Regulations on Ecological Protection of Bayinbuluke Grassland (20 16)

Article 1 In order to promote the construction of ecological civilization, protect, construct and rationally utilize Bayinbuluke grassland according to law, these Regulations are formulated in accordance with the Grassland Law of People's Republic of China (PRC) and relevant laws and regulations, combined with the actual situation of Bayinbuluke Mongolian Autonomous Prefecture (hereinafter referred to as the Autonomous Prefecture). Article 2 Bayinbuluke Grassland as mentioned in these Regulations refers to the natural grassland and artificial grassland in Bayinbuluke area of Autonomous Prefecture and Jingxian County.

All units and individuals engaged in grassland ecological protection, construction and utilization in Bayinbuluke grassland shall abide by relevant laws, regulations and these regulations. Article 3 Autonomous Prefecture adheres to the policy of scientific planning, comprehensive protection, key construction and rational utilization of Bayinbuluke grassland, implements comprehensive management, implements the system of balancing grass and livestock, and adopts measures such as herdsmen's settlement, ecological migration, grazing prohibition and rotation, so as to gradually restore and improve the ecological functions of grassland such as water conservation, soil and water conservation, windbreak and sand fixation, and climate regulation. Article 4 Autonomous Prefecture People's Government shall incorporate the protection, construction and utilization of Bayinbuluke grassland into the national economic and social development plan, and the funds for Bayinbuluke grassland protection, grassland fire prevention and grassland biological disaster prevention and control shall be included in the fiscal budget at the corresponding level. Article 5 Evaluate the economic construction and resource development of Bayinbuluke grassland, implement the system that whoever develops will protect, whoever benefits will compensate and whoever pollutes will destroy and restore, and coordinate ecological benefits, economic benefits and social benefits. Article 6 The development, utilization, protection and management of water resources in Bayinbuluke grassland shall adhere to the principle of combining economic development with grassland ecological protection, and coordinate domestic, production and ecological water use. Seventh Autonomous Prefecture, the people's Government of Hejing County grassland administrative departments responsible for the management of Bayinbuluke grassland. The specific work shall be the responsibility of the grassland supervision and management institutions in the Autonomous Prefecture and Jingxian County.

The relevant counties, cities and regiments should sign an agreement with the people's government of Hejing County to use the small Yulides grassland.

According to the needs of Bayinbuluke grassland protection, construction and management, grassland supervision and management institutions can be equipped with an appropriate number of full-time grassland supervisors and voluntary grassland supervisors.

Township (town) people's governments shall strengthen supervision and inspection of grassland protection, construction and utilization within their respective administrative areas, and may set up full-time or part-time personnel to be responsible for specific supervision and inspection work. Eighth grassland supervision and management institutions shall perform the following duties:

(a) to publicize and implement the relevant laws and regulations of the state, and investigate and deal with cases of grassland violations according to law;

(two) to participate in the mediation of grassland compensation contract and grassland ownership disputes, and to deal with matters related to grassland adjustment and use;

(3) Handling the specific matters of requisition and occupation of grasslands according to law, and cooperating with relevant departments to handle the examination and approval matters such as mining, quarrying, gold mining, medicine collection, sand digging, earth borrowing, exploration, road construction and engineering construction on grasslands;

(four) approved grassland livestock carrying capacity, supervision and inspection of the balance of grass and livestock, grazing prohibition and rotation;

(five) to protect and manage wild medicinal (economic) plants in grassland according to law;

(six) responsible for grassland fire prevention work;

(seven) the collection of grassland compensation fees, resource fees, resettlement subsidies for herders and all kinds of confiscation of grassland destruction;

(eight) other duties entrusted by laws, regulations or the people's government. Ninth land resources, forestry, agriculture, water conservancy, environmental protection, tourism and other relevant departments should do a good job in grassland protection and comprehensive management according to their respective responsibilities. Article 10 The people's governments of Hejing Autonomous Prefecture and County shall carry out long-term, continuous and real-time monitoring of rainfall, snowfall and snow cover in Bayinbuluke grassland through meteorological satellite remote sensing and rain radar monitoring technology, and timely and appropriately carry out weather modification to increase rainfall and snow in areas with severe grassland drought. Article 11 The people's government of Hejing County shall, according to law, determine the grasslands owned by the state on Bayinbuluke Grassland for use by units owned by the whole people and collective economic organizations. Grassland owned by the whole people or units owned by collective economic organizations may be contracted to households or joint households by herders within collective economic organizations in accordance with relevant state regulations.

When contracting grasslands, a contract shall be signed to clarify the rights and obligations of the employer and the contractor. Grassland contract period is 30 to 50 years. Twelfth registered grassland use rights and contractual management rights are protected by law, and no unit or individual may infringe upon them. Grassland that has already handled the ownership certificate shall not issue other ownership certificates.

The right to contracted management of grasslands can be transferred in accordance with the principle of equal consultation, voluntary compensation and unchanged animal husbandry use, and implemented in accordance with the provisions of the Measures for the Implementation of the Grassland Law of People's Republic of China (PRC) in Xinjiang Uygur Autonomous Region.

Take subcontracting, leasing, exchange and other means of circulation, the parties shall file with the employer and the county grassland supervision and management institutions. The transfer shall be approved by the employer, and the employer shall report to the grassland supervision and management institution at the county level.

Small pieces of natural grassland borrowed by relevant counties, cities and regiments shall not be circulated. Thirteenth disputes between individuals, between individuals and units, between units of grassland use rights, by the parties in line with the principle of mutual understanding and mutual accommodation, is conducive to unity and development of production; If negotiation fails, it shall be handled by the township (town) people's government, Jingxian county people's government and autonomous prefecture people's government; If a party refuses to accept it, he may bring a lawsuit to the people's court according to law.

Before the dispute over grassland ownership is resolved, no party may change the status quo of grassland. No party shall occupy the grassland, destroy the grassland and its ancillary facilities under any pretext, and shall not dismantle or move the inherent boundary markers on the grassland.
