Regulations on the protection and management of water resources in Lancang Lahu Autonomous County, Yunnan Province

Article 1 In order to strengthen the protection and management of water resources, realize the sustainable utilization of water resources, and promote the coordinated development of economy, society, resources and environment, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC) and the Law on Prevention and Control of Water Pollution of People's Republic of China (PRC), combined with the actual situation of Lancang Lahu Autonomous County (hereinafter referred to as Autonomous County). Article 2 These Regulations shall apply to the development, utilization, conservation, protection and management of water resources within the administrative area of Autonomous County. Article 3 The protection, management, development and utilization of water resources shall adhere to the principles of scientific planning, giving priority to protection, overall planning and coordination, rational development, water conservation, comprehensive management and sustainable utilization. Fourth autonomous county water department is responsible for the protection, management, development, utilization and supervision of water resources. Other relevant functional departments shall, in accordance with their respective responsibilities, do a good job in the protection, management and development and utilization of water resources.

The township (town) water management institution is authorized by the water department of the autonomous county, and under the leadership of the township (town) people's government, it specifically undertakes the protection, management and development and utilization of water resources within its jurisdiction.

Village (neighborhood) committees and villagers' groups shall assist in the protection and management of water resources. Fifth Autonomous County People's Government shall strengthen the leadership on the protection, management, development and utilization of water resources, and incorporate them into the national economic and social development plan, and the required funds shall be included in the fiscal budget. Sixth Autonomous County People's Government shall set up a water resources protection fund. Main sources of funds:

(a) the funds arranged by the county budget;

(2) Support funds from higher authorities;

(3) social donations;

(4) Other funds. Seventh Autonomous County People's Government shall incorporate water resources protection into the publicity and education plan of the rule of law, and March every year is the publicity and education month of water resources protection. Article 8 All units and individuals have the obligation to save water and protect water resources, water projects and their facilities, and have the right to stop and report acts that damage water resources, water projects and their facilities. Ninth Autonomous County People's Government shall, in accordance with the relevant provisions of the state and the province, commend and reward the units and individuals that have made remarkable achievements in the protection, management, development and utilization of water resources. Tenth autonomous county water department shall, jointly with the relevant departments, formulate comprehensive planning and professional planning on water resources protection, and report to the Autonomous County People's government for approval, and report to the superior water department for the record. The approved plan shall not be changed without authorization. If it is really necessary to change, it shall be submitted for approval in accordance with the original examination and approval procedures.

Professional planning of water resources protection, water supply, irrigation and water saving. Prepared by the water department of the Autonomous County and reported to the Autonomous County People's Government for approval before implementation. Eleventh Autonomous County People's government to encourage units and individuals to invest in the development and utilization of water resources according to law, to protect the legitimate rights and interests of investors.

The development and utilization of water resources shall conform to the comprehensive planning and professional planning of water resources protection, and shall be submitted for approval according to the prescribed procedures after being approved by the water department of the Autonomous County. Twelfth hydropower station development and construction should protect the ecological environment, adhere to the combination of promoting benefits and eliminating pests, taking into account the needs of flood control, water supply, irrigation, shipping and fisheries.

Development and construction units shall fulfill their obligations of ecological environment protection and restoration according to law. Article 13 Where a rural collective economic organization or its members invest in the construction of water engineering facilities on the collective land or contracted land legally owned by the collective economic organization, they shall manage and rationally utilize the water engineering facilities and their storage in accordance with the principle that whoever invests in the construction, manages them and benefits them. Fourteenth in the protection, management, development and utilization of water resources, involving the relocation of immigrants, the construction unit shall incorporate the required funds for immigrants into the investment plan for engineering construction, properly arrange the production and life of immigrants, and protect the legitimate rights and interests of immigrants. Fifteenth Autonomous County to strengthen the protection and management of rivers, reservoirs and channels, the implementation of the river length system. Specific measures shall be formulated by the Autonomous County People's government. Sixteenth major rivers, reservoirs, dams and other water sources within the administrative area of Autonomous County shall implement the water quality protection standards of water function zoning.

The water quality of small reservoirs, such as Nanbinghe Reservoir and Nanzhanghe Reservoir, is not lower than the Class II standard of the National Environmental Quality Standard for Surface Water; The water quality of major rivers such as Heihe River, Nanlang River and Xiayun River is not lower than the Class III standard of the National Environmental Quality Standard for Surface Water. Seventeenth in rivers, reservoirs and dams prohibit the following acts:

(a) unauthorized construction, renovation and expansion of sewage outlets;

(2) Discharging or dumping industrial waste residue and municipal garbage into water bodies;

(three) the use of fried fish, poisonous fish, electric fish and other methods to destroy fishery resources for fishing;

(4) Discarding the carcasses of livestock and poultry. Eighteenth Autonomous County People's Government shall delimit the scope of protection of water conservation forest and soil and water conservation forest, set up signs and make an announcement to the public. Within the scope of protection, it is necessary to gradually return farmland to forests, plant trees and grass, and prevent soil erosion and water depletion.

Water conservation forest should be gradually incorporated into the management of ecological public welfare forest and compensated according to law. Nineteenth autonomous county water supply units should strengthen the maintenance and management of water supply facilities to ensure normal water supply. Water units and individuals shall install metering facilities and pay water charges in accordance with regulations. For those who refuse to pay the water fee, the water supply unit has the right to limit or stop the water supply.
