Measures for the Administration of Rural Resettlement Funds in Hubei Reservoir Area of Three Gorges Project

Article 1 These Measures are formulated in accordance with the Regulations on the Construction of the Three Gorges Project on the Yangtze River and other relevant provisions of the state in order to strengthen the management of the use of funds for rural migrants leaving the county in the Hubei reservoir area of the Three Gorges Project and do a good job in resettlement. Article 2 The compensation and subsidy funds for the resettlement of rural migrants in Hubei reservoir area of Three Gorges Project (hereinafter referred to as resettlement funds) refer to the expenses for the resettlement of rural migrants in Hubei reservoir area of Three Gorges Project outside their original residence counties, including the expenses for the relocation organized by the government and the resettlement of individual migrants outside their original residence counties. Article 3 Immigration funds shall be managed by the immigration management agencies established by the people's governments at all levels. If there is no immigration management institution, the departments designated by the people's governments at all levels shall be responsible for the management. Article 4 The resettlement funds are an integral part of the resettlement compensation funds in the Three Gorges Project reservoir area. It includes the following aspects:

(1) Resettlement compensation. That is to say, it is included in the category of rural resettlement with lump-sum funds for migrants in the Three Gorges Project reservoir area, and rural migrants are compensated for production resettlement fees, infrastructure fees, compensation fees for houses and ancillary facilities, relocation transportation fees, transitional living allowances, and sporadic fruit and wood compensation fees.

(2) Immigration subsidies. That is, the relocation subsidies for rural migrants arranged from the basic reserve funds include production resettlement and infrastructure subsidies, living subsidies for extending the transition period, subsidies for purchasing means of production, subsidies for needy households, subsidies for housing and ancillary facilities, and subsidies for the management of resettlement areas.

(3) Planning fees, research fees and training fees related to immigration. Article 5 The standard of resettlement funds shall be implemented according to the standards calculated by the provincial immigration bureau of the Three Gorges Project (see attached table). Sixth immigrants should adhere to the principle of dual responsibility for immigration tasks and funds, and pay attention to the efficiency of the use of funds. Article 7 Where the government organizes migration, the migration funds managed by the government of the place of emigration include production resettlement fees, infrastructure fees, living allowances for extending the transition period, subsidies for purchasing means of production, subsidies for poor households and subsidies for migration management.

Production resettlement fees and infrastructure fees shall be used as a whole for production resettlement, homestead, infrastructure and supporting construction of public facilities by the place where the immigrants live. Immigrants who buy idle houses or build their own houses sporadically by residents in the place where they move in may pay part of the infrastructure fees to the immigrants. If the government of the resettlement site uniformly builds the infrastructure of the resettlement site, it will no longer issue infrastructure fees to the immigrants. The living allowance for extending the transition period shall be paid to the immigrants by stages according to the standard by the place where they moved in, or part of it shall be held by the collective of the place where they moved in to support the development of production of the immigrants, but the part held by the collective shall not exceed that of 400 yuan on average (static).

Subsidies for needy households shall be uniformly adjusted by the place of immigration according to the actual situation, so as to solve the living difficulties of needy households and shall not be evenly distributed.

Management subsidies are used for the administrative management of immigration management institutions in the place where immigrants live. Article 8 The resettlement funds managed by the government include subsidies for houses and ancillary facilities, compensation for sporadic fruit trees and relocation and transportation expenses. The above-mentioned funds shall be settled and distributed to immigrants in one lump sum by the immigration management agency. Article 9 If rural migrants in the reservoir area visit relatives and friends and move out on their own, after going through the formalities of moving in and out according to the relevant procedures of the government of the place of emigration and the place of emigration, the immigration management institution of the place of emigration will pay the resettlement funds to the individual in one lump sum according to the standard, and pay them to the individual in full at the time of relocation, and go through the formalities of canceling the resettlement compensation funds. Article 10 The resettlement funds shall be included in the annual resettlement plan of the Three Gorges Project reservoir area, which shall be declared by the resettlement counties according to the relevant regulations, and shall be strictly implemented according to the plan after approval. Eleventh resettlement funds managed by the emigration place shall be allocated according to the resettlement agreement signed by the emigration place government and the emigration place government. Twelfth local governments should strengthen the management of immigrant funds, clear the management organization, and open a special account in the bank, which is responsible by a special person. There are both immigrants from Chongqing reservoir area and immigrants from Hubei reservoir area, and their immigrant funds should be accounted for and managed separately. The immigration authorities of the county, city (state) in the place of immigration shall submit accounting statements and statistical statements to the immigration authorities at the next higher level as required, and send a copy to the immigration authorities in the place of emigration. Thirteenth immigration funds that should be paid to individual immigrants according to regulations must be paid in full. The funds used by governments at all levels as a whole must be used for the construction of projects related to the resettlement of immigrants' production and living, and the funds are earmarked for special purposes. It is strictly forbidden to intercept or deduct immigrant funds or use them for other expenses unrelated to immigrants. Article 14 The allocation, use and management of resettlement funds shall be implemented in accordance with state regulations. Fifteenth immigration management agencies should strengthen internal financial management, and allocate and use management subsidies in strict accordance with the prescribed proportion.

Interest on resettlement funds shall be managed and used in accordance with relevant regulations. Do not use immigrant funds to engage in financing activities or provide guarantees for any department or unit. Sixteenth townships (towns) who have the task of immigration should designate a person to be responsible for the management of immigration funds, and establish and improve a strict financial management system. Seventeenth governments at all levels in the place of emigration and immigration should strengthen the guidance on the personal use of immigrant funds, educate immigrants to work hard and develop production.
