Can someone with a criminal record get a passport and visa?
People with criminal records will not affect their ability to apply for a passport. But whether it will affect the visa depends on the visa policy of the destination country. If it does not require a clean criminal record, it does not matter.
Legal basis:
1. The "Passport Law of the People's Republic of China" stipulates that if the applicant has any of the following circumstances, the passport-issuing authority will not issue a passport:< /p>
(1) Those who do not have the nationality of the People’s Republic of China;
(2) Those who cannot prove their identity;
(3) During the application process Those who commit fraud;
(4) Those who have been sentenced and are serving their sentences;
(5) Those who have been notified by the People’s Court that they have unfinished civil cases and cannot leave the country;
(6) Being a defendant in a criminal case or a criminal suspect;
(7) The relevant competent department of the State Council believes that leaving the country will cause harm to national security or cause significant losses to national interests.
2. Article 12 of the "Exit and Entry Administration Law of the People's Republic of China" stipulates that Chinese citizens who are under any of the following circumstances are not allowed to leave the country:
(1) ) Failure to hold valid exit and entry documents or refusing or evading border inspection; (2) Being sentenced to a sentence that has not yet been completed or being a defendant or criminal suspect in a criminal case;
(3) There are unresolved civil cases and the People’s Court decides not to leave the country;
(4) Subject to criminal penalties for obstructing national (border) border management or for illegal leaving the country, illegal residence, or illegal employment Being repatriated from other countries or regions and not being allowed to leave the country before the specified period of time;
(5) It may endanger national security and interests, and the relevant competent department of the State Council decides not to leave the country;
(6) Other circumstances in which departure from the country is prohibited according to laws and administrative regulations.
