Water Resources Protection Measures in Baipenzhu Reservoir Area of Fengshuba, Xinfeng River, Dongjiang River Basin, Guangdong Province

Article 1 In order to strengthen the protection of water resources in Xinfengjiang, Fengshuba and Baipenzhu reservoir areas of Dongjiang River Basin, and ensure the safety of Dongjiang water supply, these measures are formulated in accordance with the regulations of Guangdong Province on the management of water conservancy projects, the regulations of Guangdong Province on the management of water resources in Beijiang Hanjiang River Basin, the regulations of Guangdong Province on the protection of drinking water quality and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the water resources protection activities in Xinfengjiang, Fengshuba and Baipenzhu reservoir areas (hereinafter referred to as the reservoir areas) within the administrative area of this province.

The protection of water resources in the reservoir area should adhere to the principles of prevention first, comprehensive planning, comprehensive management, strengthening supervision and treating both the symptoms and the root causes. The Dongjiang River Basin Management Agency under the water administrative department of the third provincial people's government is responsible for organizing the implementation of unified supervision, guidance and coordination on the protection of water resources in the reservoir area. Article 4 The people's governments at or above the county level in the reservoir area shall incorporate the protection of water resources and water environment in the reservoir area into the local economic and social development plan, rationally adjust the industrial layout, take countermeasures and measures to prevent and control water pollution, improve the ecological environment, ensure that the water quality in the reservoir area meets the requirements of surface water functional zones and water environmental functional zones, and be responsible for the water environmental quality in the reservoir area. Article 5 The competent administrative department of environmental protection shall exercise unified supervision and management over water environmental protection and water pollution prevention and control in the reservoir area, regularly monitor the water environmental quality in the reservoir area, and investigate and handle water pollution incidents in the reservoir area.

The administrative department of land and resources is responsible for monitoring and protecting the geological environment of the reservoir area, and supervising and managing the development of mineral resources in the reservoir area.

The forestry administrative department is responsible for the construction of forestry ecological environment and the protection of forestry resources in the reservoir area.

The fishery administrative department is responsible for the management of fishery production in the reservoir area.

The administrative department of agriculture is responsible for the supervision and management of the production environment of agricultural planting and livestock breeding in the reservoir area to prevent water pollution caused by unreasonable use of chemical fertilizers, pesticides and livestock breeding.

The reservoir project management unit is responsible for the management of reservoir projects, maintaining the safe operation of reservoir dams and power stations, and coordinating the related work of water resources protection in the reservoir area. Sixth Dongjiang River basin management agencies shall coordinate with the people's governments at or above the county level to delineate the management scope and protection scope of the reservoir area.

The scope of reservoir management mentioned in the preceding paragraph refers to the land and waters below the elevation line or land requisition line at the upstream dam site, and the scope of reservoir protection refers to the land and waters between the elevation line or land requisition line at the upstream dam site and the first watershed ridge.

After the delineation of the management scope and protection scope of the reservoir area, permanent boundary markers shall be buried at the boundary of the scope, and no unit or individual may move or destroy the boundary markers. Article 7 The water resources protection plan for the reservoir area shall be compiled by the Dongjiang River Basin Management Agency in conjunction with the people's government at the county level where the reservoir area is located, audited by the water administrative department of the provincial people's government, and submitted to the provincial people's government for approval after soliciting the opinions of the relevant departments at the same level and the people's governments listed at the prefecture level.

The approved water resources protection plan for the reservoir area shall be organized and implemented by the Dongjiang River Basin Management Agency. Article 8 Within the management scope of the reservoir area, the prohibitive provisions of laws and regulations such as People's Republic of China (PRC) Water Pollution Prevention Law, Guangdong Water Conservancy Project Management Regulations and Guangdong Drinking Water Quality Protection Regulations shall be observed. Ninth within the scope of protection of the reservoir area, it is forbidden to plant economic forests by means of mountain smelting or large-scale mechanical reclamation, and it is forbidden to plant fast-growing and high-yield forests such as eucalyptus. Where fast-growing and high-yield forests such as eucalyptus have been planted, stand transformation should be gradually implemented, and activities that destroy water resources such as quarrying, mining, earth borrowing, land reclamation on steep slopes, deforestation and large-scale breeding are prohibited. Tenth in the reservoir area within the scope of management and protection of new construction projects, expansion, renovation, the construction plan shall solicit the opinions of the Dongjiang River Basin management agencies. If the Dongjiang River Basin management institution fails to sign an opinion or fails to meet the water resources protection plan of the reservoir area after examination, the relevant administrative departments shall not approve it.

The construction of the construction project specified in the preceding paragraph shall be subject to the inspection and supervision of the Dongjiang River Basin Management Agency and the water administrative department, and the completion acceptance shall be attended by the Dongjiang River Basin Management Agency and the water administrative department. Article 11 The construction, renovation and expansion of sewage outlets in important reaches of rivers flowing into non-drinking water source protection areas shall be approved by the Dongjiang River Basin management institution and the water administrative department of the people's government at the county level in the reservoir area, and the environmental protection administrative department shall be responsible for examining and approving the environmental impact report of the project. The sewage outlets that have been built should be treated within a time limit to meet the discharge standards; Can not meet the emission standards, the deadline to close. Twelfth in the reservoir area management and protection should strictly control the construction of tourism projects. If it is really necessary to build it, it shall solicit the opinions of the Dongjiang River Basin management organization, and report it to the relevant departments for approval after the consent of the provincial water administrative department. Except as otherwise provided by laws and regulations. Thirteenth Dongjiang River basin management agencies should monitor the quality of water resources in important sections of reservoirs and major rivers in storage. If it is found that the total discharge of key pollutants exceeds the control index, or the water quality in the water function area does not meet the requirements of water use function, it shall promptly notify the relevant people's governments in the basin to take control measures and notify the competent administrative department of environmental protection.
