If the perpetrator is in our country, according to the principle of territorial jurisdiction of Article 5 of our criminal law (committing crimes in our country), our criminal law should be applied.

If the perpetrator is in China, according to the protection principle of Article 8 of our criminal law (foreigners commit crimes against our country or our citizens abroad), because the minimum penalty for this crime is public surveillance, our criminal law is not applicable.
