Measures for Social Stability Risk Assessment in Sichuan Province

Article 1 In order to standardize the risk assessment of social stability and safeguard the fundamental interests of the people, these Measures are formulated in accordance with the relevant provisions of the state and the actual situation of Sichuan Province. Article 2 These Measures shall apply to the social stability risk assessment carried out by local people's governments at all levels and their functional departments or organizations authorized by laws and regulations within the administrative region of this province. Article 3 The term "social stability risk assessment" as mentioned in these Measures refers to the act of identifying, analyzing and preventing existing social stability risk factors before major administrative decisions are made. Article 4 The risk assessment of social stability shall follow the principles of scientificity, legality, openness and fairness, unity of powers and responsibilities, and overall consideration, and be conducted in accordance with the procedures prescribed in these Measures. Article 5 The local people's governments at all levels shall lead and manage the social stability risk assessment within their respective administrative areas, and the relevant decision-making bodies, assessment bodies and implementation bodies shall be responsible for the specific organization and implementation.

(1) The local people's governments at all levels and their functional departments or organizations authorized by laws and regulations that make major administrative decisions are decision-making bodies.

(two) the local people's governments at all levels and their functional departments or organizations authorized by laws and regulations to conduct social stability risk assessment on major administrative decisions are the assessment subjects.

(3) The local people's governments, departments or other organizations that organize the implementation of major administrative decisions are the main bodies of implementation.

The social stability risk assessment guidance and coordination institution at or above the county level is responsible for the comprehensive coordination, supervision and guidance of the social stability risk assessment work in this administrative region. Article 6 The assessment subject is responsible for organizing relevant departments or experts to carry out social stability risk assessment, and may also entrust intermediary agencies to carry out social stability risk assessment, and review the social stability risk assessment report.

Entrust an intermediary organization to carry out social stability risk assessment. The assessment subject shall determine the intermediary organization through competition according to laws, regulations, rules and the relevant provisions of the state and province, sign an entrustment contract for social stability risk assessment according to law, and stipulate the assessment content, procedures, funds and liability for breach of contract. Seventh major administrative decisions, social stability risk assessment funds and assessment funds included in the budget of the relevant departments of the people's government at the same level to be guaranteed. Article 8 The provincial people's government shall establish social stability risk assessment indicators, and the provincial administrative department shall establish the social stability risk assessment indicators of this system according to the social stability risk assessment indicators formulated by the provincial people's government. Ninth provincial price departments shall formulate the guiding standards for social stability risk assessment fees of intermediaries, and incorporate the guiding standards for social stability risk assessment fees into the pricing catalogue of Sichuan Province. Tenth major administrative decisions should be assessed for social stability risk:

(a) major issues such as the restructuring, reorganization, listing, demolition and employee income distribution system of state-owned enterprises (state-owned holding enterprises) involving the diversion of employees or changes in employees' interests; Matters related to the institutional reform of public institutions;

(2) Major adjustments to social insurance systems and social assistance policies involving old-age insurance and medical insurance; Major adjustments have been made to the prices and charging standards of commodities and services such as water, electricity, gas, education, medical care and so on, which are related to the vital interests of the masses;

(three) major policies and reform measures involving rural collective land expropriation, compensation and resettlement and resettlement of landless farmers; Major adjustment of housing security policies involving affordable housing; Major policy adjustments involving urban infrastructure construction, house expropriation and compensation on state-owned land, and residents' resettlement;

(4) Large and medium-sized water conservancy and hydropower projects involve compiling the outline of land acquisition and resettlement planning, compiling resettlement planning and scheme adjustment, organizing water storage acceptance, and major sensitive issues involving a large number of people and related to the vital interests of immigrants;

(five) involving major adjustments in administrative divisions;

(six) construction projects that may cause significant environmental impact or major environmental risks, construction projects that may cause major safety accidents, and important restoration and reconstruction projects after major natural disasters;

(seven) major activities involving a large number of people and strong sensitivity, which may have an impact on social stability;

(eight) other major administrative decisions that involve the vital interests of the masses and may have an impact on social stability. Article 11 Social stability risk assessment shall include legality assessment, rationality assessment, safety assessment, feasibility assessment and controllability assessment.

(a) the legality assessment shall include whether the decision-making subject, decision-making authority, decision-making procedures and decision-making contents comply with laws, regulations, rules and national policies.

(two) the rationality evaluation should include whether the social, economic and ecological benefits of major administrative decisions are in line with the practical interests, long-term interests and legitimate rights and interests of the people.

(three) the safety assessment should include whether there are hidden dangers such as national security and public safety in major administrative decisions.

(four) the feasibility assessment shall include whether the implementation plan, material conditions and timing of major administrative decisions are in line with the interests of regions, industries and people.

(5) Controllability assessment shall include social stability risk factors existing in major administrative decisions and their preventive measures and emergency plans, etc. Article 12 The assessment subject shall carry out social stability risk assessment according to the following procedures:

(a) according to the contents of major administrative decisions, formulate the work plan of social stability risk assessment, and solicit opinions from relevant parties;

(2) According to the work plan of social stability risk assessment, relevant information can be collected by consulting literature, field investigation, questionnaire survey, public opinion survey, forum visit, online public opinion, hearing and publicity;

(3) Identifying and analyzing social stability risk factors according to relevant information, and determining the categories, probabilities and ranges of social stability risk factors;

(four) according to the risk factors affecting social stability to develop preventive measures;

(five) according to the social stability risk assessment indicators and preventive measures to determine the social stability risk level, the risk level is divided into low risk, medium risk and high risk;

(six) according to the risk level of social stability to determine the implementation, suspension of implementation, not to implement the evaluation conclusion;

(seven) the preparation of social stability risk assessment report. The social stability risk assessment report shall include the basic information of major administrative decisions, assessment process and methods, assessment contents, analysis and demonstration, preventive measures, risk levels and assessment conclusions.

Major administrative decisions involving state secrets shall abide by the relevant confidentiality provisions of the state when assessing the risk of social stability.
