Article 1 This Law is formulated for the purpose of regulating exit and entry administration, safeguarding People's Republic of China (PRC)'s sovereignty, security and social order, and promoting foreign exchanges and opening up.

Article 2 This Law is applicable to the exit and entry administration of China citizens, the exit and entry administration of foreigners, the stay and residence administration of foreigners in China and the border inspection of exit and entry vehicles.

Article 3 The State protects the lawful rights and interests of China citizens when they leave or enter the country.

The lawful rights and interests of foreigners in China are protected by law. Foreigners in China shall abide by the laws of China, and shall not endanger China's national security, harm public interests or disturb public order.

Article 4 The Ministry of Public Security and the Ministry of Foreign Affairs shall be responsible for entry and exit administration according to their respective duties.

The embassies and consulates of People's Republic of China (PRC) and China abroad or other foreign institutions entrusted by the Ministry of Foreign Affairs (hereinafter referred to as foreign visa agencies) are responsible for issuing entry visas for foreigners abroad. Entry-exit frontier inspection organs are responsible for entry-exit frontier inspection. The public security organs of the local people's governments at or above the county level and their entry-exit administrative agencies are responsible for the management of foreigners' stay and residence.

The Ministry of Public Security and the Ministry of Foreign Affairs may, within the scope of their respective functions and duties, entrust the exit and entry administration agencies of public security organs of local people's governments at or above the county level and the foreign affairs departments of local people's governments at or above the county level to accept applications for entry and residence of foreigners.

The Ministry of Public Security and the Ministry of Foreign Affairs should strengthen communication and cooperation in the management of entry-exit affairs, closely cooperate with relevant departments of the State Council, exercise their functions and powers and assume responsibilities according to their respective responsibilities.

Article 5 The State shall establish a unified information platform for entry-exit management to realize information sharing among relevant administrative departments.

Article 6 The State shall set up entry-exit frontier inspection organs at ports open to the outside world.

China citizens, foreigners and means of transport enter and exit from ports open to the outside world. Under special circumstances, you can leave or enter the country from a place approved by the department authorized by the State Council or the State Council. Entry-exit personnel and vehicles shall be subject to entry-exit frontier inspection.

The port restricted area shall be managed by the entry-exit frontier inspection organ. According to the needs of maintaining national security and the order of entry-exit administration, the entry-exit frontier inspection organ may conduct frontier inspection on the articles carried by entry-exit personnel. When necessary, the entry-exit frontier inspection organ may conduct frontier inspection on the goods carried in the entry-exit means of transport, but it shall notify the customs.

Article 7 With the approval of the State Council, the Ministry of Public Security and the Ministry of Foreign Affairs may, according to the needs of entry-exit administration, make provisions on the preservation of fingerprints and other biometric information of entry-exit personnel.

If foreign governments have special regulations on visa issuance and entry and exit management for China citizens, the China government can take corresponding reciprocal measures according to the situation.

Article 8 Departments and institutions that perform entry-exit management duties shall take practical measures to continuously improve their service and management level, enforce the law fairly, facilitate the people and be efficient, and maintain a safe and convenient entry-exit order.

Chapter II Entry and Exit of China Citizens

Article 9 China citizens shall apply for passports or other travel documents when leaving or entering the country.

China citizens who want to go to other countries or regions also need to obtain visas or other entry permits. However, unless the China government has signed visa exemption agreements with other governments or the Ministry of Public Security and the Ministry of Foreign Affairs provide otherwise.

China citizens who leave or enter the country as seafarers and work on foreign ships shall apply for a seaman's certificate according to law.

Article 10 Citizens of China who travel between the Mainland and the Hong Kong Special Administrative Region and the Macao Special Administrative Region, and citizens of China who travel between Taiwan Province Province, shall apply for a pass according to law and abide by the relevant provisions of this Law. Specific management measures shall be formulated by the State Council.

Eleventh China citizens leaving or entering the country shall submit their passports, other travel documents and other exit and entry documents to the entry-exit frontier inspection authorities, and shall go through the prescribed procedures before leaving or entering the country.

At qualified ports, the entry-exit frontier inspection organs shall provide special passages and other convenient measures for China citizens to enter and leave the country.

Twelfth China citizens are not allowed to leave the country under any of the following circumstances:

(1) Failing to hold a valid exit-entry certificate or refusing or evading border inspection;

(two) the punishment has not been completed or belongs to the defendant or criminal suspect in a criminal case;

(three) there are unresolved civil cases, and the people's court decides not to leave the country;

(4) Being subject to criminal punishment for obstructing the administration of the country (border) or being repatriated by other countries or regions for illegal exit, illegal residence or illegal employment, and not allowed to leave the country within the prescribed time limit;

(five) may endanger national security and interests, the relevant authorities in the State Council decided not to leave the country;

(6) Other circumstances under which exit from the country is prohibited by laws and administrative regulations.

Article 13 China citizens who have settled abroad who wish to return to China for settlement shall apply to the embassies and consulates of People's Republic of China (PRC) and China or other overseas institutions entrusted by the Ministry of Foreign Affairs before entering the country, or they may apply to the overseas Chinese affairs department of the local people's government at or above the county level through their relatives.

Fourteenth China citizens who have settled abroad need to provide identification when handling financial, education, medical care, transportation, telecommunications, social insurance, property registration and other matters in China, and they can prove their identity with their passports.
