Regulations of Xizang Autonomous Region Municipality on the Management of Floating Population Services (revised on 20 19)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of the floating population, strengthen the service management of the floating population, maintain social stability and promote coordinated economic and social development, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of the autonomous region. Article 2 These Regulations shall apply to the service management and rights protection of the floating population within the administrative area of this autonomous region.

"Floating population" as mentioned in these Regulations refers to citizens who leave their domicile to enter the autonomous region and live across counties (districts) within the administrative region of the autonomous region. However, people living in different places between districts within the municipal area are excluded. Article 3 The service management of floating population shall adhere to the principle of people-oriented, fair treatment, optimized service, reasonable guidance, management according to law and based on residence. The floating population can enjoy the basic public services and conveniences stipulated by the state and the autonomous region with their residence permits. Article 6 The people's governments at or above the county level shall, according to the needs of the service management of the floating population, set up a coordinating body to be responsible for organizing, coordinating, guiding, supervising and inspecting the relevant departments to carry out the service management of the floating population. Seventh relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, implement the management of floating population services.

Trade unions, the Communist Youth League, women's federations and other people's organizations shall, according to their respective functions and duties, assist relevant departments to carry out the service management of floating population. Article 8 Township (town) people's governments and sub-district offices shall, according to their duties, implement the service management of floating population within their respective jurisdictions.

Village (neighborhood) committees, units and individuals shall assist relevant departments to carry out the service management of floating population. Ninth people's governments at or above the prefecture level shall, in combination with the needs of floating population service management, establish and improve the comprehensive information system of floating population, and gradually realize resource integration and information sharing. Tenth registered population and floating population should respect each other's customs and religious beliefs, and consciously safeguard national unity and national unity. Eleventh people's governments at all levels or relevant departments shall commend and reward the units and individuals that have made remarkable achievements in the service management of floating population and the floating population that have made outstanding contributions to local social stability and economic and social development. Chapter II Basic Public Services Article 12 The people's governments at or above the county level shall establish and improve the mechanism for safeguarding the rights and interests of the floating population, the social security system and the public service mechanism, so as to safeguard the legitimate rights and interests of the floating population in the preparation of urban and rural planning, the construction of public facilities, and the formulation of public policies such as employment, vocational training, social insurance, compulsory education, legal aid, disease prevention and control, maternal and child health care and family planning, and provide corresponding services. Article 13 The administrative department of human resources and social security shall strengthen the employment, social insurance and labor rights protection services of floating population, and provide public employment services such as unemployment registration, employment training, vocational guidance and employment introduction, social insurance registration, payment declaration, treatment payment and social insurance relationship transfer. Article 14 The administrative department of education shall strengthen the management of compulsory education for school-age children and adolescents among the floating population, guide and urge primary and secondary schools to do a good job in enrolling children of the floating population, and ensure that children of the floating population enjoy the right to receive compulsory education on an equal footing with the registered population in their current residence.

The floating population with household registration in the autonomous region shall enjoy equal preferential policies for education at all stages in the autonomous region at their place of residence. Fifteenth housing and urban construction administrative departments should constantly establish and improve the public rental housing security system, and gradually bring eligible floating population into the scope of public rental housing security.

Encourage and support development zones, industrial parks and enterprises with concentrated floating population, and build dormitories for floating population. Article 16 The administrative department of health shall provide basic public health services such as health education and disease prevention for the floating population, and provide family planning technical services for couples of childbearing age who practice family planning among the floating population. Seventeenth market supervision and management departments shall provide registration services for the floating population engaged in production and business activities in accordance with the law, and safeguard the legitimate rights and interests of the floating population in production and business activities. Article 18 The civil affairs department shall bring the vulnerable groups of floating population into the social assistance system, provide temporary assistance, charitable assistance and other services for vagrants and beggars who have no livelihood and floating population with special difficulties, strengthen the construction of assistance facilities, and improve the functions of assistance services. Nineteenth public security organs should provide convenient services for floating population to declare residence registration and apply for residence permit; In order to apply for settlement and meet the conditions for settlement, the floating population shall go through the settlement procedures in the autonomous region. Article 20 The judicial administrative department shall incorporate the legal publicity and education of the floating population into the overall plan for popularizing law, guide the grassroots people's mediation committees to carry out dispute mediation, and guide the floating population to safeguard their legitimate rights and interests according to law.

Legal aid institutions shall provide legal aid to the floating population who meet the conditions of legal aid.
