Article 1 In order to regulate the registration of foreign-related adoptions, these Measures are formulated in accordance with the Adoption Law of People's Republic of China (PRC).
Article 2 Foreigners who adopt children in People's Republic of China (PRC) (hereinafter referred to as foreigners) shall register in accordance with these Measures.
If one of the adopters is a foreigner and adopts a child in China, it shall also be registered in accordance with these Measures.
Article 3 Foreigners adopting children in China shall abide by the relevant adoption laws of China and the adoption laws of the country where the adopter is located; Problems arising from the inconsistency between the legal provisions of the country where the adopter is located and those of China shall be solved by the relevant departments of the two governments through consultation.
Article 4 When a foreigner adopts a child in China, he/she shall submit an application for adoption to an adoption organization entrusted by the government of China (hereinafter referred to as China Adoption Organization) through the government of the host country or an adoption organization entrusted by the government, and submit a report and proof of the adopter's family situation.
The adoption application, family report and certificate of the adopter mentioned in the preceding paragraph refer to the following documents issued by the state-owned organ where the adopter is located, certified by the institution authorized by the foreign diplomatic or diplomatic authorities, and certified by the people's Republic of China and the embassies and consulates of China in that country:
(1) An application for intercountry adoption;
(2) birth certificate;
(3) proof of marital status;
(4) Proof of occupation, economic income and property status;
(5) physical health examination certificate;
(six) no proof of criminal punishment;
(seven) the certificate that the competent authorities of the country where the adopter is located agree to the cross-border adoption of the child;
(8) Family report, including the identity of the adopter, the qualification and appropriateness of adoption, family status and medical history, adoption motivation and characteristics suitable for taking care of children, etc.
If a foreigner who has worked or studied in China for more than one year adopts a child in China, he/she shall submit documents other than the medical examination certificate as mentioned in the preceding paragraph, as well as proof of marital status, occupation, economic income or property status, proof of criminal punishment and medical examination certificate issued by medical institutions at or above the county level.
Article 5 The person who puts out the child for adoption shall submit the residence booklet and identity card to the civil affairs department of the people's government of the province, autonomous region or municipality directly under the Central Government (if the social welfare institution is the child for adoption, it shall be submitted.
Submit the identity certificate of the person in charge and the household registration certificate of the adoptee. , and submit the following relevant supporting materials according to different situations:
(1) If the adoptee's biological parents (including divorced parents) are adopters, it shall submit the proof that the biological parents have special difficulties and are unable to support them, and the written opinions of both parents agreeing to adopt;
Among them, if the biological father or mother of the adoptee is unilaterally adopted due to the death of the spouse or the whereabouts of one of them are unknown, a certificate of the death or whereabouts of the spouse and a written statement that the parents of the deceased or the spouse whose whereabouts are unknown do not exercise the priority custody right shall be submitted;
(2) If both parents of the adoptee do not have full capacity for civil conduct, and the other guardians of the adoptee are adopters, a certificate that the adoptee's parents do not have full capacity for civil conduct and are seriously harmful to the adoptee, and a certificate that the guardian has custody shall be submitted;
(3) If the adoptee's parents are both dead and the adoptee's guardian is the adopter, the death certificate of his biological parents, the certificate that the guardian actually assumes the guardianship responsibility, and the written opinions of other people who have the obligation to support the adoption shall be submitted;
(4) If the social welfare institution is the person who puts out the child for adoption, it shall submit the certificates of abandonment and discovery of the abandoned baby and children, and look for the certificates of their parents or other guardians; If the adoptee is an orphan, it shall submit the death of the orphan's parents or the declaration of death, as well as the written opinions of other people who have the obligation to raise orphans to agree to the adoption.
Where a disabled child is put out for adoption, a child disability certificate issued by a medical institution at or above the county level shall also be submitted.
Article 6 The civil affairs departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall examine the certificates and supporting materials submitted by adopters, and make public the abandoned babies and children whose biological parents cannot be found.
Find their biological parents; If it is considered that the adoptee and the adopter meet the requirements stipulated in the adoption law, it shall notify the China adoption organization of the list of adoptees and adopters that meet the requirements stipulated in the adoption law, and forward the following documents and supporting materials:
(a) a copy of the residence booklet and identity card (the identity certificate of the person in charge of the social welfare institution);
(2) Copies and photos of the certificate, household registration certificate, growth report and physical examination certificate that the adoptee is an abandoned baby or orphan.
The announcement of the civil affairs departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to find abandoned babies or children's biological parents shall be published in provincial local newspapers. If the biological parents or other guardians of abandoned babies or children fail to claim them within 60 days from the date of announcement, they shall be deemed as abandoned babies or children whose biological parents cannot be found.
Article 7 Adoption organizations in China shall, after examining the adoption applications and relevant certificates of foreign adopters, report them to the civil affairs departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government for approval.
Among the adoptees who meet the legal requirements, select the appropriate adoptee according to the wishes of foreign adopters, and send the relevant information of adoptees and adopters to foreign adopters through foreign governments or foreign adoption organizations. If a foreign adopter agrees to adopt, the China Adoption Organization will send him a notice of adopting a child in China, and notify the civil affairs departments of the people's governments of relevant provinces, autonomous regions and municipalities directly under the Central Government to send the adoptee a notice of consent to adoption.
Article 8 Foreigners who come to China to adopt children shall go through the registration formalities in person. If the husband and wife adopt together, they shall jointly go through the adoption formalities in China; If one party is unable to come to China for some reason, it shall

Article 9 Foreigners who come to China to adopt children shall sign a written adoption agreement with the adopter. This agreement is made in triplicate, one for the adopter and one for the adopter, which will be collected when the adoption registration formalities are completed.
Keep a copy in the registration authority. After concluding a written agreement, the parties to the adoption relationship shall * * * go through the adoption registration with the civil affairs department of the people's government of the province, autonomous region or municipality directly under the Central Government where the adoptee's permanent residence is located.
Article 10 When handling the adoption registration, the parties involved in the adoption relationship shall fill in the Application for Registration of Children Adopted by Foreigners in China, submit the adoption agreement and provide relevant materials respectively.
The adopter shall provide the following materials:
(1) A notice of adoption of children in China issued by a domestic adoption organization;
(2) the identity certificate and photos of the adopter.
The person placing out the child for adoption shall provide the following materials:
(a) the adoptee has been issued by the civil affairs department of the people's government of a province, autonomous region or municipality directly under the Central Government.

Article 11 After receiving the application for registration of children adopted by foreigners in China and the relevant materials of adopters, adoptees and their adopters, the adoption registration authority shall, within 7 days from the next day,
Review, in line with the provisions of article tenth of these measures, apply for adoption registration for the parties, and issue an adoption registration certificate. The adoption relationship shall be established from the date of registration.
The adoption registration authority shall notify the China adoption organization of the registration result.
Article 12 After the adoption registration is completed by the parties involved in the adoption relationship, if the parties or one of them requests for notarization of adoption, they shall go to a notary office qualified for notarization of foreign affairs in the place where the adoption is registered.

Article 13 Before the adoptee leaves the country, the adopter shall go through the exit formalities for the adoptee with the adoption registration certificate at the public security organ where the adoption is registered.
Article 14 Foreigners who adopt children in China shall pay the registration fee to the registration authority.
The registration fee shall be charged in accordance with the relevant provisions of the state.
Adoption organizations in China are non-profit public welfare institutions, which provide adoption services for foreign adopters and can charge service fees. Service fee standards shall be implemented in accordance with relevant state regulations.
In order to support abandoned babies and children living in social welfare institutions, the state encourages foreign adopters and foreign adoption organizations to donate to social welfare institutions. The recipient social welfare institution must use all the donated property to improve the raising conditions of abandoned babies and children, and shall not use it for other purposes, and shall inform the donor of the use of the donated property. The recipient social welfare institutions shall also accept the supervision of relevant departments and publicize the use of donations to the society.
