Rules of procedure of the Standing Committee of Chongqing Municipal People's Congress

Chapter I General Provisions Article 1 In order to ensure the Standing Committee of the Municipal People's Congress (hereinafter referred to as the Standing Committee of the Municipal People's Congress) to exercise its functions and powers according to law, regulate the behavior of the members of the Standing Committee of the Municipal People's Congress and improve the efficiency of deliberation, these Rules are formulated in accordance with the Constitution of People's Republic of China (PRC). Organic law of People's Republic of China (PRC) local people's congresses and local people's governments at all levels, combined with the actual situation of this municipality. Article 2 The members of the Standing Committee of the Municipal People's Congress as mentioned in these Rules refer to the chairman, deputy directors, secretary-general and members of the Standing Committee of the Municipal People's Congress. Article 4 The members of the Standing Committee of the Municipal People's Congress shall safeguard the dignity of the Constitution and laws, safeguard the fundamental interests of the state and the people, keep close contact with the deputies to the Municipal People's Congress and the people, reflect the wishes of the people in a timely manner, and consciously accept the supervision of the people. Article 5 The speeches and votes of members of the Standing Committee of the Municipal People's Congress at the meeting and the speeches of deputies to the National People's Congress who attended the meeting as nonvoting delegates shall not be investigated by law. Chapter II Convening of Meetings Article 6 Meetings of the Standing Committee of the Municipal People's Congress shall be held at least once every two months; When there are special needs, a meeting can be convened temporarily.

The meeting of the Standing Committee of the Municipal People's Congress shall be convened by the chairman of the Standing Committee of the Municipal People's Congress. When the director is unable to convene due to special circumstances, he may entrust the deputy director to convene in writing. The date of the meeting of the Standing Committee of the Seventh Municipal People's Congress shall be decided by the meeting of directors of the Standing Committee of the Municipal People's Congress; The draft agenda of the meeting shall be drawn up by the meeting of directors of the Standing Committee of the Municipal People's Congress and submitted to the plenary meeting of the Standing Committee of the Municipal People's Congress for decision.

During the meeting of the Standing Committee of the Municipal People's Congress, if it is necessary to temporarily adjust the agenda of the meeting, the meeting of directors shall submit it to the plenary meeting of the Standing Committee for decision. Article 8 When the meeting of the Standing Committee of the Municipal People's Congress is held, the notice of the meeting shall be delivered to the members of the Standing Committee and those who attend the meeting 20 days before the meeting is held. The main documents submitted to the meeting for deliberation shall be sent 10 before the meeting.

The interim meeting of the Standing Committee of the Municipal People's Congress may be notified temporarily. If you are unable to attend due to illness or something, you must ask for leave in writing to the convener of the meeting through the general office of the Standing Committee before the meeting is held. Tenth Municipal People's Congress Standing Committee meeting must be attended by more than half of all members of the Standing Committee. Article 11 When the Standing Committee of the Municipal People's Congress holds a meeting, the responsible persons of the Municipal People's Government, the Municipal Higher People's Court and the Municipal People's Procuratorate shall attend the meeting as nonvoting delegates. According to the needs, the person in charge of the relevant departments may be notified to attend the meeting as nonvoting delegates.

Deputy Secretary-General of the Standing Committee of the Municipal People's Congress, vice chairman of the special committee of the Municipal People's Congress, and person in charge of the working body of the Standing Committee of the Municipal People's Congress attended the meeting of the Standing Committee of the National People's Congress as nonvoting delegates.

According to the needs, the Standing Committee of the Municipal People's Congress may invite some representatives of the National People's Congress of this Municipality and the directors or deputy directors of the relevant district, county (city) people's Congress Standing Committee to attend the meeting as nonvoting delegates.

Those present at the meeting have the right to speak, but not to vote. Twelfth Municipal People's Congress Standing Committee held a meeting, first through the agenda of the meeting, and then according to the agenda notice item by item. Thirteenth meeting of the Standing Committee of the Municipal People's Congress shall hold a plenary meeting of the members of the Standing Committee, which may be considered in groups or groups according to needs. The person in charge of the relevant parties must attend the meeting to listen to opinions and answer questions. Chapter III Proposal and Deliberation Article 15 The major issues that need to be submitted to the Standing Committee of the Municipal People's Congress for deliberation and decision are as follows:

(a) compliance with and implementation of the Constitution, laws, administrative regulations and local regulations;

(two) the implementation of the resolutions and decisions of the National People's Congress and its Standing Committee, the Municipal People's Congress and its Standing Committee;

(3) Formulating local regulations;

(four) the implementation of the national economic and social development plan and the annual plan, as well as the financial budget and some changes at the corresponding level;

(five) major issues of resettlement, poverty alleviation and development and the revitalization of the old industrial base in the Three Gorges reservoir area;

(six) major issues in urban planning, construction, management and environmental and resource protection;

(seven) major issues in education, science, culture, health, sports and population;

(eight) major issues in ethnic, religious, civil affairs, overseas Chinese affairs and Taiwan Province affairs;

(nine) major issues of social stability and public security work;

(ten) to conclude sister city relations and major foreign affairs activities with foreign cities;

(eleven) major issues of general concern to the people;

(twelve) awarded the honorary title of the place;

(thirteen) personnel appointment and removal matters;

(14) Deciding to dismiss relevant personnel according to law;

(fifteen) major issues of the general election of the Municipal People's Congress, the by-election of vacant deputies to the National People's Congress and the recall of individual representatives;

(sixteen) to decide whether to allow the arrest or criminal trial of the Municipal People's Congress deputies suspected of criminal offences, and whether to allow the Municipal People's Congress deputies suspected of criminal offences to take other measures to restrict personal freedom as prescribed by law;

(seventeen) to revoke the inappropriate decisions, orders and rules of the Municipal People's government, and to revoke the inappropriate resolutions and decisions of the district and county (city) people's congresses and their standing committees;

(eighteen) matters authorized by the Standing Committee of the Municipal People's Congress for deliberation and decision, as well as other major matters that the Standing Committee deems necessary for deliberation and decision.
