Wuwei City Regulations on Desertification Prevention and Control

Chapter 1 General Provisions Article 1 is to prevent land desertification, control desertified land, maintain ecological security, and promote sustainable economic and social development. According to the "Law of the People's Republic of China on National Defense and Desertification Control" and "Gansu The province implements the "Measures of the People's Republic of China on National Defense and Desertification Control" and other relevant laws and regulations, and formulates these regulations based on the actual situation of this city. Article 2 These Regulations shall apply to land desertification prevention, desertification land management, utilization and supervision and management activities within the administrative region of this city.

The term "land desertification" as mentioned in these Regulations refers to the process of the expansion of natural deserts and the destruction of vegetation and coverings on sandy soil, resulting in the formation of quicksand and exposed sand, mainly caused by unreasonable human activities.

The desertified land referred to in these regulations includes land that has been desertified and land that has been found to have obvious desertification trends through monitoring. The specific scope is determined by the municipal, county (district) people's governments in accordance with the national and provincial desertification prevention and control plans. Article 3 Desertification prevention and control work shall follow ecological laws, adhere to the concepts of ecological priority and green development, and adhere to the principles of unified planning, classified management, prevention first, protection first, comprehensive management, and rational utilization. Article 4 The municipal and county (district) people's governments shall uniformly lead the work of preventing and controlling desertification within their respective administrative regions. They shall incorporate the work of preventing and controlling desertification into the national economic and social development plans and annual plans, implement a target responsibility system for administrative leadership, and establish Assessment reward and punishment system.

City, county (district) people's governments shall report on desertification prevention and control work to the people's congress at the same level and its standing committee every year. Article 5 The forestry and grassland administrative departments of the municipal and county (district) people’s governments are responsible for organizing, coordinating, guiding, and supervising the prevention and control of desertification within their respective administrative regions.

The administrative departments for development and reform, agriculture and rural areas, water conservancy, natural resources, ecological environment, science and technology, and meteorological authorities of the municipal and county (district) people's governments shall each assume their respective responsibilities in accordance with their departmental responsibilities and division of labor. Work closely together to prevent and control desertification. Article 6 Units and individuals that use land have the obligation to prevent desertification of the land. Units and individuals that use desertified land have the obligation to control the desertified land. No unit, organization or individual may harm the legitimate rights and interests of those engaged in desertification prevention and control. Article 7 Municipal, county (district) people's governments shall encourage and support scientific and technological innovation in desertification prevention and control, research, introduce and promote new technologies and models, and accelerate the cultivation of professional and technical talents in desertification prevention and control. Article 8 Municipal, county (district) people's governments shall adopt various forms to actively carry out publicity and education on desert prevention and control knowledge, enhance citizens' awareness of desert prevention and control, and improve citizens' consciousness of desert prevention and control. Chapter 2 Planning and Management Article 9 The forestry and grassland administrative department of the Municipal People's Government shall, in accordance with the provincial desertification prevention and control plan, work with the administrative departments of development and reform, agriculture and rural areas, water conservancy, natural resources, ecological environment and meteorological authorities to prepare the municipal plan. Desertification prevention and control plans shall be reviewed by the Municipal People's Government and submitted to the Provincial People's Government for approval.

The forestry and grassland administrative department of the people's government of the county (district) where the desertified land is located shall, in accordance with the municipal desertification prevention and control plan, prepare the county (district) desertification prevention and control plan, which shall be reviewed by the county (district) people's government. Report to the Municipal People's Government for approval.

Once the desertification prevention and control plan is approved, no unit or individual may modify or adjust it without authorization. If modifications and adjustments are truly necessary, they must be reported to the original approving authority for approval. Article 10: Desertification prevention and control planning shall be connected with the overall land use planning, water resources planning, environmental protection planning, etc.

The desertification prevention and control plan shall be implemented by the forestry and grassland administrative departments of the municipal and county (district) people’s governments. Article 11 The following behaviors are prohibited within the scope of desertified land:

(1) Cutting and digging shrubs, medicinal materials and other sand-fixing plants;

(2) Grazing;

< p>(3) Burning straw, garbage, forest and grass vegetation;

(4) Other behaviors that damage ecological vegetation. Article 12: Contiguous desertified land that does not have the conditions for treatment during the planning period and is not suitable for development and utilization due to ecological protection needs shall be planned as a closed desertified land protection zone and implemented closed protection.

The scope of the closed protected area shall be determined by the people's government of the county (district) where the closed protected area is located in accordance with the national and provincial desert prevention and control plans, and the four ranges and prohibition regulations of the closed protected area shall be announced.

The people's government of the county (district) where the closed reserve is located shall set up signboards in the closed reserve to clearly indicate the scope, boundaries and protection measures of the closed reserve. Article 13 Unless otherwise stipulated by laws and regulations, logging, woodworking, medicinal collection, grazing, hunting, exploration, reclamation, quarrying, sand dredging, mining and abuse of water resources are prohibited within the scope of the closed desertified land protection zone. All activities that destroy vegetation.

It is prohibited to resettle immigrants within the closed desert protected areas. For farmers and herdsmen within the closed protection areas of desertified land, the county (district) people's government should organize the relocation in a planned manner and properly resettle them. The production and life of the farmers and herdsmen who have not yet moved out shall be properly arranged by the people's government of the county (district) where they are located.

Construction activities such as the construction of railways, highways, and airports are prohibited within the closed desertified land protection zone. If it is really necessary to build, the construction unit shall apply for approval in accordance with the law.

Chapter 3 Land Desertification Prevention Article 14 The forestry and grassland administrative departments of the municipal and county (district) people's governments shall regularly monitor the degree and development trend of land desertification within their respective administrative regions, and the water administrative departments shall regularly monitor the desertification degree and development trends of the land within their respective administrative regions. Monitor the changes and development trends of water resources, and report the monitoring results to the people's government at the same level and the relevant administrative departments at the higher level. The people's government that receives the report shall organize relevant departments to take timely measures to classify and deal with it.
