Provisions on providing online filing service for cross-border litigants. How to understand Article 8?

1. People's courts provide online filing guidance, inquiry, entrusted video witness, registration and other services for cross-border litigants.

2. The scope of cases providing online filing services for cross-border litigants includes civil and commercial litigation of first instance.

3. People's courts provide online filing service for cross-border litigants through China Mobile Micro Court.

4. If a party to a cross-border lawsuit applies for online filing for the first time, the court of appeal shall first conduct identity verification. Identity verification mainly relies on the national immigration bureau's entry-exit certificate identity authentication platform for online verification; If online verification is not possible, the court of appeal will conduct online manual verification of the identity documents of the parties and the identification materials such as notarization, authentication, forwarding and sending verification.

5. The parties to cross-border litigation shall submit materials to the Court of Appeal for identity verification online.

6. Certified cross-border litigants can apply to the Court of Appeal for online video witness by entrusting mainland lawyers to represent them.

7. When applying for online filing, the parties to cross-border litigation shall submit the complaint, identity certificate and corresponding materials such as notarization, authentication, transmission and verification online.

8. Authorization materials for cross-border litigation parties to entrust agents to conduct litigation.
