The People's Republic of China and the Kingdom of Thailand (hereinafter referred to as the "Contracting Parties"), on the basis of mutual respect for sovereignty, equality and mutual benefit, and in order to promote effective cooperation between the two countries in the punishment of crimes, conclude this Agreement Extradition Treaty, and has reached an agreement as follows:
The Contracting Parties are obliged, in accordance with the provisions of this Treaty, to extradite to each other persons found in the territory of one Contracting Party and prosecuted in the territory of the other Contracting Party for the purposes of extraditable offenses. It institutes proceedings, conducts trials or carries out sentences.
1. For the purpose of this Treaty, extraditable offenses refer to offenses punishable by imprisonment for more than one year or other forms of detention or any heavier penalty under the laws of both Contracting Parties.
2. If a person to whom an extradition request relates is sentenced to imprisonment or other forms of detention by a court of the requesting Party for any extraditable offense, the extradition request may be made only if the outstanding sentence of the sentence is at least six months. extradited.
3. For the purpose of this Article, when deciding whether a certain crime constitutes a crime under the laws of both Contracting Parties, it shall not be based on whether the laws of both Contracting Parties classify the conduct constituting the crime into the same crime category or use affected by the same crime.
4. When extraditing a person requested for an extraditable crime, if the extradition request also involves other crimes, as long as they meet the penalties or other forms specified in paragraphs 1 and 2 of this article, The person may be extradited for these offences, subject to all conditions other than the period of detention.
Extradition shall not be granted in accordance with this Treaty under any of the following circumstances:
(1) The requested party believes that the crime involved in the extradition request submitted by the requesting party is a political crime, However, political crimes shall not include murder or attempted murder of the head of state, head of government or their family members;
(2) The requested party has sufficient grounds to believe that the request for extradition made by the requesting party is intended to harm the person being requested. Initiating criminal proceedings or executing penalties because of race, religion, nationality, political opinions, etc., or the status of the person being requested to extradite in the judicial process will be harmed due to the above reasons;
(3) Extradition The crime involved in the request is only a crime stipulated in the military regulations of the requesting Party and does not constitute a crime according to the ordinary criminal law of that Party;
(4) According to the laws of either Contracting Party, including its laws on prescription, The crime involved in the extradition is no longer subject to prosecution or execution of penalties;
(5) Before submitting the extradition request, the requested party has made a judgment against the person requested for extradition for the same crime.
