Regulations on the examination and approval of Hong Kong and Macao residents settling in the Mainland

In order to protect the legitimate rights and interests of China citizens who are residents of the Hong Kong Special Administrative Region and the Macao Special Administrative Region (hereinafter referred to as Hong Kong and Macao residents) to settle in the Mainland, and standardize the administration of acceptance, examination and approval of applications by Hong Kong and Macao residents to settle in the Mainland, this specification is formulated in accordance with the Regulations on the Administration of China Citizens Travelling between the Mainland and the Hong Kong Special Administrative Region.

Application conditions

Article 1 [Application Conditions] Residents of Hong Kong and Macao may apply for settlement in the Mainland under any of the following circumstances:

(a) need to reunite with their spouses in the mainland;

(two) at least eighteen years of age, parents have settled in the mainland, there are no children in the mainland, and they need to be taken care of in the mainland;

(three) under the age of eighteen, need to take refuge in mainland parents;

(four) there are no children in the Hong Kong Special Administrative Region or the Macao Special Administrative Region, and they need to take refuge in the children who have settled in the mainland and have reached the age of 18;

(five) special circumstances need to settle in the mainland.

Accept the audit

Article 2 [Accepting Authority] Where residents of Hong Kong and Macao apply to settle in the Mainland, the entry-exit administrative organ of the public security organ at or above the prefecture level (hereinafter referred to as the accepting authority) where their relatives in the Mainland are reunited shall be responsible for accepting the application.

Article 3 [Application Materials] Applicants and their mainland relatives who intend to reunite must be present at the same time for interviews and inquiries, and submit the following materials:

(1) An Application Form for Hong Kong and Macao Residents to Settle in the Mainland, which is filled in and affixed with the applicant's recent bareheaded color photo (48×33mm);

(2) A complete statement of consent for relatives from Hong Kong and Macao to settle in the Mainland, with recent bareheaded color photos (48× 33mm) of relatives from the Mainland who intend to reunite with the applicant;

(3) Submit the applicant's identity card of Hong Kong Special Administrative Region or Macao Special Administrative Region and the original passport of Hong Kong and Macao residents to and from the Mainland, and submit a copy;

(4) Submit the original ID card and household registration book of the mainland relatives that the applicant intends to reunite, and submit a copy of the certificate;

(5) Proof corresponding to the reasons for application;

(6) Other materials deemed necessary by the exit-entry administrative organ of the public security organ.

Article 4 [Proof of application reasons] The proof corresponding to the application reasons in Item (5) of Article 3 of these Specifications refers to:

(a) Marriage certificate in case of husband and wife reunion;

(2) For children who take care of their parents, it refers to the proof of the relationship between parents and children and the proof that they have no children in the Mainland;

(3) if the children take refuge in their parents, it refers to the proof of the relationship between parents and children;

(4) If parents take refuge in their children, it refers to the proof of the relationship between parents and children and the proof that parents have no children in the Hong Kong Special Administrative Region or the Macao Special Administrative Region;

(5) In case of special circumstances, it refers to the certificate corresponding to the specific special circumstances.

Article 5 [Acceptance of Audit]

When accepting applications from Hong Kong and Macao residents to settle in the Mainland, the accepting organ shall ask the applicants and their mainland relatives who intend to reunite, and examine the following matters:

(1) Whether the application form and declaration form are complete and meet the requirements;

(2) Whether the identity cards of Hong Kong Special Administrative Region and Macao Special Administrative Region and Hong Kong and Macao residents' passes to and from the Mainland submitted by the applicant are true and valid;

(3) Whether the identity cards and household registers of the mainland relatives to be reunited by the applicant are true and valid;

(4) Records of the mainland relatives of the applicant who intends to reunite applying for settlement and visiting relatives in Hong Kong and Macao;

(5) Whether the documents corresponding to the reasons for application meet the requirements;

(six) to examine whether the applicant is a person who has been refused a residence certificate for Hong Kong and Macao residents in the Mainland according to law.

Article 6 [Acceptance]

The accepting organ shall deal with it separately according to the audit situation:

(1) If the application conditions are met and the application materials are complete, it shall be accepted, and the copy of the application materials submitted by the applicant shall be stamped with the audit seal; Input the applicant's relevant information into the public security entry-exit management information system, collect the on-site portraits, and issue an acceptance receipt to the applicant;

(2) Where the application materials are incomplete,

Will not be accepted, and inform the applicant of all the contents that need to be corrected;

(three) does not meet the application conditions, will not be accepted, and inform the applicant on the spot;

(four) if there is any doubt about the application, investigate it in time; Indicate the findings and put forward the audit opinions that will not be recognized.

Article 7 After the accepting organ solicits the opinions of the household registration administration department of the public security organ at the same level, the local public security organ shall put forward the acceptance opinions and report them to the provincial public security organ for examination and approval.

Approval and issuance

Article 8 [Examination and Approval Authority]

Public security organs at or above the provincial level are responsible for examining and approving applications from Hong Kong and Macao residents to settle in the Mainland.

Article 9 [Approval]

The application materials submitted by the local public security organs shall be examined by the exit-entry administration of the provincial public security organs:

(a) whether the application meets the requirements, and whether the application materials are complete and meet the requirements;

(2) Whether the accepting organ meets with the applicant and his relatives in the Mainland for reunion as required, whether it collects the portraits on the spot, and compares whether the photos submitted by the applicant, the photos of Hong Kong and Macao residents' identity cards and the portraits on the spot are the same person, whether the application materials are reviewed and stamped with the verification stamp, and whether the relevant information of the applicant is accurately entered;

(3) Whether the acceptance opinions are clear;

(four) to examine the authenticity and validity of the identity certificate of the applicant and his relatives in the mainland;

(five) to review the records of the mainland relatives of the applicant who intend to reunite to apply for settlement and visit relatives in Hong Kong and Macao;

(six) to examine whether the applicant has a statutory refusal to issue a residence permit for Hong Kong and Macao residents to the mainland.

Article 10 [Approval Process]

The exit and entry administration agencies of provincial public security organs shall deal with it according to the review:

(a) meet the application conditions, complete materials and procedures, solicit opinions from the household registration management department of the public security organ at the same level, and report to the provincial public security organ for examination and approval;

(two) in line with the application conditions, but the materials and procedures are not complete, the application materials will be returned to the accepting organ for correction;

(three) if there is any doubt about the application, investigate it in time;

(four) do not meet the application conditions or refuse to issue certificates for Hong Kong and Macao residents to settle in the mainland according to law, the exit-entry administration department of the provincial public security organ shall put forward an audit opinion of disapproval and report it to the provincial public security organ. After the provincial public security organ makes a decision not to approve,

The exit-entry administrative organ of the provincial public security organ shall inform the applicant of the decision not to approve its settlement in the mainland and the reasons.

Article 11 [Handling of Special Situations]

Under special circumstances, the provincial public security organ shall report to the Ministry of Public Security for approval.

Article 12 [Issuance of Certificates]

If the provincial public security organ approves the consent of Hong Kong and Macao residents to settle in the Mainland, it shall issue a certificate of Hong Kong and Macao residents' settlement in the Mainland for the applicant.

The certificate for Hong Kong and Macao residents to settle in the Mainland shall be uniformly made by the exit-entry administration department of the provincial public security organ, valid for six months, and valid for one use.

Article 13 [Procedures for Handling Certificates] When issuing the Pass for Hong Kong and Macao Residents to and from the Mainland, the exit-entry administration of the provincial public security organ shall take back the Pass for Hong Kong and Macao Residents to and from the Mainland or the Home Visit Permit for Hong Kong and Macao Compatriots held by the applicant, cut off the upper right corner of the certificate and declare it invalid in the invalid certificate database of the public security exit-entry management information system.

At the same time, the applicant must submit the resident identity card of the Hong Kong Special Administrative Region or the Macao Special Administrative Region to the exit-entry administration of the provincial public security organ and send it back to the original issuing department of the Hong Kong Special Administrative Region or the Macao Special Administrative Region. The exit-entry administration of the provincial public security organ issues the Certificate of Withdrawal for the applicant.

Article 14 [Working Hours] The public security organ shall make a decision on examination and approval within 60 days from the date of accepting the application of Hong Kong and Macao residents to settle in the Mainland. Due to special circumstances, if the public security organ cannot complete the examination and approval within the prescribed time limit, the examination and approval time may be extended to 90 days with the approval of the person in charge of the examination and approval organ.

Article 15 [Data Transmission]

The entry-exit management agency of the provincial public security organ transmits the basic data of the applicant and the relatives to be reunited to the entry-exit management information system of the Ministry of Public Security.

Article 16 [Household Registration]

The applicant shall go through the formalities of permanent residence registration with the residence permit of Hong Kong and Macao residents in the Mainland and the certificate of recovery. The household registration administration department of the public security organ at the prefecture level shall notify the entry-exit administration department of the public security organ at the same level of the applicant's registration of permanent residence.

Article 17

[Replacement and replacement of certificates]

After receiving the Certificate for Hong Kong and Macao Residents to Settle in the Mainland, if the certificate is lost, stolen or damaged within the validity period of the certificate, the applicant shall apply to the examination and approval authority for renewal or replacement. If the certificate is lost or stolen, a written statement shall be submitted and the original certificate shall be returned.

If the applicant fails to go through the registration formalities of permanent residence in the household registration department of the public security organ of the place of residence within the validity period of the certificate without justifiable reasons, he shall reapply for the Certificate of Residence of Hong Kong and Macao Residents in the Mainland in accordance with the provisions of this Code.

Chita

Article 18 After Hong Kong and Macao residents are allowed to settle in the Mainland, the exit-entry administration department of the public security organ will no longer issue the Permit for Hong Kong and Macao Residents to Travel to and from the Mainland, and their applications for entry and exit from the Hong Kong Special Administrative Region or the Macao Special Administrative Region will be handled as mainland residents.

Article 19 After Hong Kong and Macao residents have been approved to settle in the Mainland, their relatives in the Mainland will automatically lose their eligibility to apply to settle and visit relatives in the Hong Kong Special Administrative Region or the Macao Special Administrative Region on the grounds of reunion with them.
