Regulations of Chongqing Municipality on Protecting the Investment of Taiwan Province Compatriots

Chapter I General Provisions Article 1 In order to encourage Taiwan Province compatriots to invest in this Municipality and protect the legitimate rights and interests of Taiwan Province compatriots investors, these Regulations are formulated in accordance with the Law of Taiwan Province Province, People's Republic of China (PRC) on the Protection of Compatriots' Investment and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "investment by Taiwan Province compatriots" as mentioned in these Regulations refers to the investment by companies, enterprises, other economic organizations or individuals of Taiwan Province compatriots as investors in this Municipality. Article 3 The municipal, district and county (city) people's governments shall conscientiously implement the Law of People's Republic of China (PRC) on the Protection of Taiwan Province Compatriots' Investment, improve the investment environment and do a good job in protecting the legitimate rights and interests of Taiwan Province Compatriots' investors. Fourth city and district, county (city) Taiwan Province Provincial Affairs Department shall, in accordance with the provisions of the responsibilities, handle matters related to the investment of compatriots in Taiwan Province Province, and do a good job in organization, guidance, coordination and management.

The municipal, district and county (city) departments of foreign trade, planning, economy, industry and commerce, taxation, land, real estate, public security, labor, customs, commodity inspection and finance shall, according to their respective functions and duties, do a good job in the management and protection of investment by compatriots in Taiwan Province Province. Article 5 The identity confirmation of Taiwan Province compatriots investors shall be handled by the municipal Taiwan Province affairs department and its authorized district/county (city) Taiwan Province affairs department, and the Taiwan Province compatriots investors' identity confirmation certificate shall be issued; And by the municipal competent department and its authorized district and county (city) competent department issued the "Taiwan Province compatriots investment enterprise certificate".

Investors of Taiwan Province compatriots enjoy the preferential treatment stipulated by the state and this Municipality with the Certificate of Taiwan Province Compatriot Investment Enterprise and the Confirmation Certificate of Taiwan Province Compatriot Investor, and are protected according to law. Article 6 Investors of Taiwan Province compatriots and their enterprises investing in Chongqing must abide by national laws, regulations and these Regulations, and may not harm national interests and social public interests. Chapter II Scope of Investment Article 7 Investors of Taiwan Province compatriots who invest in the name of companies, enterprises or other economic organizations shall provide the following documents:

(1) A copy of the business license or registration certificate of the enterprise;

(two) the identity certificate of Taiwan Province compatriots or other certificates that can prove the identity of their legal representatives;

(3) commercial credit certification materials.

Investors of Taiwan Province compatriots who invest in their own names shall provide the following documents:

(a) Taiwan Province resident identity card or other documents that can prove personal identity;

(2) mainland travel permit for taiwan residents;

(3) Credit certificate. Article 8 Investors of Taiwan Province compatriots may entrust others as their investment agents. The power of attorney shall specify the agent's name, agency matters, authority and time limit, and shall be signed or sealed by the principal. Ninth Taiwan Province compatriots investors can take the following forms of investment according to law:

(a) the establishment of enterprises, joint ventures and cooperative enterprises with all capital;

(two) to obtain land use rights, development and operation;

(3) purchasing, leasing or contracting enterprises;

(4) purchasing stocks and bonds of enterprises;

(5) purchasing real estate;

(6) Other forms of investment permitted by laws and regulations. Tenth to encourage Taiwan Province compatriots to invest in the following projects:

(a) energy, transportation, municipal utilities and other infrastructure and basic raw materials industrial projects;

(two) the development of agriculture, forestry, animal husbandry and aquaculture and the introduction of new technologies and fine varieties, as well as agricultural infrastructure construction and comprehensive agricultural development projects;

(3) Environmental protection projects;

(4) High-tech projects with high technology content;

(five) export-oriented projects to meet the needs of the international market;

(6) Grafting transformation projects of state-owned enterprises that need technical transformation;

(seven) comprehensive long-term development projects of resettlement and resettlement in the Three Gorges reservoir area;

(eight) local ethnic projects with ethnic characteristics in ethnic minority areas;

(nine) projects in the economic and technological development zones and high-tech industrial development zones of this Municipality. Article 11 With the approval of the department specified by the State Council or the local people's government specified by the State Council, Taiwan Province compatriots investors may invest in the following projects:

(1) Investing in infrastructure projects by means of BOT;

(2) Joint ventures, cooperative supermarkets, chain stores and commercial retail enterprises;

(three) joint ventures, cooperative establishment of agricultural and sideline products wholesale and retail enterprises;

(4) Financial institutions in Taiwan Province Province apply for the establishment of banks or non-bank financial institutions;

(five) the establishment of information, consulting and other intermediary institutions;

(six) to hold public welfare undertakings such as medical care, sports and education;

(7) Tourism investment;

(eight) other investment projects allowed by the state. Chapter III Establishment of Enterprises Article 12 Investors of Taiwan Province compatriots who apply for the establishment of enterprises shall apply to the examination and approval authorities; The examination and approval authority shall make a decision of approval or disapproval within 30 days from the date of receiving all the application documents.

Taiwan Province compatriots investors shall, within 30 days from the date of receiving the approval certificate, go through the approval and registration with the administrative department for industry and commerce according to law; The administrative department for industry and commerce shall, within fifteen days from the date of receiving all the application documents, make a decision on whether to approve or disapprove the registration. Thirteenth Taiwan Province compatriots investors have all the capital of the enterprise, the operating period is determined by the investors themselves according to law; The term of operation of a joint venture or cooperative enterprise shall be determined by the parties to the joint venture or cooperative enterprise through consultation according to law.

The term of operation of enterprises invested by compatriots in Taiwan Province Province shall not exceed the term of land use of enterprises.
