Article 2 These Regulations shall apply to the development, utilization, conservation, protection and management of water resources and the prevention and control of water damage within the administrative areas of autonomous counties.

The water resources mentioned in these regulations include surface water and groundwater. Article 3 Water resources belong to the state. The People's Government of autonomous counties shall manage and protect water resources within the administrative areas of autonomous counties in accordance with legal provisions. The water in ponds and reservoirs built and managed by rural collective economic organizations or individuals shall be used by the rural collective economic organizations or individuals. Article 4 Autonomous counties encourage citizens, legal persons or other organizations to develop and utilize water resources in accordance with the law and protect their legitimate rights and interests in accordance with the principles of who invests in construction, who manages, and who benefits. Article 5: Autonomous counties implement a water abstraction licensing system and a paid use system for water resources in accordance with the law. The water resources fees collected are used as special funds for the development, utilization, conservation, protection, planning and management of water resources in autonomous counties, and are used exclusively for special purposes. Rural collective economic organizations and their members use water from ponds and reservoirs of the collective economic organization except water.

The water administrative department of the autonomous county people's government is responsible for the organization and implementation of the county's water licensing system and the paid use system of water resources. Article 6 The people's government of the autonomous county shall take measures to strengthen the management of water conservation, establish a system for the development and promotion of water conservation technology, and cultivate and develop the water conservation industry.

Article 8 The water administrative department of the autonomous county people's government is responsible for the unified management and supervision of water resources in the county.

Relevant departments of the autonomous county people's government shall be responsible for the development, utilization, conservation and protection of water resources in the county according to the division of responsibilities.

The township (town) people's government assists the water administrative department of the autonomous county people's government in the development, utilization, conservation, protection and management of water resources within its own administrative region. Chapter 2 Water Resources Planning, Development and Utilization Article 9 According to the requirements of Leshan City’s comprehensive water resources planning and the overall needs of the autonomous county’s economic and social development, the comprehensive planning of water resources within the administrative region of the autonomous county shall be made by the water administrative department of the autonomous county people’s government in conjunction with the autonomous county people’s government. It shall be prepared by the department and submitted to the autonomous county people's government for approval, and shall be reported to the water administration department of the Leshan Municipal People's Government for record.

Professional planning for rivers such as flood control, waterlogging control, irrigation, shipping, water supply, hydropower generation, bamboo and wood removal, fishery, water resources protection, soil and water conservation, water conservation, hydrological testing, dynamic monitoring, etc., are carried out by the people of the autonomous county The water administrative department of the government shall prepare the plan and submit it to the autonomous county people's government for approval after soliciting opinions from the relevant departments of the autonomous county people's government. Article 11 Water engineering projects that are newly built, expanded, renovated, developed, utilized and protected within the administrative areas of autonomous counties shall comply with the comprehensive planning and professional planning of water resources, and shall be reviewed and approved by the water administrative department of the autonomous county people's government in accordance with national regulations. The capital construction procedures are submitted for approval. Article 12 Citizens, legal persons or other organizations that directly draw water resources from rivers, underground and water projects within the administrative areas of autonomous counties shall apply to the water administrative department of the autonomous county people's government to obtain a water drawing license, pay water resources fees, and obtain water drawing rights. . Metering facilities should be installed for water intake and water metering should be implemented.

The following water-drawing activities do not require a water-drawing permit:

(1) Drawing a small amount of water for family life and scattered and free-range livestock and poultry for drinking;

( 2) Drawing water to maintain public safety and eliminate harm to public interests (such as firefighting);

(3) Drawing water for non-commercial public welfare undertakings;

(4) Temporary water extraction in rural areas for drought relief. Article 13 Autonomous counties encourage and support rural collective economic organizations or their members to invest and labor in the construction of mountain ponds, stone river weirs, reservoirs, reservoirs and other small water conservancy projects on collective land or contracted land owned by the collective economic organization in accordance with the law. Projects, in accordance with the principles of who invests in construction, who manages, and who benefits, manage and rationally use water engineering facilities and their water storage, and are exempt from applying for water abstraction permits and paying water resources fees. Except for commercial use. Article 14: Autonomous counties encourage the development and utilization of water energy resources.

Article 15 If the construction of a water project requires resettlement, the policy of developmental resettlement should be implemented and carried out simultaneously with the project construction. The construction unit shall, based on the environmental capacity of the resettlement area and the principle of sustainable development, work with the autonomous county people's government to organize the preparation of a resettlement plan, solicit the opinions of the resettled people, and organize its implementation in accordance with relevant procedures. The required resettlement funds are included in the project construction investment plan.
