First, the attendance rate of international students during their study should reach at least 80%.
In Australia, if the attendance rate of international students does not reach 80% without justifiable reasons, the student visa must be cancelled, which is not negotiable. It's easier said than done to achieve 80% attendance. Take the university as an example. The actual teaching time of Australian universities is about 65,438+03 weeks per semester. As long as you miss a class three times, the attendance rate is less than 80%. In particular, the roll call of many schools is mostly within 10 minutes before class. Missing the roll call becomes absenteeism. In China, it is very common for college students to fail to take the attendance test (even if they do, it will have little practical effect), but in Australia, the lack of attendance is fatal. Once there is a problem with the attendance rate, it will affect the student visa, so we must attach great importance to this issue.
The specific provisions of this law are as follows:
(1) After learning that the attendance rate of foreign students is less than 80%, the school where foreign students attend must issue the so-called "Article 20 Notice" to the students (named after presenting the notice according to Article 20 of the Australian Federal Overseas Student Education Service Act). If the school fails to report it, it will be punished or sanctioned accordingly;
(2) International students must report to the immigration office with their passports within 28 days from the date of presentation of the notice;
(3) The immigration officer will interview the students and ask them to explain and show the reasons and evidence that lead to the attendance rate below 80%. If the reasons are appropriate and the evidence is conclusive, the visa may not be cancelled. If the reason is justified and the evidence is insufficient, or the reason is improper and the evidence is insufficient, the immigration officer must cancel his student visa;
(4) If the student fails to report to the Immigration Bureau within 28 days from the date of submission of the notice in Article 20, the student visa will be automatically cancelled at the end of the 28th day.
What parents here should pay special attention to is that even private language schools, high schools, preparatory schools and universities must "act according to law" because this is stipulated by law. According to what we have learned from the Student Visa Office of the Immigration Department, most students' student visas will be cancelled after receiving the notice of Article 20 issued by the school.
Then, what else should we pay attention to when dealing with attendance, besides ensuring class attendance on time?
First, once you receive the notice of Article 20, you must pay full attention to it immediately, instead of waiting until the visa is cancelled. Because the law has detailed provisions on what is a legitimate reason for absence from class and what is not, we must know clearly, have a clear goal and go to the immigration officer with confidence. Similarly, pay attention to what kind of evidence is useful and what kind of evidence is not. For example, sick leave notes are only useful if they are prescribed by registered western medicine, while sick leave notes prescribed by Chinese medicine are often ineffective.
Second, if students change their address, they must inform the school in time. Legally speaking, a student visa comes with a condition that requires students to:
(1) If a student obtains a student visa overseas, he/she must inform the school of his/her address within 7 days of entry;
(2) If the address is changed, the new address of the school shall be notified within 7 days after the change;
(three) if the school changes, it shall notify the school to change within 7 days after receiving the new admission notice.
It should be noted that if a student fails to inform the school of the change of address in time or fails to receive the notice in Article 20 in time for any other reason, "failure to receive" cannot be used as a reason to overturn the decision to cancel the visa after the visa is cancelled. Therefore, we must ensure that we can receive letters in time at any time, even when we go home or visit relatives during the New Year. Some students' visas are automatically cancelled when they are overseas because they have not received the notice of Article 20. According to the law, students can submit internal administrative reconsideration to the Immigration Bureau within 28 days after their visas are cancelled. If there is no good reason after 28 days, the Immigration Bureau will ignore it. It's like a subpoena issued by the court. If it is not received, the consequences can be imagined. Because of this, we can imagine the surprise, embarrassment and anxiety of those international students who came back from their holidays in China and were told that their visas had been cancelled when they boarded the plane.
Third, record your attendance at school in time and learn from the school at any time.
Article 20 The notice is drafted by the Immigration Department and placed on the website where schools need a password to enter. Once the notice is issued, the Immigration Department also receives the electronic copy at the same time as the student receives the notice. In this way, even if the school misremembered or miscalculated the attendance rate, the immigration bureau still had to act according to the rules without mercy, leaving students with great trouble.
Fourth, try not to let students take time off to visit relatives in China during their studies.
When students first arrive in Australia and enter a brand-new cultural environment, many students are uncomfortable and particularly homesick. In this case, especially for relatively young students, parents tend to be soft-hearted, sometimes allowing students to go home for a while and then come back, and some will find some high-sounding reasons for this. Absence from class caused by such a situation, first, must ask for leave from school; Second, it is necessary to clarify the reasons and duration of leave; Third, there must be the written consent of the school; Fourth, you must pay it back when it expires, and don't postpone it. Because even if the above five "musts" are met, the Immigration Bureau will not necessarily cancel the visa. The safe way is to go back to China to visit relatives only during school holidays.
Fifth, if you don't feel well, you must see a doctor and write a note.
If you feel unwell during your study, even if it is a small problem like headache and stomachache, you should go to the doctor to write a note. As long as it is clear that it is because of physical discomfort that you need to rest and can't go to school, most western doctors will write a fake note and then ask for leave from school. Give the fake note to the school the next day, and be sure to keep a copy for future reference. This sick note is the only way to save attendance.
Second, we must achieve the minimum academic performance required by the school.
Another legal requirement of student visa is that international students must meet the minimum academic performance required by the school. If the school thinks that the students have not reached the minimum academic achievement, the school must produce the notice of Article 20. As for the minimum academic performance required by the school, according to the relevant laws, it is entirely up to the school itself to decide. For example, many schools define that students fail more than 50% of the courses in a semester as failing to achieve the minimum academic performance. In other words, after students are admitted to the school, they can also be shown the notice of Article 20 because of their poor grades, and their visas will be cancelled. It is easy to be overlooked that many schools generally don't show 20 notices in the first semester, because students fail more than 50% of the courses in this semester. If the students around them also fail in the course, students will be easily paralyzed. In the next semester, if more than 50% of the courses fail, the school will show 20 notices, but at that time, the students' grades were ugly and they became "recidivists" and had to be rehabilitated.
It is suggested that if you feel that your study is too hard, you should choose a professional company to help you arrange to transfer courses or schools as soon as possible. You must not be careless and love your face, which will lead to passivity in the back.
Of course, students' grades are not good, some because they don't work hard, but many of them are because the courses they choose are not suitable.
