The Law on the Protection of the Rights and Interests of Returned Overseas Chinese in People's Republic of China (PRC) clearly stipulates: "Returned overseas Chinese refer to overseas Chinese who have returned to China to settle down. Overseas Chinese refer to China citizens who are designated to live abroad. Relatives of overseas Chinese refer to relatives of overseas Chinese and returned overseas Chinese in China. "

In order to meet the needs of work, the State Council Overseas Chinese Affairs Office and other relevant departments have made specific explanations on the above concepts:

1. Overseas Chinese: Designated China citizens living abroad.

2. Returned overseas Chinese: refers to overseas Chinese who have returned to China to settle down. No matter how old you are and when you return to China, you are all returned overseas Chinese. Foreign Chinese who have settled in China are also called returned overseas Chinese after their China nationality is restored.

3. Overseas Chinese students refer to overseas Chinese who have returned to study and have not settled in China.

4. Returned overseas Chinese students refer to overseas Chinese who have returned from abroad to settle and study. Regardless of their age, they are all returned overseas Chinese students.

5. Family members of overseas Chinese: refers to the family members of overseas Chinese in China. Including spouses, parents, children (including daughter-in-law, son-in-law), brothers and sisters, grandparents, grandchildren, grandchildren, caregivers and other relatives whose main source of livelihood depends on overseas Chinese.

After overseas Chinese return to China, their domestic dependents are still regarded as relatives of overseas Chinese.

Family members of overseas Chinese with China nationality in China have the same scope as overseas Chinese relatives (enjoy the treatment of overseas Chinese relatives).

6. Foreign Chinese: refers to people who were originally overseas Chinese or descendants of Chinese, but later joined or acquired the nationality of their country of residence (domestic preferential policies for overseas Chinese can generally be applied to foreign Chinese).
