a certificate issued by the relevant public security organ, the applicant has obtained China nationality and lost his foreign nationality at the same time.
