People's Republic of China (PRC) Exit and Entry Administration Law
Article 75 stipulates that if a citizen of China is illegally repatriated to another country or region after leaving the country, the entry-exit frontier inspection organ shall confiscate his exit-entry certificate, and the issuing organ of exit-entry certificate shall not issue exit-entry certificate within six months to three years from the date of his repatriation.
In addition, according to Article 12 of the Law of People's Republic of China (PRC) on Exit and Entry Administration, China citizens are not allowed to leave the country under any of the following circumstances:
(1) Failing to hold a valid exit-entry certificate or refusing or evading border inspection;
(two) the punishment has not been completed or belongs to the defendant or criminal suspect in a criminal case;
(three) there are unresolved civil cases, and the people's court decides not to leave the country;
(4) Being subject to criminal punishment for obstructing the administration of the country (border) or being repatriated by other countries or regions for illegal exit, illegal residence or illegal employment, and not allowed to leave the country within the prescribed time limit;
(five) may endanger national security and interests, the relevant authorities in the State Council decided not to leave the country;
(6) Other circumstances under which exit from the country is prohibited by laws and administrative regulations.
Second, the visa process
If you plan to go abroad to visit relatives, friends, travel, study abroad, settle down, get employment or engage in other non-official activities, you need to apply for an ordinary passport of the People's Republic of China. According to different reasons for going abroad, it is also necessary to prepare the following certification materials from relevant domestic units:
(1) To participate in the overseas tour of the tourism team, you must submit the full amount of travel issued by the travel agency with the right to operate overseas tourism.
(2) Those with college education or above who apply for studying abroad at their own expense must submit the Qualification Examination Certificate for Studying Abroad at Their Own Expense issued by the Beijing Municipal Education Commission (address: No.4 Zaojun Temple, Haidian District). Public students studying abroad (including national public students and public students) shall submit and fill in the complete Registration Form for Public Students to Apply for Passports.
(3) Where an adopted child goes abroad to settle down, it shall submit the adoption register, the adopter's passport or other identification documents issued by the provincial civil affairs department where the permanent residence is located.
(4) The dispatched laborers handled by the labor service company shall submit the description of the labor service project issued by the labor service company with the right to operate the dispatched labor service. Where an overseas employment service agency assists in overseas employment, it shall submit the employment contract signed by the applicant and the overseas employer confirmed by the overseas employment service agency with the right to operate overseas employment.
(five) to go abroad for cultural exchanges, the consent certificate issued by the cultural department at or above the provincial level shall be submitted or handled in accordance with relevant regulations.
(6) If you apply for going abroad for other reasons, you don't need to submit overseas invitation materials.
3. How long will foreigners be detained after their visas expire?
According to China's current regulations, foreign citizens staying in China for 10 days will not be punished, but they will be fined from 1 1 day, with a maximum of 5,000 yuan per day in 500 yuan.
