Measures for Long-term Residence or Settlement Permits for People from the Mainland Area to Reside in Taiwan Area by Relatives
Article 1
These Measures are based on the Regulations on Relations between People of the Taiwan Area and the Mainland Area (hereinafter referred to as these regulations) are stipulated in Paragraph 9 of Article 17.
Article 2
The competent authority for these regulations is the Ministry of the Interior.
Article 3
If the name used by the applicant in the mainland area is inconsistent with the original household registration in Taiwan, proof should be provided to prove that he is the same person and the name should be registered in the original household registration in Taiwan. Information application; if the person has been declared dead, the application shall be made after the judgment to revoke the death declaration is finalized.
Article 4
The procedures for people from the Mainland Area to apply for dependent residence, long-term residence or settlement in the Taiwan Area are as follows:
1. The applicant is in the Mainland Area Persons: Applications should be made to the institutions specified in Paragraph 1 of Article 4 of this Regulation or to branches established in the mainland area by civil organizations entrusted in accordance with Paragraph 2 of this Regulation, for transfer to the Immigration and Exit Bureau of the Police Department of the Ministry of the Interior (hereinafter referred to as the Immigration Bureau). If there is no branch, the relative or spouse within the second degree of affinity or other entrusted immigration business agency or Category A or above travel agency in Taiwan should apply to the Immigration Bureau on his or her behalf.
2. Applicants in Hong Kong or Macau: Applications should be made to institutions established or designated by the Executive Yuan in Hong Kong or Macau or to non-governmental organizations entrusted by the Executive Yuan. The application will be reviewed and transferred by personnel stationed by the Immigration Bureau.
3. Applicants in overseas areas should apply to our embassies, consulates, representative offices, offices or other authorized institutions of the Ministry of Foreign Affairs (hereinafter referred to as the overseas missions). If the Immigration Administration dispatches review personnel to the overseas mission, the review will be done by them; if no review personnel are assigned, the review will be done by personnel assigned by the overseas mission, and then the application will be transferred to the Immigration Bureau for processing.
4. Applicants in Taiwan: The applicant should apply directly to the Immigration Bureau by himself or by his or her second-degree relative, spouse, or authorized immigration business agency or Category A or above travel agency in Taiwan. However, those who apply for long-term residence or settlement in accordance with the provisions of Paragraph 3 and Paragraph 5 of Article 17 of this Regulation shall apply in person at the Immigration Bureau.
If the applicant in the first paragraph of the preceding paragraph does not have any relatives or spouses within the first degree of affinity in Taiwan, or if he or she has suffered domestic violence and obtained a general protection order issued by the court, he or she may entrust another person or immigration agency Or a travel agency of Category A or above can apply on your behalf.
Article 5
For people from the Mainland Area to apply for dependent residence, long-term residence or settlement in the Taiwan Area, the dependent person or the second relative with a household registration in the Taiwan Area shall A relative shall be the guarantor and issue a letter of guarantee.
If there is no dependent or second-degree relative in Taiwan, or if the guarantor is unable to fulfill the guarantor responsibility for some reason, and cannot find a guarantor as mentioned in the preceding paragraph, he or she may find a guarantor who has a household registration and a certain residence in Taiwan. A citizen with a legitimate occupation shall serve as the guarantor, and the number of guarantors shall not exceed three persons each year.
The guarantor of the first two items should hold the guarantee letter and go to the police agency (institution) at the place of residence to handle the guarantee procedures in person. However, this does not apply if the guarantor prepares all the required documents and goes to the Immigration Bureau in person to complete the guarantee procedures, or if the guarantor serves a government agency, public or private school, or public institution, and his or her guarantee letter is stamped with the seal of the service agency (institution) or school. .
People in Mainland China who have suffered domestic violence and have obtained a general protection order issued by the court and have minor children in Taiwan cannot apply for dependent residence or long-term residence in Taiwan. When providing a guarantor in Paragraph 2, the local social affairs or police agency (institution) may find the guarantor in Paragraph 1 and Paragraph 2 on your behalf, or directly act as its guarantor, and issue a letter of guarantee stamped with the seal of the agency (institution). and The relationship with the guaranteed person is genuine and there is no hypocrisy or untruth.
2. Responsible for the life of the guaranteed person after entry.
3. If the guaranteed person is required to be forced to leave the country according to law, he should assist the relevant authorities to force the guaranteed person to leave the country and bear the expenses required for the forced departure.
If the guaranteed person's guarantor is unable to bear the guarantee responsibility for some reason before the household registration is completed, the guaranteed person shall change the guarantor within one month. If the guaranteed person suffers domestic violence from the guarantor and obtains a temporary or ordinary protection order issued by the court, the original guarantor shall not apply for replacement and must still bear the guarantor liability.
Local social affairs or police agencies (institutions) serve as guarantors. When the guaranteed person is required to be forced to leave the country according to law, they should assist the relevant agencies in forcing him or her to leave the country.
If a guarantor fails to perform the guarantee responsibilities specified in Paragraph 1 or makes a false guarantee, the competent authority may, depending on the seriousness of the case, refuse to accept the guarantor as a guarantor within three to five years.
Article 7
If there is an amount limit for applications for dependent residence, long-term residence or settlement in Taiwan, and the amount is calculated on an annual basis, it may be distributed evenly on a monthly basis, and Numbers will be issued according to the order in which the application has passed the review; if there are circumstances in which permission is not granted, the number will be supplemented in sequence. The unused amount of the current month can be used in the next month, and the amount of the next month cannot be used in advance; its annual balance cannot be transferred to other categories for use.
For the application cases mentioned in the preceding paragraph, the competent authority may set another basis for the amount of points to be awarded.
Article 8
The competent authority shall conduct an interview (interview) with the applicant or dependent in accordance with relevant laws and regulations when accepting the application case, at the time of entry, or at a selected date.
Article 9
People from the Mainland Area who are permitted to reside in Taiwan as dependents, long-term residents or settlers shall be issued with entry documents, which shall be delivered by the Immigration Bureau to the applicants and immigrants. Business institutions, Category A or above travel agencies or transfer units forward the applicant.
People from the Mainland Area who have reached the limit of dependent residence or long-term residence in Taiwan during their legal stay or residence in Taiwan may return their entry and exit documents and exchange them for dependent residence or long-term residence documents. The validity period will be from Counting from the date of issuance; for those who have reached the settlement amount, a mainland passport or pass (hereinafter referred to as a mainland passport) will be required to go through the settlement procedures.
