Interim Measures for the Management of Cemetery in Ningxia Hui Autonomous Region (revised on 20 18)

Chapter I General Provisions Article 1 These Measures are formulated to implement the funeral management policy of "actively and step by step promoting cremation, reforming burial, getting rid of feudal superstitious funeral customs, advocating frugality and civilized funeral" and strengthening the management of cemeteries. Second cemetery management should be unified planning and management. Article 3 The management of cemeteries shall be classified into operational and public welfare management.

City, county (district) urban areas can establish business cemeteries, and towns and villages can establish public welfare cemeteries.

Public welfare cemeteries can create conditions and gradually change to operating cemeteries. Fourth people's governments at all levels and civil affairs departments should strengthen the leadership of cemetery management.

Funeral management offices at all levels shall implement unified planning and management of cemeteries within their respective administrative areas. Fifth approved designated cemetery area, no unit or individual may infringe. Chapter II Planning and Management of Cemetery Article 6 A city or county (district) shall apply for the construction of a new operating cemetery, which shall be audited by the people's government at the county level and reported to the Civil Affairs Department of the autonomous region for approval; New public cemetery, the township (town) people's government to apply for approval by the people's government at the county level.

The civil affairs department or township (town) people's government holds the approval document, applies to the local urban and rural construction department for site selection, and goes through the formalities of land use certificate with the land management department. Seventh cemetery area should be unified planning:

(a) set up the cemetery nameplate and boundary markers. The nameplate of the cemetery shall specify the name of the cemetery, the time when the tomb was built, the geographical location, the area occupied and the management system;

(2) arranging the number of tombs and formulating the standards for tombs, with the spacing between tombs not exceeding one meter, the height of the tombs not exceeding two meters, the area of each tomb not exceeding six square meters, the height of tombstones not exceeding one meter, and the width of roads in the cemetery area being four meters;

(three) the construction of green belts and places for the masses to pay homage and rest. Eighth operating cemeteries can establish cemetery management institutions, whose main responsibilities are:

(1) Building and managing cemeteries according to the plan;

(two) to provide funeral services for the bereaved, such as digging graves and burying bodies;

(3) Planting trees and greening cemeteries. Ninth cemetery management agencies need personnel, can implement the recruitment system, can also hire temporary workers. Tenth township and village cemeteries shall be managed by the township (town) people's government, villagers' committee or its designated personnel. Eleventh city and county (District) funeral management office shall register the designated cemetery area, draw maps, establish files, establish cards, and report to the funeral management office of the autonomous region for the record. Twelfth cemetery management agencies should issue an announcement and take photos for the record before dismantling the main tomb. Thirteenth mourners buried in the cemetery area, must abide by the cemetery management system, according to the cemetery management agencies designated grave burial.

It is forbidden to engage in feudal superstitious activities in funeral ceremonies. Chapter III Use and Expenses of Cemetery Article 14 If the deceased is buried in a business cemetery, he shall go through the burial registration formalities in the cemetery area at the local funeral management office with the death certificate issued by the competent funeral hospital or the public security, traffic supervision organ and the unit where the deceased belongs, and be buried in the designated grave after paying the fees according to regulations.

The cemetery in the cemetery area can be reserved in advance. Fifteenth operating cemeteries are funeral service facilities open to the public, operated by funeral management offices at or above the county level, or jointly operated with other units. Sixteenth operating cemeteries shall be used with compensation, and fees shall be charged according to regulations.

Public cemetery only charges a one-time cemetery management fee. Seventeenth in conditional areas can be built in the ashes cemetery. Each ashes tomb covers an area of no more than one square meter. The tomb is made by the cemetery management organization, and the funeral owners choose to charge according to the quality. Article 18 The charging items, standards, methods and expenditure ranges listed in Articles 16 and 17 of these Measures shall be jointly formulated by the Civil Affairs Department, the Price Bureau and the Finance Department of the autonomous region. Nineteenth cemetery fees and expenses shall establish an accounting and auditing system, and regularly report to the civil affairs department at a higher level and the funeral management office. Twentieth cemetery management agencies shall be exempted from business tax on funeral services. Chapter IV Provisions on Punishment Article 21 Whoever commits one of the following acts shall be punished by the civil affairs department at the county level or the funeral management office entrusted by it:

(a) without registration to the funeral management department, burial in the cemetery area without authorization, in addition to the required payment, and impose a fine of 50 to 100 yuan on the mourner;

(two) not in the designated grave burial, punishable by a fine of one hundred and fifty to two hundred yuan;

(three) those who engage in feudal superstitious activities in the cemetery area shall be fined from 200 yuan to 300 yuan. Twenty-second national cadres and workers who have one of the acts listed in Article 21 of these Measures shall be punished in accordance with the provisions, and the civil affairs department shall recommend their units or competent departments to give administrative sanctions. Twenty-third do not obey the management of the cemetery management institutions, hinder the management of the cemetery, insult, assault cemetery management personnel, by the public security organs in accordance with the "People's Republic of China (PRC) National Public Security Management Punishment Law" to be punished; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Twenty-fourth civil affairs departments or their entrusted funeral management, when imposing fines on the parties, should use the confiscation certificate uniformly printed by the financial department of the autonomous region.

Confiscated income, all turned over to the finance at the same level.
