chapter I general provisions article 1 these regulations are formulated in accordance with the population and family planning law of the people's Republic of China and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to control the population, improve the population quality, improve the population structure, and promote the coordination and sustainable development of population and economy, society, resources and environment. Article 2 These Regulations shall apply to citizens whose household registration is in this province.

Article 4 Citizens have the obligation to carry out family planning according to law. The lawful rights and interests enjoyed by citizens in family planning are protected by law.

Article 8 The population and family planning administrative departments of the people's governments at or above the county level shall be in charge of the population and family planning work in their respective administrative areas, and shall be responsible for the guidance, coordination, supervision and management of the population and family planning work.

other departments of the people's governments at or above the county level shall do a good job in population and family planning work according to the division of responsibilities.

social organizations, enterprises, institutions, other organizations and citizens such as trade unions, youth leagues, women's federations and family planning associations shall assist the administrative departments of population and family planning in their work.

Chapter II Fertility Regulation Article 9 The first marriage when a man reaches the age of 25 and a woman reaches the age of 23 is a late marriage. The first child born by a married woman at the age of 24 is late childbirth.

In accordance with the provisions of the second, third and second paragraphs of the first paragraph of this article, if both husband and wife are agricultural population, they shall be approved by the population and family planning administrative department of the county (city, district) people's government; If one or both spouses are non-agricultural population, it shall be approved by the administrative department of population and family planning of the municipal people's government with districts. Article 12 Both husband and wife are agricultural people, and if they meet any of the following circumstances, they can have a second child with the approval of the population and family planning administrative department of the county (city, district) people's government:

(1) Only one girl;

(2) Having lived in a poverty-stricken natural village in a mountainous area that is not included in the immigration plan and determined by the provincial people's government for more than 7 years and has only one child;

(3) The man has settled in a family with only girls and supported the woman's parents;

(4) The brother or spouse of the brother of the man, who is over 3 years old, has been identified as infertile by a medical institution or a family planning technical service institution at or above the county level and has not adopted a child.

if there are more than three sisters or brothers in the preceding paragraph, and more than two people request to have a second child, only one of them will be approved. Thirteenth remarried couples meet one of the following circumstances, with the approval of the population and family planning administrative department of the county (city, district) people's government, they can have another child:

(1) one party has given birth to a child and the other party has not;

(2) One party is widowed and has given birth to two children, while the other party has not given birth;

(3) Both parties have given birth to one child before remarriage, and both children live with their original spouses according to law;

(4) One party is widowed and has given birth to a child, and the other party has given birth to a child, but the child lives with the original spouse according to law.
