First, professional requirements. According to the immigration law, a major refers to a job that only professionals with at least a bachelor's degree can do. Professional positions must meet one of the following conditions:

The minimum requirement for this job is a bachelor degree; The industry generally requires employees to have a bachelor's degree, or the work is extremely complicated or unique, and only a professional degree can be competent; Employers usually require practitioners to have professional degrees; A job is very complicated, which requires a bachelor's degree or above and enough knowledge to do it.

Second, the application procedure. The application of H- 1B is divided into two steps. First, the applicant's company must submit the 9035 form to the Ministry of Labor to prove that the applicant's salary will not be lower than that of similar workers in the United States; When the applicant applied, the company did not strike and other activities; The applicant's working conditions are the same as those of similar workers in the United States; The company has informed the trade union that the applicant's application has been reported to the Ministry of Labor. If there is no trade union in the company, it will be announced within the company.

Once the 9035 form is approved, the applicant can apply to the Immigration Bureau through the company where he works. Generally speaking, it takes two weeks for the 9035 form and four weeks for the immigration office.

3. Delay, change of work unit and others. H- 1B is valid for three years for the first time. After the expiration of three years, you can apply for an extension of another three years, one to six years. H- 1 status can continue to work for 240 days during the period when an extension has been applied for but not approved.

You need to apply for a new H- 1B in the following situations:

OPT: internship visa for American graduates

Students who have graduated from American institutions of higher learning can find work practice units in related professional fields. You can keep your student status of F 1 during the internship period, and you can apply for an H- 1B visa during the internship period, that is, you can apply for immigration by changing your student status into a work status. In the past, the period of OPT visa was 12 months, which means that if they want to apply for immigration, you need to get an H- 1B visa within 12 months. Before the project, if you study science, technology, engineering or mathematics, it can be extended to 29 months, but other majors are usually 12 months. After the OPT visa ends, you have two months to pack up and go back to China.

It should be noted that for newly graduated students, no matter what major they study, the OPT visa they apply for is always 12 months, except for students majoring in science and technology, engineering and mathematics who can apply for an extension of 17 months in the first OPT state, so the OPT time is 29 months in total.
