Archives norm
Legal basis: Archives Law of People's Republic of China (PRC).
Article 1 This Law is formulated in order to strengthen archives management, standardize archives collection and arrangement, effectively protect and utilize archives, improve the level of archives informatization construction, promote the modernization of national governance system and governance capacity, and serve the cause of Socialism with Chinese characteristics.
Article 2 This Law shall apply to the collection, arrangement, protection, utilization, supervision and management of archives. The archives mentioned in this Law refer to various forms of historical records, such as words, charts, audio-visual and so on, which are directly formed by past and present organs, groups, enterprises, institutions and other organizations and individuals engaged in economic, political, cultural, social, ecological civilization, military affairs, foreign affairs, science and technology and other activities, and are of preservation value to the country and society.
Third, uphold the Party's leadership over archival work. People's governments at all levels should strengthen the archival work, incorporate the archival undertaking into the national economic and social development plan, and incorporate the archival undertaking development funds into the government budget to ensure that the archival undertaking development is compatible with the national economic and social development level.
Article 4 Archives work shall be conducted under the principle of unified leadership and hierarchical management, so as to maintain the integrity and safety of archives and facilitate the use of all sectors of society.
Article 5 All state organs, armed forces, political parties, organizations, enterprises, institutions and citizens have the obligation to protect archives and enjoy the right to use archives according to law.
Article 6 The State encourages and supports scientific research and technological innovation of archives, promotes the transformation and application of scientific and technological achievements in the collection, collation, protection and utilization of archives, and promotes scientific and technological progress of archives. The state takes measures to strengthen the publicity and education of archives and enhance the archives consciousness of the whole society. The state encourages and supports international exchanges and cooperation in the field of archives.
Article 7 The State encourages social forces to participate in and support the development of archival undertakings. Units and individuals that have made outstanding contributions to the collection, collation, protection and utilization of archives shall be commended and rewarded in accordance with relevant state regulations.
Article 8 The national archives department is in charge of the national archives work, and is responsible for the overall planning, organization and coordination, unified construction, supervision and guidance of the national archives cause. The local archival departments at or above the county level shall be in charge of the archival work within their respective administrative areas, and supervise and guide the archival work of organs, groups, enterprises, institutions and other organizations within their respective administrative areas. Township people's governments shall designate personnel to be responsible for the archives management of their own organs, and supervise and guide the archives work of their subordinate units and grassroots mass autonomous organizations.
Article 9 State organs, public organizations, enterprises, institutions and other organizations shall make sure that archival institutions or archivists are responsible for managing the archives of their own units, and supervise and guide the archival work of their subordinate units. According to the needs of archives management, the central state organs shall guide the archives work of this system within the scope of their duties.
