Detailed rules for the implementation of land acquisition compensation and basic living security for landless farmers in Suqian City

Su Fa [2006] No.29 Article 1 In order to protect the legitimate rights and interests of land-expropriated farmers and rural collective economic organizations, ensure the basic livelihood of land-expropriated farmers, and strengthen the management of land expropriation compensation and basic livelihood guarantee resettlement, these detailed rules are formulated in accordance with the provisions of the Regulations on Land Administration in Jiangsu Province, the Measures for Land Expropriation Compensation and Basic Livelihood Guarantee for Land-expropriated Farmers in Jiangsu Province (Order No.26 of Jiangsu Provincial People's Government) and other laws, regulations and rules, and in combination with the actual situation of this Municipality.

Article 2 The term "compensation for land expropriation and basic livelihood guarantee for landless peasants" as mentioned in these Detailed Rules refers to the act of the state to compensate landless peasants and rural collective economic organizations according to law after the land collectively owned by peasants is expropriated, and to establish a basic livelihood guarantee system for landless peasants to ensure their basic livelihood.

The term "landless peasants" as mentioned in these Detailed Rules refers to the people who need to be resettled from the members of the collective economic organization after the land collectively owned by peasants is expropriated.

Article 3 These Detailed Rules shall apply to the compensation for land expropriation and the basic living guarantee for landless farmers within the administrative area of this Municipality.

National and provincial key projects land acquisition compensation standards and resettlement measures, the State Council and the provincial government have other provisions, from its provisions.

Within the scope of urban planning and construction land in cities and counties, the villagers' groups whose per capita arable land was less than 0. 1 mu before the implementation of these rules, after being revoked with the approval of law, the original rural residents turned into urban residents and were included in the urban social security system according to the regulations, these rules are not applicable.

Article 4 The people's governments of cities, counties and districts shall be responsible for the compensation for land expropriation and the basic livelihood guarantee for landless farmers. Land administrative departments shall be specifically responsible for the payment of land acquisition compensation and land acquisition compensation and resettlement fees; The labor and social security departments are specifically responsible for the issuance and management of the basic living security funds for landless farmers, and the specific work shall be handled by the agricultural insurance agencies of the labor and social security departments at all levels; The financial department is specifically responsible for the management of the basic living security funds for landless farmers; The audit department shall strengthen the audit and supervision of the compensation funds for land acquisition and the basic living security funds for land-expropriated farmers according to law; Supervision, public security and other departments shall, in accordance with their respective responsibilities, cooperate with relevant work.

Article 5 Sucheng District of this Municipality shall be implemented in accordance with the compensation standards for land acquisition in three types of areas; Other counties and districts shall be subject to the compensation standards for land acquisition in the four districts.

The minimum standards for the average annual output value of cultivated land in the first three years in counties and districts of this city are: 2 1.000 yuan/hectare (1.400 yuan/mu) in Class III areas and 1.800 yuan/hectare (1.200 yuan/mu) in Class IV areas.

Sixth land acquisition compensation and resettlement costs, including land compensation, resettlement subsidies, ground attachments and young crops compensation.

Seventh land compensation fees according to the following provisions:

(1) Expropriation of cultivated land (regardless of grain, cotton and vegetable fields, the same below) shall be calculated at 10 times of the average annual output value of the cultivated land in the three years before expropriation.

(two) the collection of intensive fish ponds (including special aquaculture) is calculated at 10 times of the average annual output value of cultivated land in the first three years; Collection of ordinary fish ponds, calculated at 6 times the average annual output value of cultivated land in the first 3 years; If other aquaculture water surface is levied, it shall be calculated according to 4 times of the average annual output value of cultivated land in the first 3 years. See annex 1 for the specifications and standards of aquaculture water surfaces such as intensive fish ponds and ordinary fish ponds.

(three) the expropriation of orchards or forest land is calculated at 8 times the average annual output value of cultivated land in the first 3 years.

(four) the expropriation of other agricultural land, calculated at 6 times the average annual output value of the cultivated land in the first three years.

(five) the expropriation of unused land is calculated at 3 times the average annual output value of the cultivated land in the first 3 years.

(six) the expropriation of non-agricultural construction land collectively owned by farmers is calculated at 6 times the average annual output value of the cultivated land in the first three years. Scattered planting of less than 0.6 mu in the residential area is regarded as non-agricultural construction land.

Eighth resettlement subsidies in accordance with the following provisions:

(a) land acquisition and resettlement subsidies are calculated according to the number of landless farmers who need to be resettled. The resettlement subsidy standard for each landless farmer who needs to be resettled is 13000 yuan in the third category area and 1 1000 yuan in the fourth category area.

(two) the number of landless farmers who need to be resettled, and the number of expropriated cultivated land is calculated by dividing the number of expropriated cultivated land by the per capita cultivated land of the expropriated unit before land acquisition; If agricultural land other than cultivated land is expropriated, the number of landless farmers who need to be resettled shall be calculated according to the total land compensation fee for this agricultural land divided by 70% of the local per capita resettlement subsidy.

(three) the expropriation of unused land and non-agricultural construction land owned by farmers' collectives, without paying resettlement subsidies.

(four) the land that has been requisitioned before is no longer included in the calculation of per capita cultivated land area before land acquisition; During this land acquisition period, the land-expropriated farmers who have been given resettlement compensation are no longer included in the number of land-expropriated farmers.

Ninth young crops and ground attachments compensation according to the following provisions:

(a) compensation for young crops is generally calculated according to the output value of crops in one season, and those that can be harvested as scheduled will not be compensated. The specific compensation standards shall be implemented according to the standards of 700 yuan per mu in the three types of areas and 600 yuan per mu in the four types of areas.

(2) transplanting seedlings, flowers, trees, etc. , pay the transplant fee; If it cannot be transplanted, it shall be given reasonable compensation. See Annexes 2, 3 and 4 for specific compensation standards; See Annex 5 for compensation fees for other ground attachments.

(three) farmland water conservancy facilities, electricity, broadcasting, communication facilities and other attachments, in accordance with the principle of equivalent substitution to pay relocation fees or compensation fees. The roads, bridges, culverts, pipe networks and other facilities raised by farmers belong to the interior of the village, and have been included in the rating and comprehensive evaluation of the demolished houses, and no further compensation will be made; Outside the village, according to the actual situation of compensation.

(four) housing and other buildings (structures) of the demolition compensation and resettlement according to the relevant provisions of the city and county.

(5) The young crops, other attachments, houses and other buildings (structures) planted after the investigation of land requisition will not be compensated, and will be demolished by the owners themselves.

Article 11 The land administrative department of the people's government of the city or county shall, within 3 months from the date of approval of the land requisition compensation and resettlement plan, transfer the land requisition compensation and resettlement expenses to the special account of the financial department, and the financial department will directly pay the land requisition compensation and resettlement expenses of the landless farmers who have not entered the basic living guarantee and the living allowance of people under the age of 16 to individuals with bank cards; Not less than 70% of the compensation for agricultural land and the resettlement subsidies for land-expropriated farmers that are all included in the basic living security are included in the financial accounts of the basic living security funds for land-expropriated farmers set up by the financial departments at the same level in the bank; Pay compensation fees for ground attachments and young crops and surplus land to rural collective economic organizations, and rural collective economic organizations will pay compensation fees for ground attachments and young crops to their owners.

Rural collective organizations and their members have the right to refuse to pay the land expropriation compensation and resettlement fees if they are not fully paid; Land acquisition compensation and resettlement subsidies in full, the landless rural collective economic organizations and their members shall not delay the delivery of land.

Twelfth land compensation fees paid to rural collective economic organizations into the special fund account of the village collective economic organizations, by the township rural economic service center is responsible for the management. It must be used to solve the living problems of land-expropriated farmers left over from history, develop the production and public welfare undertakings of rural collective economic organizations, and must not be used for other purposes.

Article 13 The county and district people's governments shall set up funds to guarantee the basic livelihood of landless peasants, which shall be included in the management of special financial accounts and used exclusively for the basic livelihood guarantee of landless peasants.

Sources of basic living security funds for landless farmers include:

(a) not less than 70% of the land compensation fee for agricultural land and all resettlement subsidies.

(two) the part of the county and district people's governments extracted from the paid land use income such as land transfer fees. The extraction standard, calculated according to the newly requisitioned land area, is not less than 9,000 yuan per mu in Sucheng District and not less than 8,000 yuan per mu in other counties.

1. If the land is provided in a paid way such as transfer, it shall be paid by the municipal and county finance from the transfer income;

2. Land supply by means of allocation shall be included in the project cost.

(three) the interest and value-added income of the basic living security funds for landless farmers.

(four) other funds that can be used for the basic living security of landless farmers.

The basic living security funds are insufficient to pay, and the financial department at the same level is responsible for solving it.

Fourteenth landless farmers' basic living security fund account consists of landless farmers' basic living security personal account and social pooling account.

Resettlement subsidies and land compensation fees for agricultural land of not less than 70% are included in personal accounts. If a person who implements basic living security dies, the balance of principal and interest in his personal account can be inherited according to law.

The living allowance and pension of the landless peasants who implement the basic living guarantee for the landless peasants are first paid from their personal accounts; If the individual account is insufficient to pay, it shall be paid from the social pooling account.

Article 15 The financial departments of the county and district people's governments shall, according to the payment plan of the basic living guarantee funds for landless peasants, regularly transfer the basic living guarantee funds for landless peasants into the expenditure households of the basic living guarantee funds for landless peasants established by the labor and social security departments in the bank to ensure the timely and full payment of the basic living guarantee funds for landless peasants.

Sixteenth county, district rural collective economic organizations members database established by the county, district agriculture and industry office. The members of the database are listed by the rural collective economic organizations and reported to the township (town) government, the Agriculture and Industry Office and the family planning department for examination and determination, which serves as the basis for the labor and social security department to issue basic living allowances and pensions for landless farmers.

(a) the following persons can be included in the database of members of rural collective economic organizations:

1. The permanent population with permanent residence in rural collective economic organizations that enjoy the right to contracted management of rural land and undertake corresponding obligations according to law;

2. College students and active duty conscripts (excluding active duty officers) who meet the requirements specified in item 1 before enlisting;

3. Prisoners and reeducation-through-labor who meet the requirements specified in item 1 before serving their sentences and reeducation through labor;

4. Persons born in the plan after the second round of land contracting.

(two) the following persons are not included in the database of members of rural collective economic organizations:

1. Persons who have been resettled after the previous land acquisition;

2 accounts in rural collective economic organizations (including previously contracted land) in the state organs or institutions;

3. The original registered permanent residence was in a rural collective economic organization and contracted land management, and now he is dead;

4. Although the registered permanent residence is in the rural collective economic organization, it belongs to the personnel who have been approved by the relevant departments to retire and resign and receive pension or endowment insurance (including the retired and resigned personnel who have returned home because of their children's replacement).

5. Although the household registration is in rural collective economic organizations, the permanent population does not enjoy the right to contracted management of rural land.

Seventeenth to the date of approval of land acquisition compensation and resettlement program as the boundary, the landless farmers will be divided into the following four age groups:

(1) the first age group1under 6 years old;

(2) In the second age group, women are 16 to 45 years old and men are 16 to 50 years old;

(3) In the third age group, women are 45 to 55 years old and men are 50 to 60 years old;

(four) the fourth age group (pension age) women over 55 years old, men over 60 years old.

The "above" mentioned in the preceding paragraph includes this number.

Article 18 The peasants whose land has been expropriated shall be the children of the members of the rural collective economic organizations that owned the land before the land expropriation, who have the right to contracted management of the land and undertake agricultural obligations, and the original land contractor shall have the preemptive right.

The proportion of land-expropriated farmers of all ages should be the same as that of land-expropriated units of all ages before land expropriation. Resettleed farmers do not enjoy the right to contract rural land within the period when there is no land to contract within the village collective economic organization.

The list of farmers whose land has been expropriated has been put forward with the consent of more than half of the members of the rural collective economic organizations whose land has been expropriated, and after publicity, it shall be reported to the township people's government (street office) for review and determined by the county-level people's government. If the list cannot be determined in time, it will not affect the land delivery.

Nineteenth people in the first age group receive a one-time living allowance of 4000 yuan and 3000 yuan respectively according to the three or four categories of areas; After receiving a one-time living allowance, people of this age group will no longer be included in the scope of basic living security stipulated in these rules. After reaching the age of employment, it will be managed according to the new labor force in cities and towns.

Twentieth people of the second, third and fourth age groups can choose whether to participate in the basic living security. County and District People's governments shall take active measures to encourage and support landless farmers to participate in the basic living security.

Land-expropriated farmers who implement basic living security shall implement different security standards according to different regions and different age groups:

(1) People in the second age group will receive monthly living allowance from the month when the basic living guarantee is implemented (the month when the rural collective economic organization delivers the land), with a term of 2 years. Monthly living allowance standard: Grade III District 120 yuan, Grade IV District 100 Yuan; Reach the age of receiving a pension and receive a monthly pension.

(2) People in the third age group will receive a monthly living allowance from the month when the basic living guarantee is implemented (the month when the rural collective economic organizations deliver the land). The standard of receiving monthly living allowance, third-class district 100 yuan, fourth-class district 80 yuan; When you reach the old-age age, you receive a monthly pension.

(3) People in the fourth age group will receive a monthly pension from the month when the rural collective economic organization delivers the land.

See Annex 6 for the standards of "receiving monthly living allowance" and "receiving monthly pension" in the preceding paragraph.

Land-expropriated farmers who did not participate in the basic living security shall be registered by the collective economic organizations to which the land-expropriated farmers belong and reported to the labor and social security departments for examination and filing. Pay compensation and resettlement fees for land acquisition according to Article 1 1.

Twenty-first landless farmers to implement the basic living security of landless farmers, basic living security funds by the labor and social security departments of agricultural insurance agencies to the community on a quarterly basis. In case of special circumstances such as land-expropriated farmers' household registration moving out of the security co-ordination area or suffering from serious illness, they can receive personal account funds in one lump sum or in batches. If I receive personal account funds in one time or in batches, I shall apply to the county labor and social security department and sign an agreement. After the land-expropriated farmers receive personal account funds at one time or in batches, they will terminate the basic living security relationship and no longer enjoy living allowances or pensions.

The basic living security funds for landless farmers and their value-added parts, as well as the pensions and living allowances received by those who implement basic living security, shall be exempted from taxes and fees in accordance with the relevant provisions of the state.

Article 22 If the landless peasants who have implemented the basic living guarantee for landless peasants reach the old-age age and enjoy the pension insurance for employees of urban enterprises, the pension insurance for institutions or statutory retirement benefits, they will no longer enjoy the social co-ordination treatment for the basic living guarantee for landless peasants, but they can receive the balance of funds in their personal accounts at one time.

Twenty-third governments at all levels and relevant departments should create conditions for the employment of landless peasants and support the employment of landless peasants with employment difficulties. Land-lost farmers who have the ability to work and employment requirements within the legal working age but are unable to find employment are regarded as registered unemployed people in cities and towns, and employment registration certificates are issued. With the employment registration certificates, they can enjoy employment support policies for registered unemployed people in cities and towns. Land-expropriated farmers who find it difficult to find employment within the urban planning area (referring to the community neighborhood committees that have withdrawn their villages to build their homes) are regarded as laid-off workers in cities and towns, and they are issued with a "Re-employment Concession Card", by which they can enjoy the re-employment support policies for laid-off workers.

Twenty-fourth basic living security funds are not paid in full and on time, and the administrative responsibility of the relevant personnel shall be investigated.

Article 25 State functionaries who neglect their duties, abuse their powers or engage in malpractices for personal gain in land acquisition compensation and the work of ensuring the basic livelihood of landless farmers shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

By land acquisition units or relevant departments to resort to deceit, impersonator, interception, misappropriation of land acquisition compensation and resettlement fees, by the land administrative departments of the people's governments at or above the county level shall be ordered to make corrections, and the administrative responsibility of the person in charge and other directly responsible personnel shall be investigated according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Obstruct, destroy the land acquisition work, hinder the staff from performing official duties according to law, and be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-sixth before the implementation of these rules, the land acquisition plan has been approved by the people's government of the State Council and the province, and the land acquisition compensation and resettlement will still be given according to the approved land acquisition plan.

Twenty-seventh before the implementation of these rules, the basic living security for landless farmers has been established in accordance with the regulations, and the basic living security standard is lower than the standard stipulated in these rules. From the month when these rules are implemented, the standards stipulated in these rules shall be implemented.

Article 28 These Rules shall come into force as of April 6, 2006. Counties can be combined with the actual situation, with reference to the detailed rules for the implementation of the specific implementation plan.
