What procedures and materials are needed for marriage registration?

The marriage registration process is roughly as follows:

(1) application

Those who meet the requirements for applying for marriage registration shall apply for marriage registration in person with their own registration photos, relevant certificates and supporting materials, and fill in the declaration required for applying for marriage registration on the spot.

The documents and materials for applying for marriage registration depend on individual circumstances. For example, if a citizen of China applies for marriage registration in China (except Hong Kong, Macao and Taiwan), he/she needs to hold his/her identity certificate, household registration certificate, marriage examination certificate, a signed statement that he/she has no spouse and no lineal blood relationship with the other party and collateral blood relationship within three generations, and the divorced party also needs a divorce certificate or divorce certificate.

Foreigners living in China, foreign Chinese and other foreigners applying for marriage registration in China need to hold their identity documents (passports or other nationality certificates), valid residence permits for foreigners, official certificates of marital status and other materials.

(2) Review

The marriage registration office will check and review the submitted application materials to find out whether the application for marriage is correct, and the marriage registration office will ask the parties concerned and ask them to provide corresponding certification materials when necessary.

(3) Registration and licensing

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and then issue a marriage certificate; For divorced people, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.

What procedures and documents do you need for divorce?

The process of divorce registration is roughly as follows:

(1) application

If both husband and wife want a divorce, they shall sign a divorce agreement in accordance with the regulations, apply to the marriage registration authority (which has jurisdiction), and provide the following documents and supporting materials:

(2) Accept

If it does not meet the application conditions, it will not be accepted, and the parties concerned may request to issue a Notice of Rejecting the Application for Divorce Registration.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party unwilling to divorce may withdraw the previously submitted application for divorce registration from the divorce registration office accepting the application for divorce registration with his valid identity certificate and the Receipt for Accepting the Divorce Registration (if the receipt cannot be found, the reasons can be explained in writing), and fill out the Application for Withdrawing the Divorce Registration in person. After verification, the marriage registration authority shall issue the Confirmation of Divorce Registration to the parties concerned, and file the Application for Divorce Registration, the Application for Divorce Registration and the Confirmation of Divorce Registration (stubs) together. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.

(4) Review

Within 30 days after the end of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the cooling-off period), both parties shall bring relevant documents and materials as required, such as photos, marriage certificates, ID cards or passports, divorce agreements, etc. , and apply for a divorce certificate at the marriage registration office as required. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. If it does not meet the requirements for divorce registration, it shall not be handled, and if the parties request to issue a notice of not handling divorce registration, it shall be issued.

(5) Registration (certification)

The marriage registration authority shall register in accordance with the provisions and issue a divorce certificate.
