Start-ups must provide a complete report on their business activities in each quarter from the beginning of the company's operation to the submission of nominations. On the basis of actually operating its business, it will not be regarded as "actively operating" its business until the startup company registers its ABN or ACN.
As a result of this new access policy, if an enterprise has been operating for a long time, but needs to register new ABN and ACN because of the change of owner or enterprise structure, then the enterprise is recognized as a start-up enterprise.

Detailed description of employer qualification requirements
1. Enterprises legally operating in Australia;

Good financial ability means that the guarantee company must submit relevant financial documents to the Immigration Bureau or RCB to prove that the company has sufficient capital reserves and operating ability to pay the salaries of the guarantee employees in the next few years and ensure the existence of the position.
The guarantee company must provide relevant training for local employees (except RSMS 187), and the training fee must reach a certain standard. Local employees refer to Australian permanent visa holders or Australian citizens, and there is no mandatory requirement for the number of local employees. This requirement can also be understood as a kind of protection for local employees by the Australian government.
Another important factor in examining the employer's sponsorship qualification is the real will and demand for nominating overseas employees.
