Legal analysis: For those who illegally enter or leave the country in violation of the provisions of this Law, illegally reside or stay in China, travel to areas closed to foreigners without valid travel documents, forge, alter, falsely use or transfer their entry or exit documents, the public security organs at or above the county level may impose a warning, a fine or a detention penalty of not more than 10 days; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.
Legal basis: Article 2 of the Law of People's Republic of China (PRC) on the Administration of Entry and Exit of Foreigners applies this Law to the administration of entry and exit of China citizens, entry and exit of foreigners, stay and residence of foreigners in China, and border inspection of exit and entry vehicles.
