The implementation of the rural minimum living security system should follow the following principles:

Self-owned housing or living in other people's housing, all compensation income can be calculated for a fixed number of years, and rural subsistence allowances are not enjoyed within the fixed number of years.

(seven) when calculating the income of the applicant and low-income families, alimony and maintenance expenses, if any, shall be deducted from the applicant's family income; Income from alimony and alimony should be included in the applicant's family income.

Calculation method of alimony, maintenance fee or income:

1. If there is an agreement, award or judgment, it shall be calculated according to the amount of the agreement, award or judgment; If the court provides a certificate of unenforceability, it will not be included in the family income.

2. If there is no agreement, ruling or judgment, and the annual per capita income of the dependents and their families reaches more than twice the local rural minimum living standard, the alimony and alimony shall be calculated according to the following calculation formula.

If the applicant's family has flexible employees, its income shall be determined according to the industry income measurement standard determined by the people's government at the county level; If the income is difficult to identify, it shall be calculated according to the average income of local industries.

(nine) a valid proof of the actual income of the family.

According to the requirements of annual dynamic management, rural subsistence allowances are accepted from June 10 to February 12 every year for centralized examination and approval. Families applying for rural subsistence allowances will enjoy rural subsistence allowances from the following year after being approved.

(II) The application for rural subsistence allowances shall be based on the family, and the head of the household shall submit a written application to the township (town) people's government and sub-district office through the village committee where the household registration is located, fill in the Application Form for Minimum Living Guarantee for Rural Residents in Fujian Province, and provide the following materials or copies according to the actual situation of family members:

Families with rural residents and urban residents living together in rural areas and their per capita annual income is lower than the local rural minimum living standard can apply for rural minimum living standard. * * * Living in a city with a monthly per capita income lower than the local urban minimum living standard, you can apply for urban minimum living standard.

(four) after accepting the application, the villagers' committee shall conduct a household survey on the applicant's family income and living conditions. The results of household survey should be signed by the household survey personnel and the applicant for confirmation.

The villagers' committee shall form a minimal assurance appraisal group to conduct democratic appraisal on the applicant's family situation. The appraisal team consists of villagers' representatives, members of village committees and township (town, street) cadres. The subsistence allowance staff introduced the household survey to the review panel meeting and voted after the review by the review panel members. (five) the township (town) people's government or the street office shall examine the application materials and make audit records. That meet the conditions, signed by the township (town) people's government or street offices and stamped, the application materials submitted to the county civil affairs department for approval; If it does not meet the requirements, it shall notify the applicant in writing and explain the reasons.

(six) the civil affairs department at the county level shall review the materials submitted by the township (town) people's government or the street office, and may conduct spot checks on the applicant when necessary. For families who have been approved to enjoy the rural minimum living allowance, the township (town) people's government or the subdistrict office shall notify the villagers' committee to post a list for publicity again, and the publicity time limit shall not be less than 5 days. (seven) the applicant has any objection to the verification of family income, which can be directly put forward to the township (town) people's government, street offices or county-level civil affairs departments. The township (town) people's government, street offices or county-level civil affairs departments shall complete the verification within 15 working days from the date of receiving the objection, and correct it in time if the situation is true. The verification results shall be reported to the applicant in writing in a timely manner.

If the applicant disagrees with the preliminary results of the village committee, he may apply directly to the people's government of a township (town) or the subdistrict office, and the low-income staff of the township (town) people's government or the subdistrict office will conduct a household survey again. If it meets the requirements after examination, it will be publicized again. After review, it is still considered that it does not meet the minimum living conditions, or there are still objections to the second publicity and it is verified that it does not meet the rural minimum living conditions. The township (town) people's government or the subdistrict office shall inform the applicant and explain the reasons.

Seven, rural residents object management

County-level civil affairs departments and township (town) people's governments or sub-district offices and villagers' committees shall, in accordance with the requirements of one household and one file, establish minimum living guarantee family files and set up special counters for preservation and management.

The low-income files kept by the civil affairs departments at the county level include the Application Form for Low-income Objects, the Investigation and Approval Form, the Adjustment Form of the Supplementary Amount and the Distribution List; The subsistence allowances kept by the township (town) people's government or street offices include the assessment roster, assessment records and distribution roster; The subsistence allowances kept by the village committee include the minutes of the review team meeting, the issuance of the roster, and the publicity roster.

Eight, the rural minimum living security fund management

(a) the sources of rural subsistence allowances include.

5. Other funds.

Civil affairs departments at the county level shall, in accordance with the provisions, submit the use of rural subsistence allowances to the financial department, prepare the year-end final accounts, and submit them to the financial department at the same level for review.

Business funds are mainly used for subsistence allowances verification, filing, training, information system construction and daily management of subsistence allowances.

Nine. Supervision and inspection of rural subsistence allowances

(a) civil affairs departments at all levels should establish and improve the publicity system of subsistence allowances, and announce the subsistence allowances policy, subsistence allowances standards, application approval procedures, subsistence allowances, subsistence allowances, and other objects to the public through various news media, public places, public affairs columns, and publicity columns, and accept social supervision.

(two) the civil affairs departments at all levels should set up a suggestion box and telephone consultation and complaint, and accept the consultation, complaint and report of residents. Complaints and reports to the masses should be registered one by one, investigated and handled in time, and fed back to relevant personnel.

(three) civil affairs departments at all levels should strengthen the management of rural subsistence allowances. Finance, auditing, supervision and other departments should track and audit the use of rural subsistence allowances.

Ten, this specification shall come into force as of the date of promulgation.

The Civil Affairs Department of Fujian Province is responsible for the interpretation of this specification. "Fujian Province, the implementation of the minimum living security system for rural residents" (No.32 [2004] of nine), "Fujian Province, the minimum living security fund management Interim Measures" (No.9 [2004] of the agency) is inconsistent with this specification, this specification shall prevail. All localities can formulate specific implementation opinions according to this specification and local conditions, and implement them after being approved by the people's government at the same level.
