Regulations on the Protection of Dongjiang Lake National Wetland Park
Chapter I General Provisions
Article 1 In order to strengthen the environmental protection of Dongjiang Lake and prevent water pollution, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution and other relevant laws and administrative regulations, combined with the actual situation of Dongjiang Lake Basin.
Article 2 These Regulations shall apply to the water environment protection of Dongjiang Lake Basin under the jurisdiction of Zixing City, Rucheng County, Guidong County and Yizhang County.
Dongjiang Lake as mentioned in these Regulations refers to Dongjiang Reservoir and Jiang Xiaodong Reservoir; The term "Dongjiang Lake Basin" as mentioned in these Regulations refers to Dongjiang Lake and the area where Dongjiang Lake meets water.
Article 3 The environmental protection of Dongjiang Lake should adhere to the principle of unified management and graded responsibility, and realize the rational development and sustainable utilization of water resources.
Article 4 The provincial people's government shall strengthen its leadership over the water environment protection work in the Dongjiang Lake Basin. Chenzhou Municipal People's Government is fully responsible for water environment protection in Dongjiang Lake Basin. The people's governments of Zixing City, Rucheng County, Guidong County and Yizhang County are responsible for the water environment protection of Dongjiang Lake Basin within their respective administrative areas.
The people's governments of provinces, Chenzhou City, Zixing City, Rucheng County, Guidong County and Yizhang County shall incorporate the water environment protection of Dongjiang Lake Basin into the national economic and social development plan and take measures to prevent and control water pollution.
The people's governments of Chenzhou City, Zixing City, Rucheng County, Guidong County and Yizhang County shall, in accordance with the requirements of the Standing Committee of the people's congress at the corresponding level, report on the water environment protection in the Dongjiang Lake Basin within their respective administrative areas.
Article 5 All units and individuals engaged in activities in the Dongjiang Lake Basin have the obligation to protect the water environment, and have the right to dissuade, report and accuse acts that pollute the water environment in the Dongjiang Lake Basin.
Article 6 The relevant people's governments and departments shall commend and reward the units and individuals that have made remarkable achievements in scientific and technological research, advanced technology popularization and protection and management of water environment protection in Dongjiang Lake Basin.
Chapter II Delimitation of Protected Areas and Protection Targets
Article 7 The scope of water environment protection in Dongjiang Lake Basin is divided into first-class protected areas, second-class protected areas and quasi-protected areas.
The scope of the first-class protected area:
(a) the waters between Jiang Xiaodong Reservoir Dam and Dongjiang Reservoir Dam.
(2) The waters between the dam of Dongjiang Reservoir and Douluyan Island are bounded in the south by the connecting line between the southern end of Douluyan Island ridgeline and the grindstone on the other side, and in the north by the connecting line between the northern end of Douluyan Island ridgeline and the logging yard 1 pier of Dongjiang Timber Factory.
(3) The first ridgeline connected with the water surface of the above-mentioned (1) and (2) waters is inclined to the water surface.
(4) Pocket rate rock island.
The scope of the two protected areas:
(1) The waters of Dongjiang Lake except the first-class protected areas.
(two) the land area of the first layer of ridge line connected with the water surface of Dongjiang Lake, except the area designated as a first-class protected area.
Quasi-protected area: the area in Dongjiang Lake Basin except the first and second protected areas.
Article 8 Signs and boundary markers shall be set up on the boundary line of the first-class protected areas, and no unit or individual may destroy or move them without authorization.
Article 9 The objectives of water environment protection in Dongjiang Lake Basin are:
The water quality of a protected area shall conform to the Class II standard in the National Environmental Quality Standard for Surface Water and the Class I standard in the Water Quality Standard for Drinking Water Sources.
The water quality of the two protected areas shall conform to Class III standard in the National Environmental Quality Standard for Surface Water and Class II standard in the Water Quality Standard for Drinking Water Sources. The water quality of rivers entering the secondary protection zone in the quasi-protection zone shall conform to the Class III standard in the National Environmental Quality Standard for Surface Water.
Chapter III Protective Measures
Tenth in the quasi protected areas must comply with the following provisions:
(1) No unit or individual may engage in indigenous mineral processing such as arsenic smelting, gold dressing, tungsten dressing, etc., and may not engage in production projects that seriously pollute the environment that are explicitly prohibited by the state and the province; Units and individuals without water pollution prevention measures are prohibited from engaging in electroplating, tanning, pulping and papermaking, chemical industry, printing and dyeing, and the production of radioactive materials.
(two) it is forbidden to dump industrial waste residue, domestic garbage and other wastes into the scope of river management.
(three) the direct or indirect discharge of industrial wastewater into the waters must conform to the national and provincial wastewater discharge standards.
(4) It is forbidden to eat poisonous fish and fried fish.
(five) prohibit other acts of water pollution.
Eleventh in the secondary protected areas, in addition to the provisions of Article 10 of these regulations, the following provisions must also be observed:
(1) It is forbidden to build or expand construction projects that discharge pollutants into water bodies, such as mining, mineral processing and smelting; We must reduce the amount of sewage in rebuilding construction projects.
(two) prohibit the use of fish medicine and highly toxic and high residue pesticides harmful to human body.
(three) it is forbidden to build facilities and places for centralized storage and disposal of solid waste and domestic waste landfill.
(four) where the Township People's Government is located and the tourist service facilities are relatively concentrated, domestic sewage treatment facilities shall be built; Solid wastes such as domestic garbage should be collected, transported and treated in time.
(5) When ships and vehicles are loading, unloading and transporting oil or toxic substances, measures must be taken to prevent overflow and leakage.
(six) passenger ships and tourist ships must be equipped with garbage, feces and oily sewage storage facilities, and the terminal management unit should be equipped with facilities for collecting and transferring garbage, feces and oily sewage.
Twelfth in the first-class protected areas, in addition to the provisions of Article 10 and Article 11 of this Ordinance, the following provisions must be observed:
(a) it is forbidden to build, expand or rebuild construction projects other than hydropower and water supply projects.
(2) Camping, picnics and water sports are prohibited.
(three) it is forbidden to set up gas stations and water business, catering and other service outlets.
Thirteenth construction projects and facilities that have been built in the protected areas and seriously pollute the water resources of Dongjiang Lake shall be handled in accordance with the following provisions:
(a) without the approval of the relevant administrative departments in accordance with the law, to be closed down and removed.
(two) approved by the relevant administrative departments in accordance with the law, it shall be treated within a time limit; If the discharge standard is still not reached after the deadline, it shall be closed and dismantled.
Article 14 Ships that run in Dongjiang Lake and use gasoline and diesel as fuel should switch to clean energy such as electricity and liquefied gas within a time limit.
Fifteenth first-class protected areas prohibit cage fish farming; Cage fish culture in two protected areas shall be carried out in accordance with the scale and location approved by the relevant administrative departments.
Sixteenth protected areas should plant trees, optimize forest structure and build ecological forestry; Deforestation is prohibited to prevent soil erosion.
It is forbidden to cut down trees in the first-class protected areas; Logging in other areas shall be submitted for approval in accordance with relevant laws and regulations.
Article 17 The people's governments of Chenzhou City, Zixing City, Rucheng County, Guidong County and Yizhang County shall formulate preferential measures to encourage villagers in protected areas to protect the ecological environment, gradually return farmland to forests and grasslands, develop ecological agriculture, and prevent chemical fertilizers, pesticides and other pesticides from polluting water bodies.
Villagers who are in serious shortage of production resources in the first and second protected areas should be arranged in a unified way, gradually moved out and properly placed.
Eighteenth Chenzhou Municipal People's government tourism management department shall formulate tourism planning according to the requirements of protecting the water environment of Dongjiang Lake.
Tour operators and tourists shall abide by the laws and regulations on protecting the water environment and shall not pollute the water body.
Nineteenth Dongjiang hydropower, water supply and other enterprises should support and cooperate with the environmental protection work in Dongjiang Lake.
Chapter IV Supervision and Administration
Twentieth environmental protection, development planning, economy and trade, land and resources, construction, transportation, agriculture, forestry, water conservancy, industry and commerce, tourism and other relevant administrative departments. The provincial people's government shall, in accordance with their respective responsibilities, do a good job in environmental protection in Dongjiang Lake.
Article 21 The Chenzhou Municipal People's Government shall organize the people's governments of Zixing City, Rucheng County, Guidong County and Yizhang County and relevant departments to prepare the water pollution prevention and control plan for Dongjiang Lake Basin, and submit it to the provincial people's government for approval before implementation.
The master plan and other plans of Dongjiang Lake Scenic Area shall be revised and adjusted according to the requirements of these Regulations.
Article 22 The competent administrative department of environmental protection of Chenzhou Municipal People's Government shall set up a water quality monitoring section at the junction of cities and counties where major rivers flow into Dongjiang Lake, conduct regular monitoring and evaluation, and report the evaluation results to Chenzhou Municipal People's Government and announce them to the public.
The people's governments of Zixing City, Rucheng County, Guidong County and Yizhang County shall ensure that the effluent quality meets the prescribed standards; If it fails to meet the prescribed standards, the Chenzhou Municipal People's Government shall instruct it to find out the reasons, take measures and make rectification within a time limit.
Article 23 The people's governments of Chenzhou City, Zixing City, Rucheng County, Guidong County and Yizhang County shall increase their investment in water environment protection in Dongjiang Lake Basin year by year; Forestry administrative departments shall, according to the methods for raising and using forest ecological benefit subsidy funds formulated by the state and provincial people's governments, raise forest ecological benefit subsidy funds for subsidizing the protection of ecological public welfare forests in Dongjiang Lake Basin.
Chenzhou Municipal People's Government shall take measures to organize the rational development and utilization of Dongjiang lake water resources; With the approval of the provincial people's government, a certain proportion of the proceeds from development and utilization will be earmarked for environmental protection and resettlement compensation in Dongjiang Lake.
Chapter V Legal Liability
Article 24 Whoever, in violation of the provisions of Article 8 of these regulations, destroys or moves the signs and boundary markers on the boundary line of the first-class protected area without authorization shall be ordered by the environmental protection department of the people's government at or above the county level to make corrections and compensate for the losses.
Twenty-fifth in violation of the provisions of article tenth (a) of this Ordinance, the people's government at or above the county level shall order it to close down; Those who cause pollution accidents shall be punished in accordance with Article 43 of the Detailed Rules for the Implementation of People's Republic of China (PRC) Water Pollution Prevention and Control Law.
In violation of the provisions of article tenth (two) of this Ordinance, it shall be punished in accordance with the provisions of article thirty-ninth (four) of the detailed rules for the implementation of the law on the prevention and control of water pollution in People's Republic of China (PRC).
Twenty-sixth in violation of the provisions of article eleventh (five), shall be ordered to improve the facilities; Those who cause water pollution accidents shall be punished in accordance with Article 43 of the Detailed Rules for the Implementation of People's Republic of China (PRC) Water Pollution Prevention Law.
In violation of the provisions of article eleventh (six) of this Ordinance, no garbage, feces and oily sewage storage facilities are set up, and it shall be ordered to make corrections; Dumping ship garbage into water bodies shall be punished in accordance with Item (5) of Article 39 of the Detailed Rules for the Implementation of People's Republic of China (PRC) Water Pollution Prevention Law.
Twenty-seventh in violation of the provisions of article twelfth (a), (two) and (three), the people's governments at or above the county level shall be ordered to close down, dismantle or ban.
Twenty-eighth in violation of other laws and regulations in the protected area, by the relevant departments of the people's governments at or above the county level in accordance with the provisions of relevant laws and regulations.
Article 29 Whoever refuses or obstructs the functionaries of state organs from performing their duties in protected areas according to law shall be punished in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirtieth in the Dongjiang Lake Basin water environment protection, national staff dereliction of duty, abuse of power, corruption, by their units or the competent authorities at a higher level shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VI Supplementary Provisions
Article 31 These Regulations shall come into force as of March 6, 2002.
