Measures for the Administration of Feilaixia Water Control Project in Guangdong Province

Article 1 In order to strengthen the management of Feilaixia Water Control Project, ensure the normal operation of the project and give full play to the benefits of the project, these measures are formulated in accordance with the provisions of relevant state laws and regulations. Article 2 The Water Resources Department of Guangdong Province is the competent department of Feilaixia Water Control Project. Guangdong Feilaixia Water Control Project Construction Management Bureau (hereinafter referred to as the Construction Management Bureau) is the construction and management organization of Feilaixia Water Control Project, and is responsible for the implementation of these measures. Article 3 The management scope of Feilaixia Water Control Project: the hub buildings, engineering ancillary facilities and land approved by the government in Shengping Town, Feilaixia Management Area, Qingyuan City, and the land and water surface below the land requisition line approved by the government on both sides of the upstream trunk and tributary of the hub, that is, the land and water surface below the land requisition line on both sides of the Beijiang River from the hub dam site to Jiangjiazhou Gorge and Lianjiang tributary in Wangbu Town, yingde city to Anghu Park in Xiniu Town, yingde city.

The ownership of land and water surface within the management scope belongs to the state, and the right to use it belongs to the Construction Management Bureau. Article 4 The scope of protection and water source protection of Feilaixia Water Control Project:

(1) The protection scope of Feilaixia Water Control Project: the land above the land requisition line on both sides of the upstream of the dam site, that is, the land between the main stream of Beijiang River from the dam site to the downstream of Jiangjiazhou in Wangbu Town, yingde city, the tributary of Lianjiang River to the land requisition line on both sides of Yanghu Garden in Xiniu Town, yingde city and the design flood level.

(II) Water source protection scope of Feilaixia Water Control Project: the land above the first watershed ridge from the design flood level, that is, the land between the main stream of Beijiang River from the project dam site to the downstream of Jiangjiazhou in Wangbu Town, yingde city, the tributary of Lianjiang River to the design flood level on both sides of Anghu Garden in Xiniu Town, yingde city, and the first watershed ridge.

The original ownership and use right of the land within the scope of protection and water source protection remain unchanged, but it must be used in accordance with the provisions of these measures. Article 5 The Construction Management Bureau shall bury permanent boundary markers within the scope specified in Articles 3 and 4 of these Measures, and no unit or individual may move or damage the permanent boundary markers buried by the Construction Management Bureau. Article 6 Where new buildings, such as bridges, docks, roads, ferries, pipelines, cables, water intakes, sewage outlets, factories, warehouses, industrial and civil buildings and other public facilities cross rivers, rivers, dikes and rivers within the management scope and protection scope of the hub, the consent of the Construction Management Bureau shall be obtained before applying for the construction permit, and the consent of the Provincial Water Resources Department shall be obtained for important construction projects. Approved by the Construction Management Bureau or the Provincial Water Resources Department, the examination and approval procedures can be handled according to the basic construction procedures. Article 7 Units and individuals engaged in activities such as quarrying (mining), earth borrowing, land reclamation, tree cutting and other activities that destroy vegetation and landforms within the protection scope of the hub and water source shall report the water and soil conservation plan to the Construction Management Bureau, and report it to the local water administrative department for approval after being examined and approved by the Construction Management Bureau. Article 8 Any unit or individual who uses reservoir water shall first report to the Construction Management Bureau, install water metering facilities after approval, and pay water charges to the Construction Management Bureau according to regulations. The water fee standard is approved according to the "Guangdong Province Water Conservancy Project Water Fee Verification, Collection and Management Measures". Article 9 When ships (including bamboo rafts and floating objects) pass through the lock, they must obey the command of the management personnel and pay the lockage fee to the Construction Management Bureau in accordance with the Measures for the Administration of Water Charge Collection of Water Conservancy Projects in Guangdong Province. Tenth dam crest highway, dam crest highway and dam crest highway are special passages for project management, and no unit or individual may use them without the consent of the Construction Management Bureau. Under the same conditions, priority can be given to immigrants from the reservoir area. Fourteenth pollution sources entering the management scope of the hub shall be ordered by the environmental protection department of the city and county (district) to treat themselves within a time limit according to the principle of "whoever pollutes". Fifteenth illegal buildings and other obstacles within the scope of management and protection of the hub shall be submitted by the Construction Management Bureau to the relevant departments to order the parties to dismantle (clear) within a time limit. The cost of demolition (removal) shall be borne by the person responsible for illegal construction. Sixteenth in violation of the relevant provisions of these measures, one of the following acts, by the Provincial Water Resources Department commissioned by the Construction Management Bureau in accordance with the water laws, regulations and rules for punishment:

(a) in violation of the provisions of article sixth and article seventh of these measures;

(2) Crawler tractors, hard-wheeled vehicles and overweight vehicles run on the dam crest, dam crest and sluice dam traffic bridge, and run on the dam crest or the dam crest without pavement after rain;

(3) Grazing, planting, shoveling grass, piling up sundries and drying grain and grass on dikes and channels;

(4) Non-management personnel operate flood gates, sluices and other equipment of the hub without authorization, which affects the normal operation of the hub.
