According to the Notice of the General Office of Ministry of Human Resources and Social Security on Properly Handling Labor Relations during the Prevention and Control of Pneumonia Infected in novel coronavirus, wages and benefits of patients, suspected patients and close contacts infected with pneumonia in novel coronavirus during isolation and medical observation are paid by affiliated enterprises according to their wages during normal work. If the workers are not infected, suspected of being infected or in close contact, it is not necessary to be isolated for observation according to local management measures, but it is required to be isolated at home before going to work. It is suggested that the employer can take annual leave or negotiate wages with the workers during the period of self-isolation. If negotiation fails, it shall be handled as personal leave or absence.
According to Article 4 1 of the Law on the Prevention and Control of Infectious Diseases, if an isolated person has a work unit during the isolation period, his work unit shall not stop paying his remuneration during the isolation period.
Article 49 stipulates that if the close contacts of suspected patients or pathogen carriers of Class A infectious diseases are excluded as patients or pathogen carriers after detention, the wages and benefits during the detention period shall be paid by subordinate units according to attendance.
Second, how to calculate the wages of employees who work at home during the period of home isolation?
If the employing unit fails to arrange workers' holidays according to the needs of epidemic prevention work, it shall pay overtime wages according to 300% of the remuneration for statutory holidays. If other workers are arranged to work during the Spring Festival and cannot take compensatory time off, overtime pay shall be paid according to 200% of my salary.
For enterprises that shut down according to law, employees do not need to provide labor remuneration obligations based on government emergency measures during this period. If an enterprise stops production during the wage payment period, it shall pay the wages of its employees according to the standards agreed in the labor contract.
As can be seen from the above, wages will be paid during the period of home isolation. Because according to the notice issued by the state, the unit needs to pay the employee's salary according to the normal salary standard during the period of employee isolation or medical observation.
