Regulations of Yunnan Province on Construction Project Cost Management (revised in 2004)

Article 1 In order to strengthen the management of construction project cost, reasonably determine the project cost, ensure the project quality, improve the investment benefit, safeguard the legitimate rights and interests of all parties involved in the project construction, and promote the development of the construction cause, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 These Regulations shall apply to the construction project cost activities within the administrative area of this province.

The relevant functional departments of the people's government shall examine and supervise the cost and management activities of the following construction projects:

(a) the use of state-owned funds or state financing of more than five hundred thousand yuan of construction projects;

(two) infrastructure, public utilities and other projects related to social security;

(3) Construction projects using loans or aid funds from international organizations or foreign governments. Article 3 The term "construction project cost" as mentioned in these Regulations refers to all the expenses required for the construction project from project initiation to completion, acceptance and delivery, including pre-project expenses, construction and installation project expenses, equipment and tools purchase expenses, reserve expenses, construction resettlement expenses, bank loan interest during the construction period, fixed assets investment direction adjustment tax and other expenses. Fourth provincial construction administrative departments responsible for the province's construction project cost management; The construction administrative departments of prefectures, cities and counties are responsible for the cost management of construction projects in accordance with the principle of hierarchical management.

The administrative departments in charge of development planning, economy and trade and other relevant departments shall be responsible for the relevant construction project cost management according to their respective responsibilities. Fifth construction administrative departments shall perform the following main duties in the construction project cost management:

(a) responsible for organizing construction project investors and relevant departments to review the completion and settlement of construction projects managed by the government at the corresponding level;

(two) unified management of construction project standard quota, the preparation and release of general construction project standard quota;

(three) responsible for technical appraisal and administrative mediation of construction project cost disputes;

(four) responsible for the qualification of the construction project cost consulting unit and the management of the professional and technical personnel of the project cost.

The construction project standard quota mentioned in the preceding paragraph refers to the valuation basis of construction project investment estimation index, budgetary estimate quota, budget quota, cost quota, construction period quota, labor quota, material budget price information and project cost index.

The investment estimate of the feasibility study report of a construction project shall be examined and approved by the administrative department of development planning or the administrative department of economy and trade, or reported to the higher administrative department for examination and approval. Ninth preliminary design budget should be based on the approved feasibility study report, in accordance with the construction project standard quota and budget method.

The preliminary design estimates of housing construction projects and municipal projects shall be examined and approved by the construction administrative department, among which, projects involving state investment and financial budget arrangements shall be examined and approved by the construction administrative department in conjunction with the development planning administrative department; The preliminary design budget of other projects shall be examined and approved by the administrative department of development planning in conjunction with the administrative department of construction. Article 10 The examination and approval time for estimation, budgetary estimate and settlement of construction projects shall not exceed 60 days, and the examination and approval time for large-scale construction projects may be appropriately extended with the approval of the person in charge of the administrative department. Eleventh construction drawing budget should be based on the construction drawing and construction organization design, in accordance with the construction project standard quota and budget preparation method. Twelfth tender offer should be determined independently according to the engineering construction standard quota and bidding documents, combined with the technical conditions and management level of the enterprise. Article 13 The contract price of a construction project shall be determined according to the tender documents and the bid documents of the winning bidder.

The construction project contract shall be submitted to the construction administrative department for registration and filing together with the tender documents within 30 days from the date of signing. Fourteenth construction project completion settlement shall be compiled according to the approved preliminary design and its budgetary estimate, the agreement in the construction project contract, the approved design change and the preparation method of completion settlement. Fifteenth construction units shall carry out construction in accordance with the approved preliminary design and budgetary estimate, and shall not expand the construction scale, increase the construction content and improve the construction standards without authorization. If it is really necessary to excessively adjust the budget estimate during the construction process, it shall be approved by the original examination and approval department. Sixteenth design units shall, in accordance with the provisions of these regulations, prepare investment estimates and preliminary design estimates, and shall not raise or lower the quota standards without authorization. Seventeenth construction units shall, in accordance with the provisions of these regulations, prepare the budget and settlement of construction drawings, and shall not raise or lower the quota standards without authorization, and carry out construction in accordance with the requirements of construction drawings and construction technical standards.
