Matters needing attention in changing residence in Spain
The renewal of residence of Spanish immigrants is an application for residence of boss, work, family reunion, student, non-profit and first long-term residence.
60 natural days before the expiration of residence, and 90 natural days after the expiration of residence shall be the term of continued residence. If you stay after expiration, you may be fined.
If the residence permit expires after 90 days, the residence permit will be considered invalid, which means that Spanish immigrants have legally lost their residence status in Spain, and the Immigration Bureau will establish an expulsion file.
When supplementary materials are needed, generally speaking, the Spanish Immigration Bureau will give the applicant 10 working days to make supplementary materials. Some materials, such as double certification, may take a long time to process. For specific supplementary materials, the Immigration Bureau is more flexible, but it is recommended that applicants try their best to complete the materials according to the time specified by the Immigration Bureau.
If the applicant decides not to submit supplementary materials after receiving the letter from the Spanish Immigration Bureau, it means giving up the first application or updating the residence, the corresponding application documents and the applied residence permit.
If the applicant's application for residence permit is rejected, the applicant has the right to apply for an appeal. There are two kinds of appeals. The first is an administrative appeal, which means that government officials who have previously reviewed residence permit applications will be reviewed again.
Generally speaking, there will be reasons for refusal in the rejection letter. You have 1 month to apply for an appeal, and the applicant needs to submit meaningful and true materials for his appeal according to the reasons for rejection. The other is administrative judicial appeal, that is to say, suing the administrative department through the court, that is, going to court, usually has two months to appeal, and then you need to wait for the court to schedule and arrange time to go to court.
No matter what kind of appeal, we must submit the appeal request strictly within the prescribed time limit, otherwise it will lead to the rejection of the appeal, which will directly lead to the rejection of the appeal. After that, the applicant will face illegal residence in Spain, and the Immigration Bureau has the right to expel the applicant.
