The Australian Immigration Bureau made a policy change in the employer-sponsored 186/ 187 visa, that is, it cancelled the requirement that enterprises should operate for at least six months. The relaxation of this policy provides more opportunities for applicants to find jobs suitable for their majors, and also greatly increases the chances of obtaining PR.

The following clauses have been deleted from the latest policy.

According to this policy, the nominating employer must prove that his company has been actively engaged in business for at least six months before submitting the nomination application. If the company has not operated for six months, the nominated employer does not meet the relevant legal requirements of "active operation" ... The company must operate full-time for six months from the date of starting operation to meet the relevant legal requirements of "active operation".

The following clauses have been added to the latest policy.

Start-ups must provide a complete report on their business activities in each quarter from the beginning of the company's operation to the submission of nominations. On the basis of actually operating its business, it will not be regarded as "actively operating" its business until the startup company registers its ABN or ACN.

As a result of this new access policy, if an enterprise has been operating for a long time, but needs to register new ABN and ACN because of the change of owner or enterprise structure, then the enterprise is recognized as a start-up enterprise.

The employer's sponsorship visa application, whether permanent residence or temporary residence, the employer's sponsorship qualification must first be reviewed by the immigration bureau before it can be guaranteed.

Detailed description of employer qualification requirements

1. Enterprises legally operating in Australia;

2. There is no record of violating relevant laws;

3. Have good economic ability;

4. There are records of training expenses for local employees that meet the standards (applicable to RSMS 457 and 186, RSMS 187 RSMS has no training requirements).

5. Hire and ensure the true wishes and needs of overseas employees.

6. Annual salary paid to overseas employees in line with the market salary rate standard (at present, the minimum requirement for a 457 visa is $53,900.00).

Good financial ability means that the guarantee company must submit relevant financial documents to the Immigration Bureau or RCB to prove that the company has sufficient capital reserves and operating ability to pay the salaries of the guarantee employees in the next few years and ensure the existence of the position.

The guarantee company must provide relevant training for local employees (except RSMS 187), and the training fee must reach a certain standard. Local employees refer to Australian permanent visa holders or Australian citizens, and there is no mandatory requirement for the number of local employees. This requirement can also be understood as a kind of protection for local employees by the Australian government.

Another important factor in examining the employer's sponsorship qualification is the real will and demand for nominating overseas employees. For example, it is reasonable to nominate a high-tech chef in the catering business, but it is unreasonable to nominate a marketer. It is also necessary to prove that the nominated overseas employees can really contribute to the company's business development or bring new technologies.

It is particularly worth mentioning that in the process of examining the employer's sponsorship qualification, the state government in remote areas usually considers more angles and factors than the immigration bureau. If the employer's operating time is too short or the skills required for the nominated position are not up to a certain level, the local state government is more inclined to hire and train local employees to alleviate the local employment pressure.

SC 186 and 187 Revision of Entrepreneurship Policy

The policies for sub-categories 186 and 187 related to entrepreneurship have been changed from July 20 14 1 day.

According to the policy, nominators must prove that their enterprises have been actively operating for at least 6 months before submitting their nominations. If the enterprise has not operated for at least 6 months, the nomination does not meet the relevant legal requirements for active operation ... The entity must have been operating for a full 6 months from the time when it actively started operating to meet the requirements for active operation.

The following contents have been added to the latest policy:

Start-ups must provide business activity reports for each complete quarter from the start of operation to the submission of nominations. Except for the actual business, the newly started business will not be determined to have been actively operated until the ABN and/or ACN of the business have been registered.

As a result, if an enterprise has been operating for a long time, but changes its ownership or structure, resulting in the need for a new ABN and ACN, the enterprise is now considered as a start-up.
